" /E--_-../155 " "G/E--_-../155O�a .56 SZf l 3 Abd lA0N E.3! .-g3 E-.----P: E s a 2 RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR A NATURAL GAS COMPRESSOR STATION AND 400-FOOT GUYED MICROWAVE TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT - KN FRONT RANGE GATHERING COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 1st day of September, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of KN Front Range Gathering Company, 635 North 7th Avenue, Brighton, Colorado 80601, for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW4 of Section 14, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, at said hearing on September 1, 1993, the Board deemed it advisable to continue said matter to September 15, 1993, to allow the applicant to post its signs, and WHEREAS, at said hearing on September 15, 1993, said applicant was represented by Jean Watson, Attorney, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. The amended proposal will not remove any prime agricultural land from production. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Amended Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The Site Specific Development Plan and Amended Special Review Permit is for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The engine/compressor unit may be in operation twenty-four (24) hours per day, 365 days per year. 4. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. All construction, electrical work and fabrication shall be done in accordance with the Weld County Building Code Ordinance. 6. Recommendations of the Empire Laboratories, Inc. , "Report of a Geotechnical Investigation for Dougan Compressor Station. . ." shall be followed for construction on the site. 7. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 8. The Special Review Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 9. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to water quality and sanitary disposal systems. 10. Safety and fire protection will be as prescribed by the Hudson Fire Protection District, Industry Standards, and/or other applicable rules and regulations of governmental bodies having jurisdiction on the premises. 11. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 12. No permanent disposal of wastes shall be permitted at this site. 14. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 15. All construction activities that disturb more than five (5) acres are required to obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 16. A weed barrier, approved by the Platte Valley Soil Conservation District, shall be placed under the graveled pad at the proposed tower site. 17. The medium intensity strobe lighting shall be modified using a "louver" system. 18. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 19. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 20. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 21. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 22. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 23. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. ADDITIONAL COMMENTS In response to an objection from a surrounding property owner, the Department of Planning Services recommends the use of a louvered modification in the strobe lighting on the proposed tower. The protective louvers do not allow the direct light of the strobes to be seen on the ground by people living in the immediate area. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION August 3, 1993 A regular meeting of the Weld County Planning Commission was held August 3, 1993, in the Centennial Center, 915 Tenth Street, Room 350, Greeley, Colorado. The summary of the last regular meeting of the Weld County Planning Commission, held on July 20, 1993, was approved as read. Election of Officers. It was determined the election of officers would be scheduled for the next regularly scheduled meeting, to be held August 17, 1993. Bud Clemons left at 1:40 p.m. CASE NUMBER: USR-1020 APPLICANT: Western Sugar REQUEST: A Site Specific Development Plan and a Special Review permit to store sugarbeets in the A (Agricultural) zone district. LEGAL DESCRIPTION: Part of the E2 E2 of Section 18, T7N, R65W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately 1.5 miles east of the Town of Ault. The applicant, explained this proposal would allow them to obtain a new site for the storage of sugar beets. The intended location would be more rural and more accessible to local growers. It will help eliminate the traffic in the Towns of Ault and Galeton. SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING August 3, 1993 Page 2 Richard Kimmel asked if they would haul to the Fort Morgan area. The applicant said most likely not, but in an emergency and pending freight costs (Ft. Morgan vs. Greeley) it might be a possibility. The Chairperson asked if the applicant agreed with staff's recommendation. Tony asked if Development Standard #8 could be altered because this facility would not operate continually through the year. He thought the requirement for permanent toilet facilities was a bit excessive. John Pickle explained this requirement was initiated at the State level. No other alternatives other than a possible "vault" system exist. Shirley Camenisch felt the bridge over the haul route should be addressed. Greg Thompson explained Weld County Engineering had no concerns. She asked about alternate accesses if breakdowns of the vehicles occur. Tony explained the access would be widened and an access to the south also exists. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Richard Kimmel moved Case Number USR-1020, Western Sugar, be forwarded to the Board of County Commissioners with the Planning Commission' s recommendation for approval. Shirley Camenisch seconded the motion. The Chairperson asked the secretary to poll the members of the Planning Commission for their decision. LEGAL DESCRIPTION: Part of the NE4 of Section 32, T3N, R65W of the 6th P.M. , Weld County, Colorado. LOCATION: Southwest of the intersection of Weld County Road 28 and Weld County Road 41. Shirley Camenisch moved Case Number USR-1021, Gerrity Oil and Gas Corporation, be continued indefinitely because the Weld County Health Department has determined that a Certificate of Designation will be required for the proposed facility. The applicant feels this is not necessary and has referred the situation to the Attorney General for their comment and review. Extensive discussion followed showing the details of the proposed facility. Fire protection was discussed with Glen Miller, Fire Chief, Platteville Fire Protection District, and it was determined there would be no problem storing required material and supporting this facility. