HomeMy WebLinkAbout931359.tiff t,0 MINUTES WELD COUNTY COUNCIL September 1, 1993 Tape #15-93 The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at the Severance Town Hall, 336 First Street, Severance Colorado, on Wednesday, September 1, 1993, at 7:30 p.m. ROLL CALL: The meeting was called to order by President Young, and the following members were present, constituting a quorum of the members thereof: President Young, Vice President Campbell and Councilman On. Councilwoman Janda and Councilman Gardner were excused. Also present were Adolph and Thelma Winter and the Council secretary. APPROVAL OF MINUTES: Councilman On made a motion to approve the minutes of the August 4, 1993 meeting. Vice President Campbell seconded the motion. Vote was taken and the motion carried unanimously. Vice President Campbell made a motion to approve the minutes of the August 23, 1993 meeting. Councilman Orr seconded the motion. Vote was taken and the motion to approve the minutes carried unanimously. APPOINTMENTS: President Young noted the appointments listed and mentioned that he would be unable to attend the Elected Officials' Meeting on September 13, 1993. ADDITIONS TO AGENDA: There were no additions to the Agenda at this time. CORRESPONDENCE: The correspondence received was duly noted by President Young and was subsequently circulated among the Council members. 1#16]] 531359 Weld County Council Minutes Page 2 September 1, 1993 REPORTS: COORDINATOR REPORTS Councilman On attended the last Planning Department Task Force meeting. He reported that Weld County now recognizes major irrigation ditches with deeded easements to be legal boundaries as a result of this task force. This means that no recorded exemption would be necessary. Other major ditches that are not deeded easements are currently being studied by the task force in order to ensure uniformity of the regulation. This was referred to as an example of a positive outcome from the task force working with citizens' concerns. President Young attended the August Elected Officials' meeting. OLD BUSINESS: DISCUSSION RE PERFORMANCE AUDIT OF THE WELD COUNTY TREASURER Vice President Campbell made a motion to withdraw his August 4 motion tabling this issue. The motion died for lack of a second. Councilman Orr commented that there was no need to either take any action now or to drop the issue and suggested keeping the motion on the table. Vice President Campbell expressed his conviction that the Commissioners are doing everything possible and agreed with Councilman On to keep a performance audit in consideration. Councilman Orr then went on record as saying that there were no improprieties involved with the Weld County Treasurer; however, that if the Council left the motion on the table, it would serve as a message to the County Commissioners and the Weld County Treasurer that the matter has not been forgotten and will be reconsidered in the future. He subsequently made a motion to leave this issue on the table indefinitely. Vice President Campbell seconded the motion. Vote was taken and the motion carried unanimously. CORONER'S OFFICE FOLLOW-UP Vice President Campbell briefly explained the events leading up to this agenda item. He had met with Mr. Frank Stewart during the past month and will follow up at the next Council meeting by investigating further the supposed discrepancy of hours worked by Coroner's Office employees. NEW BUSINESS: PAYMENT OF THE BILLS Weld County Council Minutes Page 3 September 1, 1993 Councilman Orr made a motion to approve the payment of the bills as amended. Vice President Campbell seconded the motion. Vote was taken and the motion carried unanimously. Mileage for Ralph Campbell $28.00 Reimbursement for Ralph Campbell $46.05 Mileage for James Gardner $16.00 Reimbursement for Sandy Nagel $18.16 Windsor Beacon legal ad $ 8.13 SECRETARIAL RESEARCH REQUESTS There were no secretarial research requests at this time. PUBLIC COMMENTS: Mr. Winter brought up a concern of area residents regarding confusion over the jurisdiction of law enforcement agencies. He also mentioned a problem with weed control in the area. The Council secretary relayed a message received by telephone from John Hoyman regarding the County's voicemail system and that he had encountered a County Attorney's Office message stating that no one was in the office on a Monday workday. He also stated that his telephone calls were not being returned. President Young will follow up on this. BOX 758 .n GREELEY, CO 80632 356-4000, ext. 4780 PRESS RELEASE The Weld County Council , in accordance with the Weld County Home Rule Charter, will meet in regular session on Wednesday, November 3, 1993, at 7:30 p.m. at the Firestone Town Hall , 150 Buchanan Avenue, Firestone, Colorado. The Council will follow up on the Weld County Coroner's Office. The public is invited to attend the Council meeting and provide input on this issue or any other interests they may have pertaining to County government. -30- WELD COUNTY COUNCIL REPORT TO THE PEOPLE SEPTEMBER 21 , 1993 The Weld County Council is mandated by the Home Rule Charter of Weld County, Colorado to report to the people the events that have shaped the previous quarter. This_ report summarizes the activities of the weld County Council during the third quarter of the calendar year 1993 . Continued discussion regarding a performance audit of the Weld County Treasurer, Mike Loustalet, was held during the July Council meeting held at the Milliken Community Center. It was decided that additional research on the scope and cost of an audit would be necessary before a final decision could be made. It was at this meeting that a citizen concern involving the County Coroner's Office was addressed, initiating investigation into personnel matters there. During the April meeting in Greeley, the Council dropped the Weld County Sheriff 's Department reorganization issue. It was also decided to set up a meeting with attorney Dan Harkins, who is representing Weld County in its attempt to recoup lost funds , for the purpose of him explaining the litigation to the Council. A report on the apparently smooth operation of the Coroner's Office was given. At a special meeting of the Council held on August 23, 1993, information to be received by the Council , including the confidential nature of Weld County's pending litigation, required that the Council discussion concerning the legal advice regarding Weld County Council Report to the People Page 2 September 21, 1993 the proposed Weld County Treasurer's audit be held in executive session. The Town of Severance hosted the Council ' s September meeting, with a continuation of the discussion of, and subsequent decision to leave the Weld County Treasurer's performance audit issue on the table indefinitely, with the option of reconsidering it in the future. During the course of the third quarter of 1993, the Council has met periodically with the Commissioners and various Elected Officials and Department Heads in an attempt to keep the lines of communication open. This report is not meant to be an exclusive enumeration of the activities entered into by the Council. It is, however, an attempt to communicate with the voters on our activities . The County Council believes that the Weld County Home Rule Charter continues to be a viable tool for the citizens of Weld County. WELD COUNTY COUNCIL David L.
