RE: CONSENT TO ENFORCEMENT OF R _ O U ION OPT G UNIFORM FIRE
CODE BY WESTERN HILLS F ECTI N DISTRICT WITHIN
UNINCORPORATED PORTIONS O WELD CO T ND AUTHORIZE CHAIRMAN
TO SIGN
WHEREAS, the Board f Cou ty C issioners of Weld County,
Colorado, pursuant to Colorado s atu a and the Weld County Home
Rule Charter, is veste with the hority of administering the
affairs of Weld County lorado, a
WHEREAS, Section -1 1002 (1 (d) , CRS, provides that a fire
code promulgated a f' district may not be enforced in
unincorporated porons We d County without the consent of the
Weld County Board Comm sioners , and
WHEREAS, tit\
rn Hills Fire Protection District has
presented a Reuadopting fire codes and standards for
unincorporated portof Weld County and requests consent to
enforce such c des agulations in order to regulate conditions
hazardous to ife anperty from fire or explosion, and provide
for the iss ance of permits for hazardous uses or operations ,
pursuant to . ection 32-1-1002 (1) (d) , CRS, and
WHER S , his ' ire code proposal from the Western Hills Fire
Protection Dist ict is generally consistent with the guidelines
set forth in the o el Fire Code adopted by the Board on September
12 , 198 and
WHERE S, aft r review, the Board deems it in the best
interests f the citizens of Weld County to consent to the
enf�rcem t f the above mentioned Resolution, a copy of which is
attached r to and incorporated herein by reference , subject to
certain to m and conditions, and except Appendix Chapter II-B of
said Code, because it is in conflict with the Weld County Building
Code Ordi nce, Section 20 . 11 . 10 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the enforcement of
the Resolution as hereinabove mentioned, within the unincorporated
portions of Weld County by the Western Hills Fire Protection
District, with the exception of Appendix Chapter II-B of said
Code, be, and hereby is, consented to.
BE IT FURTHER. RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Resolution.
