RE: ASSESSMENT OF COST OF IMPROVEMENTS FOR WELD COUNTY ARROWHEAD LOCAL
IMPROVEMENT DISTRICT NO. 1993-1
A public hearing was conducted on November 3, 1993, at 9:00 A.M. , with the
following present:
Commissioner Constance L. Harbert, Chairman
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Carol Harding
County Attorney, Bruce Barker
County Engineer, Drew Scheltinga
The following business was transacted:
I hereby certify that pursuant to a notice dated September 27, 1993, and
duly published September 30, 1993, in the Windsor Beacon, a public hearing
was conducted to consider the assessment of costs for the Weld County
Arrowhead Local Improvement District No. 1993-1. Bruce Barker, County
Attorney, made this a matter of record and stated the only objection
received is from Virginia M. Williams, 5035 Arrowhead Drive. Mr. Barker
stated the Notice of Hearing was mailed to the affected property owners on
September 29, 1993. Drew Scheltinga, County Engineer, identified the
parcel belonging to Ms. Williams for the Board, and explained she is one
of the property owners being assessed one-half an assessment, since the
road she lives on was not paved during this project. Mr. Scheltinga
reminded the Board two meetings were held prior to the Local Improvement
District process being initiated: one with the homeowners association,
and the second one as a public informational meeting. At those meetings
he discussed the full assessment for each property owner whose lot is
adjacent to roads being paved by this project, and the one-half assessment
for each property owner living on other roads within the subdivision which
are already paved. He said the petition was signed equally by those
receiving a full assessment and a one-half assessment. Mr. Scheltinga
noted the parameters of the project and said he is satisfied with the
results. He said the project came in under the estimated amount due to
the contractor saving and reusing the shoulder material. Total cost is
$171,293.84, and Mr. Scheltinga recommended the full amount be apportioned
to the district, making the full assessment $1,250.32 for 111 lots and the
one-half assessment $625. 16 for 52 lots. There was no public testimony
offered concerning this matter. Commissioner Webster moved to find the
assessment of Weld County Arrowhead Local Improvement District No. 1993-1
to be just and equitable, deny the request for relief from Virginia M.
Williams, and apportion a full assessment amount of $1,250.32 among 111
lots and a one-half assessment amount of $625. 16 among 52 lots. Seconded
by Commissioner Baxter, the motion carried unanimously.
