HomeMy WebLinkAbout930882.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR A NATURAL GAS COMPRESSOR STATION AND 400-FOOT GUYED MICROWAVE TOWER IN THE A (AGRICULTURAL) ZONE DISTRICT - KN FRONT RANGE GATHERING COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 1st day of September, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of KN Front Range Gathering Company, 635 North 7th Avenue, Brighton, Colorado 80601, for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW* of Section 14, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was not represented, and WHEREAS, said property was not posted in a timely manner; therefore, the Planning staff recommended continuing said matter to September 15, 1993, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, and, having been fully informed, finds that this request shall be continued to September 15, 1993, at 10:00 a.m. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, continued to September 15, 1993, at 10:00 a.m. PL0781 930882 PLO '7?/ cc ; Az_ , <�_( A1, /WIG. 7 Fite AMENDED SPECIAL REVIEW PERMIT - KN FRONT RANGE GATHERING COMPANY PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 1st day of September, A.D. , 1993. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem - Excused Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated August 16, 1993, and duly published August 19, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of KN Front Range Gathering Company for a Site Specific Development Plan and Amended Special Review Permit for a natural gas compressor station and 400-foot guyed microwave tower in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, said the applicant's sign was not posted in a timely manner and staff recommends continuing said matter to September 15, 1993. He confirmed, for Commissioner Kirkmeyer, that this request was not preadvertised and explained the applicant called Wednesday but did not pick up the sign until the following Monday, which resulted in untimely posting. Commissioner Hall suggested there be more communication between the applicant and staff. Mr. Thompson said he has been calling the applicants a couple of days before the ten-day sign posting requirement. Commissioner Hall suggested mentioning to the applicant that not posting the sign will result in a continuance, which is a waste of time for all parties involved. Mr. Morrison informed the Board that Don Warden, Clerk to the Board, is scheduling a work session concerning this issue. After further questions from Commissioner Kirkmeyer, Mr. Thompson said the sign posting matter is explained in the Special Review Permit requirements and the Clerk to the Board's Office also sends a reminder of said requirement with the hearing notice. There was no public testimony offered concerning the continuance of this matter.