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. John Hoakmiller, surrounding property owner, expressed concern about the proposed oil separation pond, (this item would be covered in the above continued case and does not pertain to this application) . He also said some type of bond should be applied for by the applicant to cover costs to taxpayers if the company doesn' t honor its obligation. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 12. Any required Emissions Permit is obtained from the Air Pollution Control Division, Colorado Department of Health for fugitive dust and odors. 13. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 15. All construction activities that disturb more than five (5) acres are required to obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 16. A weed barrier, approved by the Platte Valley Soil Conservation District, shall be placed under the graveled pad at the proposed tower site. 17. The medium intensity strobe lighting shall be modified using a "louver" system. 18. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 19. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 20. Provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county - Due to the design from the manufacturer, any structure failure should result in collapse of the tower downward upon itself rather than falling outward. In addition, there is no residence or inhabited structure within a distance equal to three tower heights. The entire compressor station site is fenced. Proposed Use will be compatible with the existing surrounding land uses - Existing surrounding land use is pasture land. Construction of the tower will not in any way interfere or compete with the existing use. This investigation was authorized by Bob Wagner of KN r Energy. Included in this investigation were test borings, laboratory testing, and a report of our conclusions and recommendations. The scope of our report was limited to the following: 1) Evaluating the engineering properties of the subsoils E . 2) Recommending types, depths and allowable pressures for f foundation elements. L 3) Presenting recommendations for earthwork and soils related construction with respect to the soils encountered. L The scope of this investigation did not include any environmental assessment for the re:4 presence of hazardous or toxic materials in the soil or groundwater on or near this site. If contamination is suspected or is a concern, it is recommended that the scope of this study be expanded to include an environmental assessment. 'Fhis report was prepared by the firm of Geotechnical Services, Inc. (GSI) under the supervision of a professional engineer registered in the State of Colorado. Recommendations are based on the applicable standards of the profession at the time of this report within this geographic area. This report has been prepared for the exclusive use of KN Energy for specific application to the proposed project, in accordance with generally accepted geotechnical engineering practices. PROPOSED CONSTRUCTION It is proposed to construct a 400 foot guyed tower with guys at 120 degrees and inner guys at 50-80%of outer radius. While tower loads are not known at this time, they are expected to be within normal loads for this configuration. SITE CONDITIONS The site is located South of the South Platte River in North Central Colorado. The Denver formation is present at the surface. The site is nearly flat and covered with native grasses. A natural gas compressor station is operating on the property adjacent to the site. There has been no development on the proposed site,however a natural gas line runs underground through the site. There is a slight rise on the North side of the site,with elevations changing 5 to 6 feet from South to North. FIELD INVESTIGATIONS The field investigation was conducted on May 13, 1993. The exploratory program consisted of four - (4) test borings drilled at the location shown on the Boring Location Plan (Appendix A). Test borings were located in the field by the drilling crew by pacing distances from features shown on the site plan provided and their location should be considered accurate only to the degree implied by the method used. Elevations of the borings were taken from the plans supplied by KN Energy. . L I Test borings were advanced to a depth of 10 and 20 feet below existing grade with a truck mounted Mobile B-57 drill rig using four-inch diameter continuous flight augers. Soil samples were obtained at the sampling intervals shown on the Boring Logs (Appendix B). Undisturbed samples,designated"U"Samples were obtained with thin wall tube samplers,3 inches outside diameter,hydraulically pushed in general accordance with ASTM D1586-84 "Thin Walled Tube Sampling of Soils." California Barrel Samples designated"C"samples were obtained in accordance with ASTM 3550-84, "Ring-Lined Barrel Sampling of soils." the N-value,reported in blows per foot,equals the number of blows required to drive the sampler over the last 12 inches of the sample interval. Split-Barrel Samples,Designated"S"samples,were obtained while performing Standard Penetration Test(STP)with an accordance with ASTM D1586-84 "Penetration Test and Split Barrel Sampling of Soils", the N-Value,reported in blows per foot,equals the number of blows required to drive the sampler over the last 12 inches of the sample interval. The field boring logs were prepared by a representative of GSI in accordance with ASTM D2488-84, "Description of Soils (Visual-Manual Procedure)". Stratification lines represent the approximate boundary between soil types,and the transition may be gradual. No water level readings were made in the drill holes at the times and under conditions stated on the Boring Logs. LABORATORY TESTING The field boring logs were reviewed to outline the depths, thicknesses, and extent of soil strata, and a