RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION N0. 1353 - JOHN AND JUNE
PARAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a request for Recorded Exemption No. 1353, submitted by John and
June Paral for property which is located in part of Section 5, Township 6 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 135 acres and 5 acres.
WHEREAS, after reviewing the recommendation of the Planning staff and
hearing the testimony presented, the Board determined that said request shall be
denied for the following reasons:
1. It is the opinion of the Board of County Commissioners that this
proposal evades the purpose of the Weld County Subdivision
Regulations as defined in Section 1-3.
2. The Board feels that this proposal and the existing land splits in
this area do not represent efficient and orderly development.
3. The Board feels further residential development in this area will
create an increased demand for urban-type services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for Recorded Exemption 111353, submitted by
John and June Paral be, and hereby is, denied.

Subject: Recorded Exemption #1353
Dear Commissioners:
This request for a recorded exemption is submitted by John and June Paral. The
parcel of land is described as part of Section 5, T6N, R66W, of the 6th P.M. ,
Weld County, Colorado. The property is located north of Weld County Road 72 and
east of Weld County Road 27. This request is to divide a 140 acre parcel into
two parcels of 135 acres and 5 acres, more or less. There are no improvements
on either of the proposed lots.
The applicants propose using North Weld County Water District as the water source
for both lots. Septic systems will provide sewage disposal.
The Department of Planning Services' staff recommends that this request be
denied. The staff has concerns about the potential for continued land splits in
this section. During 1989 this section was divided into 7 parcels. In December
of 1989, the Board approved RE-1222 and if this request is approved there will
be 9 parcels in this section. Residential development in this area will create
an increased demand for urban type services.
It is the opinion of the Department of Planning Services' staff that this
proposal evades the purpose of the Weld County Subdivision Regulations as defined
in Section 1-3. The staff feels that this proposal and the existing land splits
in this area do not represent efficient and orderly development. The submitted
maps demonstrate the piecemeal development which has occurred. The staff would
like the Board to review the submitted materials and determine whether it wishes
to allow this trend to continue.

Your recorded exemption application is complete and in order and will be processed
on or before June 10, 1991. If it is determined that the application meets the
approval criteria of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations, you will be notified that the recorded exemption is
approved. If the staff determines that the application does not meet the approval
criteria, you will be notified and asked to appear before the Board of County
Commissioners at a public hearing. You will be informed of the hearing date prior
to the hearing. The Board of County Commissioners will then consider your
application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Town of Severence Planning Commission for its review and comments.

Re: Application for Recorded Exemption
Ladies & Gentlemen:
Enclosed please find the following: Recorded Exemption
application fee in the amount of $ 600 . 00 , Certificate of
Conveyances , application form, copy of deed , letter from North
Weld County Water District , and map of subject properties .
Additionally, this letter should be considered as a part of the
Recorded Exemption application.
This proposal is to divide a 140 acre parcel into two
parcels, the smaller being 5 .5 acres and the larger being 134 . 674
acres . The two proposed parcels are located South of Woods Lake
which is located approximately two miles East of the town of
Severance . At the present time this property is used for
agricultural purposes and the Northwest corner of the property
(proposed Lot "A" ) is a dryland knoll which cannot be irrigated
and has not been used for agricultural purposes . The owner of
the subject property has cleaned up the proposed Lot "A" by
removing debris and abandoned equipment and planted the dryland
knoll with a dryland grass mixture . Due to the location of the
proposed Lot "A" , the size of the knoll and lack of irrigation ,
the proposed Lot "A" cannot be used for productive agricultural
purposes and is best suited for a rural residence.
The proposal is consistent with the ag zone district ,
compatible with existing surrounding land uses and compatible
with future proposed existing uses . Existing uses include
agriculture , the Woods Lake Yacht Club and rural residential .
Expected future uses include those as identified and additional
construction of rural residences in the area surrounding Woods
Lake . These parcels are not projected in the Comprehensive Plan
or Master Plan of the town of Severance for development and the

Comprehensive Plan of Weld County shows this area as also being
rural in nature with ag zoning and rural residences . It should
also be mentioned that at the time the various parcels of land
around Wood Lake were sold it was contemplated that rural
residences would be constructed and that was the reason the sales
of parcels took place and the creation of the Wood Lake Yacht
Club.
This plan is consistent with the policies of the Weld
County Comprehensive Plan as the 140 acre parcel does not have
a residence at this time and there is no .removal of land from
agricultural production. Additionally, under the Comprehensive
Plan the owner is entitled to have a separate residential parcel
upon the subject property.
The property is not subject to any overlay district and is
not located within a flood plain or geological hazard area.
The owners understand that no home can be constructed upon
the proposed Lot "A" until all requirements are met under the
individual sewage disposal system and permits of Weld County.
Two other residences have been constructed around Wood Lake in
the past two years and as this site is higher in elevation and
further away from the lake it is not contemplated that the use of
an individual sewage system and leach line would be a problem.
Upon your approval of this Recorded Exemption application,
a final plat map will be prepared in accordance with the
requirements . Your approval of this application is requested .
