My father, Wesley Hall, is the Weld County Coroner. The Weld County Coroner is an elected position, pursuant to § 6-1 of the Weld County Home Rule Charter. Section 14-2 of the Home Rule Charter requires the Board of County Commissioners of Weld County to set and adopt an annual budget for the entire Weld County Government. One of the components of the annual budget will be the budget for the Coroner's Office. As a result, I will be asked, as a Weld County Commissioner, to vote on the entire budget, which may give the appearance of a conflict of interest given my relationship with the Coroner. I wish to make it clear that my relationship with the Weld County Coroner is only a familial one. I do not have any financial interest in any of the duties and/or responsibilities which my father is obligated to perform in the course of his work as Coroner. \if 930855 Secretary of State Board of County Commissioners Weld County Council Page 2 January 7, 1993 I plan to refrain from discussing the specific budget items for the Weld County Coroner when they are presented to the Board of County Commissioners . I feel obligated, however, as a Weld County Commissioner to vote on the annual budget for the entire Weld County operations, even though only a small portion of that budget is allocated for the Coroner. I have consulted with Assistant Weld County Attorney Bruce Barker, and we have concluded that my voting on the annual budget for the entire Weld County operations will not violate the provisions of § 24-18-101, et. seq. , C.R.S. , Colorado Code of Ethics, or the Weld County Home Rule Charter. Neverthe- less, a disclosure is hereby given and a request is made that an advisory opinion be issued from the Secretary of State concerning this matter.
