RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION
AGAINST CERTAIN PARTIES FOR VIOLATIONS OF THE WELD COUNTY BUILDING CODE
ORDINANCE AND THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, Carmen and Billy Mata, VI #2003, and Joseph and Carol Hansford,
BCV #2031, are alledgedly in violation of the Weld County Building Code and Weld
County Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matters, the
violations have not been corrected, and
WHEREAS, on the 8th day of March, 1994, a public hearing was held before
the Board of County Commissioners for the purpose of hearing any testimony
relating to said violations, and
WHEREAS, Carmen and Billy Mata and Joseph and Carol Hansford were not
present or represented at said hearing, although all parties were notified of
said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it necessary to bring legal action against those
individuals as hereinabove named to correct said violations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Carmen and Billy Mata and Joseph and Carol
Hansford to remedy the violations of the Weld County Building Code Ordinance and
the Weld County Zoning Ordinance, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in
active concert with the identified parties.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 8th day of March, A.D. , 1994.

February 24, 1994 Property inspected. 2 - 12 x 12 sheds remain on the
property that require permits. Property still in
violation.
February 25, 1994 Letter sent to property owner indicating that the
violation case was scheduled before the Board of County
Commissioners.
The construction of the two sheds without permits is a violation of Section(s)
30 of the Weld County Building Code Ordinance. To correct the violation a
building permit for each shed must be obtained or the sheds must be removed from
the property.
The Department of Planning Services recommends that the County Attorney be
authorized to proceed with legal action against any other persons occupying the
properties, any person claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

It has come to the attention of the Department of Building Inspection staff that
( you may be in the process of construction, remodeling, or moving a building, or
facility on your property that would fall under this Department' s Jurisdiction.
The alleged noncompliance with the Building Code Ordinance is the construction
and installation of two 12 x 12 sheds, one 12 x 16 shed, and one 14 x 9 shed
without the appropriate permits.

Met with Billy Mata the owner of the property located at 3807 McAvoy Avenue,
Evans. I explained to him what the County considers a noncommercial junkyard
that would need to be cleaned up in order to close the violation. There is
trash, used appliances, miscellaneous building materials scattered around the
property. Mr. Mata indicated that he would get people renting the house to clean
up the property or they would hire someone to get it done.
