RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR THE SUBSTITUTION OF A NONCONFORMING USE IN THE I-1 INDUSTRIAL ZONE DISTRICT, TO INCLUDE STORAGE OF VEHICLES OVER 6,000 POUNDS GROSS VEHICLE WEIGHT - HAROLD ANDREWS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 12th day of February, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Harold Andrews, 1400 16th Avenue, Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review Permit for the substitution of a nonconforming use in the I-1 (industrial) Zone District, to include storage of vehicles over 6,000 pounds gross vehicle weight on the following described real estate, to-wit: Lot B of RE-333, located in the SE,'- of Section 9, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Fred Otis, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Goals and Policies. The City of Greeley has reviewed this proposal and found no conflict with its interests. This proposal is also consistent with the Industrial Goals and Policies of the Weld County Comprehensive Plan and the existing development in the neighborhood. This proposal is not consistent with the intent of the I-1 Zone District. However, the use is consistent with the Weld County Zoning Ordinance. There is an existing nonconforming use on the property. Therefore this proposal is evaluated in terms of Section 73.2.1 of the Zoning Ordinance. That section of the Ordinance allows for the substitution of a nonconforming use provided the Board of County Commissioners finds that the proposed use is equally appropriate or more appropriate to the zoning district and neighborhood than the existing nonconforming use. c. The attached Conditions of Approval and Development Standards will insure compatibility with the future development of the surrounding area. d. The subject site is in the Airport Overlay District, but there are no activities or structures on the property which will conflict with the district. No other overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for the substitution of a nonconforming use in the I-1 (Industrial) Zone District, to include storage of vehicles over 6,000 pounds gross vehicle weight on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners: a. The applicant shall submit written evidence to the Department of Planning Services' staff that a drainage plan has been approved for the subject site by Weld County Engineering. 920125 SPECIAL REVIEW PERMIT - ANDREWS PAGE 3 b. The applicant shall amend the plat to demonstrate that all parking spaces will meet the set back requirements prescribed for structures in the I-1 Zone District. c. The applicant shall place the following note on the plat: "This property is located in the airport overlay district and shall comply with all applicable regulations." Webster 920125 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS HAROLD ANDREWS USR-964 1. The Site Specific Development Plan and Special Review Permit is for the substitution of a nonconforming use in the I-1 (Industrial) Zone District, to include storage of vehicles over 6,000 pounds gross vehicle weight, as submitted in the application materials on file in the Department of Planning Services, limited to 30 vehicles and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The Special Review Permit shall terminate if the use of the land ceases for any reason for a period of more than six months. Any subsequent use of the property shall conform to the regulations specified in the Weld County Zoning Ordinance for the I-1 (Industrial) Zone District. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. Derelict vehicles or junk, as defined in Section 10.1 of the Weld County Zoning Ordinance shall not be stored on the property. 10. The parking areas designated on the plat shall be covered with an all- weather surface of gravel or pavement or other suitable road base, capable of supporting the weight of vehicles over 6,000 pounds gross vehicle weight. 11. The property shall be maintained in a manner consistent with the drainage plan approved by Weld County Engineering. 12. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 920125 DEVELOPMENT STANDARDS - ANDREWS PAGE 2 13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 14. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 18. All vehicle parking shall meet the same set back requirements prescribed for structures in the I-1 Zone District. 920125 HEARING CERTIFICATION DOCKET NO. 92-11 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR THE SUBSTITUTION OF A NONCONFORMING USE IN THE I-1 (INDUSTRIAL) ZONE DISTRICT, TO INCLUDE STORAGE OF VEHICLES OVER 6,000 POUNDS GROSS VEHICLE WEIGHT - HAROLD ANDREWS A public hearing was conducted on February 12, 1992, at 10:00 A.M. , with the following present: Commissioner George Kennedy, Chairman Commissioner Constance L. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated January 29, 1992, and duly published January 30, 1992, in The New News, a public hearing was conducted to consider the request of Harold Andrews for a Site Specific Development Plan and Special Review Permit for the substitution of a nonconforming use in the I-1 (Industrial) Zone District, to include storage of vehicles over 6,000 pounds gross vehicle weight. Lee Morrison, Assistant County Attorney, made this a matter of record. Brian Grubb, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Fred Otis, Attorney representing the applicant, said Harold and John Andrews are present. Mr. Otis explained the property is zoned I-1 (Industrial) , and the request is to allow truck parking on the property. He said the property used to be a salvage yard, but has been cleaned up by the Andrews. In reference to the plat, Mr. Otis said there is an 180-foot set back off the Highway, and during the Planning Commission hearing, the parking area on the apron of the property was deleted. He said they would like that area reinserted to allow parking of trucks which are for sale. Commissioner Lacy mentioned the letter from the State Highway Department concerning the screening of visibility. John Andrews, son of applicant, answered questions of the Board. There was further discussion concerning the required distance from a right-of-way, which Mr. Grubb said is 25 feet. (Changed to Tape #92-09 during discussion. ) In response to a question from Commissioner Harbert, Mr. Andrews said they are agreeable to all other Conditions of Approval and Development Standards. Mr. Otis suggested the distance of the set back be shown on the plat. Mr. Grubb suggested adding Development Standard #18, regarding the set back requirements prescribed for structures in the I-1 Zone District, and read said addition into the record. He also suggested deleting Condition of Approval #3b which amended the plat to delete all parking spaces within 175 feet of the centerline of 18th Street. After further discussion, Mr. Grubb read language into the record to replace Condition of Approval #3b, which consisted of amending the plat to demonstrate that all parking spaces will meet the set back requirements prescribed for structures in the I-1 Zone District. Commissioner Lacy clarified that the Board is not making the City of Greeley's recommendation, concerning paving of the parking area and driveway, a requirement because the area has been gravel for many years. Commissioner Harbert moved to approve the request of Harold Andrews for a Site Specific Development Plan and Special Review Permit for the substitution of a nonconforming use in the I-1 (Industrial) Zone District, to include storage of vehicles over 6,000 pounds gross vehicle weight, based on the recommendation of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, with changes and additions, as entered into the record. Fred Otis, representative for the applicant, Harold Andrews, explained this is a change in an existing nonconforming use. Harold Andrews bought this property several years ago when it was a salvage yard. It has since been cleaned up, and it is now a more attractive piece of property. It is still zoned Industrial, has 4 nice looking buildings on it. One of the buildings is presently being used as a tractor repair facility and there are some tractors and trailers on site. This is not permitted in the I-1 (Industrial) zone. Therefore the planning staff asked us to file a petition to change the nonconforming use so these uses are permitted. Bud Clemons said he drives by daily and wants to commend the applicant on the attractiveness of the property. Shirley Camenisch asked about the gross weight of the trucks. John Andrews said the trucks and trailers are normal semi-trucks you see on the highway. Bud Clemons asked if most of the work done on the trucks takes place inside. John Andrews said yes, very little is done outside. Bill O'Hare also wanted to compliment Mr. Andrews on the attractiveness of the site. Jean Hoffman asked about vehicles parked on setbacks. John Andrews said if they wanted to sell one of the vehicles they would like the option of parking it where it could be seen. Brian Grubb said this issue was covered in Condition of Approval #3. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. Derelict vehicles or junk, as defined in Section 10.1 of the Weld County Zoning Ordinance shall not be stored on the property. 10. The parking areas designated on the plat shall be covered with an all- weather surface of gravel or pavement or other suitable road base, capable of supporting the weight of vehicles over 6,000 pounds gross vehicle weight. 11. The property shall be maintained in a manner consistent with the drainage plan approved by Weld County Engineering. 12. In the previous applications, it has been stated storm water would have little effect because of low density and a flat terrain. For the first application, I visited the site in June of 1988 where I saw very low density, and a grassed area in the rear where runoff would drain. In January of 1990, the application materials indicated that no drainage plan was necessary because runoff from the building would go to the north into a pond. See attached memorandums dated June 20, 1988 and February 1, 1990. The materials submitted with this application indicate the proposed building sits where the storm water was directed as indicated by previous applications. In the letter dated October 23, 1991, paragraph 4 indicates the storm water will now drain onto adjacent agricultural property to the north. The continued addition of buildings and truck parking areas to this property will change the runoff characteristics.
