HomeMy WebLinkAbout940088.tiff RESOLUTION RE: ACTION OF THE BOARD REGARDING SUBSTANTIAL CHANGE HEARING - BOOTH LAND AND LIVESTOCK COMPANY, C/O JACQUELINE JOHNSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of January, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Booth Land and Livestock Company, c/o Jacqueline Johnson, Karowsky, Witwer, Miller and Oldenburg, P.O. Box 1407, Greeley, CO 80632-1407, for the purpose of considering whether or not there has been substantial change in the facts and circumstances regarding the application, submitted by John and June Paral, for a recorded exemption which was denied by the Board of County Commissioners on July 10, 1991, and WHEREAS, said hearing concerned the application for a recorded exemption on the following described real estate, to-wit: Part of Section 5, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Jacqueline Johnson, Attorney, and WHEREAS, said hearing was conducted according to the Board's policy concerning applications for land-use for property previously denied, said policy having been adopted on May 21, 1986, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning staff and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request to apply for a subdivision exemption shall be approved for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant's representative, in her letter dated December 22, 1993, and at the hearing on January 17, 1994, demonstrated a substantial change in facts and circumstances has occurred. a. The previous owners, John and June Paral, who applied for Recorded Exemption #1353, which was denied, are no longer involved. The previous application was for a recorded exemption, and the new application will be for a subdivision exemption on land containing existing improvements. c. The subdivision exemption will create one lot of approximately two acres, on which improvements currently exist, and which will consolidate the remaining approximately 138 acres with land owned by the applicant and contiguous to the parcel under consideration. No new building sites will be created and no currently farmed land will be taken out of production by the application. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that there has been substantial change in the facts and circumstances regarding the application, submitted by John and June Paral, for a recorded exemption. BE IT FURTHER RESOLVED by the Board that the request of Booth Land and Livestock Company, c/o Jacqueline Johnson, to apply for a subdivision exemption be, and hereby is, approved. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Chuck Cunliffe The following business was transacted: I hereby certify that pursuant to a notice dated January 3, 1994, and duly published January 6, 1994, in the Windsor Beacon, a public hearing was conducted to consider whether or not there has been substantial change in the facts and circumstances regarding the application, submitted by John and June Paral, for a recorded exemption which was denied by the Board of County Commissioners on July 10, 1991. If a finding is made by the Board that a substantial change in the facts and circumstances exists, then the applicant, Booth Land and Livestock Company, c/o Jacqueline Johnson, will be allowed to apply for a subdivision exemption. Lee Morrison, Assistant County Attorney, made this a matter of record. Chuck Cunliffe, Planning Department representative, entered the favorable recommendation of the Planning staff into the record. Jacqueline Johnson, Attorney, represented the applicant and stated concurrence with staff's recommendation. She explained the prior application was for a recorded exemption, which would have created a buildable lot; however, the new owner would like to apply for a subdivision exemption on property which already has existing improvements. Ms. Johnson indicated the subdivision exemption would remove the boundary line between two parcels presently owned by Gary Booth. Mr. Cunliffe clarified Parcels 4 and 5 would be combined with a two-acre parcel left beside the lake. Ms. Johnson confirmed the final layout would be indicated on the plat which would be recorded. After further clarification from Mr. Cunliffe, he confirmed all parcels are owned by Mr. Booth and an access easement has been proposed. In response to a question from Commissioner Harbert concerning justification for the substantial change, Mr. Cunliffe stated a different type of application will be submitted and there are new owners. Mr. Morrison also stated the net result would be different than that of the previous application. He reviewed the Board's criteria to be considered and answered further questions from Commissioner Harbert. Ms. Johnson reiterated the original recorded exemption application was for additional improvements, which this application would not create. Commissioner Kirkmeyer concurred with staff's recommendation and moved to approve that there has been substantial change in the facts and circumstances and to allow the applicant to file a subdivision exemption application. The motion was seconded by Commissioner Harbert.
