RE: CREATION OF WELD COUNTY ROAD 63 LOCAL IMPROVEMENT DISTRICT NO. 1991-3
A public hearing was conducted on August 21, 1991, at 10:00 A.M. , with the
following present:
Commissioner Gordon E. Lacy, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert - Excused
Commissioner C. W. Kirby
Commissioner W. H. Webster
Also present:
Acting Clerk to the Board, Shelly Miller
Assistant County Attorney, Lee Morrison
Director of Engineering, Drew Scheltinga
The following business was transacted:
I hereby certify that pursuant to a notice dated July 10, 1991, and duly
published July 18, 1991, in The New News, a public hearing was conducted
to consider the creation of a local improvement district, to be known as
Weld County Road 63 Local Improvement District No. 1991-3. Lee Morrison,
Assistant County Attorney, made this a matter of record. Drew Scheltinga,
Director of Engineering, said that the Engineering Department is ready to
proceed with said District; however, he received a phone call from Julia
Warehime, one of the petitioners, who said they are not ready. Ms.
Warehime also submitted a letter to the Board stating there has been a
change in their income. Clinton Warehime, other petitioner, was present
and explained that due to a Social Security Disability settlement which
they have to pay back, they are not financially able to proceed at this
time. Mr. Morrison stated that if the Warehimes needed more than a one-
year extension, he recommends dismissing said matter and starting over
when they are ready to proceed. Mr. Warehime said they have to pay back
$14, 000.00, which will not be possible within one year. Chairman Lacy
recommended dismissing the matter at the request of the petitioners. The
Board concurred that there would be no prejudice in the event that the
Warehimes reapply. Commissioner Kennedy moved to dismiss said matter
concerning the creation of a local improvement district on Weld County
Road 63, without prejudice. Commissioner Kirby seconded the motion, and
it carried unanimously.
This Certification was approved on the 26th day of August, 1991.