testing program was established to evaluate the engineering properties of recovered samples. Specific test which were performed include moisture content, density determinations, Atterberg Limits, swell-consolidation tests, and grain size testing. All test were conducted in general accordance with current ASTM or state-of-the-art test procedures. Laboratory test results are presented in Appendix D. Based on the results of this testing program, the field logs were reviewed and supplemented as presented in Appendix B. These final logs represent out interpretation of the field logs, and reflect the additional information gained in the laboratory testing program. GSI Job#2108017 3 June 1, 1993 _ S QL4 rey4:4 SUBSOIL CONDITIONS Subsoil conditions encountered consisted of trace amounts of topsoil,underlain by tan silty sands of the Denver Formation. These sands are dry and well sorted containing some silt and clay. Clay content increases with depth. The sands exhibit no swell potential and a moderate to high bearing capacity. Preconsolidation pressure is on the order of 1500 lbs per square foot. The sands extend from the surface to thirteen (13) feet below ground level. A brown silty claystone was encountered at thirteen (13) feet below ground level. The claystone was moist with fair sorting containing sands and silts. This claystone contained calcite at nineteen (19) to twenty (20) feet below ground level. CONCLUSIONS AND RECOMMENDATIONS In general, this site is considered suitable for the proposed construction. Subsoils L, encountered on this site are generally capable of supporting the anticipated loads. Groundwater was not encountered during drilling and should not be a major concern during • or after construction. u _ TOWER FOUNDATION The tower foundation can be shallow spread footing founded in the silty sand or drilled piers socketed into the claystone. f , A net allowable soil bearing pressure of 2,000 pounds per square foot may be used to size shallow footings. Footing designed using a net soil bearing pressure of 2,000 per square foot could experience total settlements of 3/4 to 1 inches. GSI Job#2108017 4 June 1, 1993 w, re:4 For drilled piers taken to 12 to 15 feet below existing grade we recommend the use of the following data: Cohesion 0 4) 35 degrees a 0.5 Using this data to analyze a pier drilled to 12 foot below existing grade, a diameter of 18 inches and a factor of safety of 2, we obtain a Q allowable of 10 kips. For drilled piers taken to the claystone we recommend that the piers be socketed into the claystone at least 12 inches. An end bearing value of 20 kips per square foot can used for design of drilled piers meeting this criteria. We estimate negligible settlement will occur with piers socketed into the claystone. Drilled piers should be designed to resist lateral loads using a constant of horizontal subgrade reaction in sands and natural overburden soils of 1.5 TSF and a modulus of horizontal subgrade reaction of 35 TSF in the claystone. The modulus values given are for a long twelve (12) inch diameter drilled pier and must be corrected for pier size. GUY ANCHORS We recommend the following values be used for the guy anchors. In areas to accept fill, the top 6 to 12 inches of ground surface should be scarified and recompacted to eliminate a plane of weakness along the contact surface. New fill or reworked clean cohesive soils should be placed in maximum loose lifts of 8 inches thick and compacted to a minimum of 95 percent of the maximum dry density as determined by ASTM D 698-78, Standard Proctor Moisture-Density Relationship. Moisture content at the time of compaction should be controlled to between+2 and-2 percent of the optimum moisture content. Vertical cuts and excavations may stand for short periods of time, but should not be considered stable in any case. All excavations should be sloped back, shored, or shielded for protection of workers. Trenching and excavation activities should conform to federal and local regulations as a minimum. GENERAL In the event that any changes in the nature design, or location of the structure are planned, the conclusions and recommendations contained in this report shall not be considered valid unless the changes are reviewed and the conclusions of this report modified or verified in writing. The analysis and recommendations submitted in this report are based in part upon the data obtained from the four (4) soil borings. The nature and extent of variation between the borings may not become evident until construction. If variations then appear, it will be necessary to reevaluate the recommendation of this report. It is recommended that the soil and foundation engineer be provided the opportunity for general review of the final design and specification in order that earthwork and foundation recommendations may be properly interpreted and implemented in the design and specifications. Stock Piling Topsoil ******************** The depth of top soil on this site is approximately eight inches, which is what we recommend to be stockpiled. Furthermore, to avoid wind and water erosion we recommend that it be cover with a mulch if it is going to be stockpiled for more than a month. Landscaping and Erosion Control Measures **************************************** Underneath the proposed gravel pad, we recommend that a weed barrier be placed to control weeds . Weed barriers are more effective than plastic because they are made of a fabric material and do not decompose as readily as plastic will . Also, they are more effective at preventing weed growth, and they tend to adhere to the soil surface. Reclamation Procedures Upon Cessation of Use ******************************************** Please see the attached seeding recommendation for the recommended species to seed upon cessation of activity. Prior to seedbed preparation the weed barrier strips should be removed. Then an intensive seedbed preparation will be required due to the heavy nature of equipment used on this site . This primary tillage directly followed by planting and mulching is recommended. All of which should occur in the fall after November first on unfrozen ground. Planting should be done with a grass drill that is equipped with double discs, an agitator box, and depth bands . Mulching should follow planting immediately, and it should consist of a native prairie hay free of weed species . Soil Shrink/Swell Potential Relative to Construction **************************************************** The soil at this site is described as a Valent sand, has only a slight potential for shrink/swell, which should not pose a problem for construction at this site . Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated August 16, 1993, and duly published August 19, 1993, in the Windsor Beacon, a public hearing was conducted on September 1, 1993, to consider the request of KN Front Range Gathering Company for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record and noted this matter was continued from September 1, 1993, to allow the applicant time to comply with sign posting requirements. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written and answered questions from the Board concerning the sign posting. Jean Watson, Attorney representing the applicant, stated this request is to locate a tower in the Wattenberg Field at their gas gathering/compression station site. She explained their existing tower in the Hudson area conflicts with the flight patterns of the new airport; therefore, the airport has requested KN to relocate said tower. Ms. Watson indicated this site will provide microwave communication into both Lakewood and Brighton. In response to questions from Commissioner Webster and Chairman Harbert, Ms. Watson said Development Standards and Conditions of Approval are agreeable, and she indicated there should not be a lot of additional traffic. Kip Greenstreet, also representing the applicant, said the tower needs to be accessed only once every three months for maintenance and tower light inspections required by the FCC, unless there are problems. Responding to further questions from the Board, Mr. Greenstreet indicated no interference with radio and/or television reception is anticipated. He explained the lighting system would be shrouded so the strobe is not seen from the ground. Commissioner Kirkmeyer read concerns of surrounding property owners into the record and requested responses. Mr. Greenstreet explained, concerning the possibility of the tower falling, that the tower is 400 feet tall and the property line surrounds it by 230 feet; therefore, unless the guys were intentionally cut, it would not fall straight out but would fall in a heap in one area. Mr. Thompson stated, concerning the surrounding uses, there is an agricultural subdivision, Patches, to the west and south of the site and all other uses are agricultural. Concerning health hazards, James Hart, Radio Consulting Engineer representing the applicant, explained the energy emitted from this tower is far below FCC requirements. After further explanation, he stated the energy emitted is less than that from a microwave oven. Mr. Hart estimated there are at least 200 towers of this type in or near the Denver area. He indicated the tower is for communications for KN only and explained micro-energy, similar to light, is transferred to other towers. Ms. Watson reiterated the communication is internal and for their company system only. The Board stated further concerns about surrounding property owners' television reception. Mr. Hart said the frequencies of satellite dishes and antennas are both above the frequency of the tower; therefore, l ` 930921 RE: HEARING CERTIFICATION - KN FRONT RANGE GATHERING COMPANY PAGE 2 there should be no interference. In response to a question from Commissioner Kirkmeyer, Mr. Thompson said there was not a specific recommendation from the Office of Emergency Management. Nick Pijoan, of the City of Denver, said the FAA indicated the current tower is too tall and asked KN to relocate it. He said Burlington Northern Railroad has also been asked to relocate one of its towers, which he believes Weld County will use for emergency services. Linda McKenna, John McKenna, Dean Secord, Joyce Thaden, and Lydia Johann voiced concerns about effects of the tower and its strobe lighting on their animals, views, radio and television reception, property values, and health. They also stated road conditions have worsened and traffic has increased and questioned why this site was chosen. Ms. Watson responded by summarizing the surrounding property owners' concerns and reiterating that the lighting will be shrouded and there is no scientific basis for problems with television reception or animals. She said the tower was strategically placed so only one tower was necessary, and the dispatching will be done from Brighton. Ms. Watson stressed the fact that KN has every intention of being a good neighbor. There was discussion concerning the height of the base of the tower, which will be on top of Smith Mound, compared to the height of the houses. Responding to questions from the Board, Ms. Watson reiterated the radiation emitted would be less than released from a microwave oven, and Mr. Greenstreet indicated FCC requires the top of tower to be lighted with two more sets of lights one-third of the way down the tower. He estimated the first shrouded light to be at 133 feet. In response to questions from Commissioners Webster and Baxter, Ms. Watson said she has had no personal experience, as KN's attorney, nor has she any personal knowledge of any protective agreements for adverse effects. She stated it would be greatly appreciated if this project could be moved on, because the airport is waiting and the time table is an imminent problem. Commissioner Webster moved to approve the request of KN Front Range Gathering Company for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. He stated the proposal has been researched with great expertise and requested KN to be a good neighbor and maintain continual contact with the people in the area. The motion was seconded by Commissioner Baxter, who stated he would be more comfortable with assurance that KN would consider and follow up on any problems in the area. Ms. Watson made that assurance and reiterated their intent to be a good neighbor. Commissioner Kirkmeyer stated she would vote against the motion because of the incompatibility with the present and future development. On a roll-call vote, the motion carried four to one, with Commissioner Kirkmeyer voting nay.
