WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 22nd day of July, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Cottonwood Water Ski Club, Ltd. , 3382 Vivian Drive, Wheatridge, Colorado 80033, for a Site Specific Development Plan and Special Review Permit for a recreational water ski facility with overnight camping in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW* SE* and SW* SE', Section 30, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Steve O'Brian, consultant, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies; Transportation Goals and Policies; and Open Space, Parks and Recreation Goals and Policies. A representative from the City of Brighton reviewed this request and found the proposed Special Review Permit to be acceptable. Conditions of Approval and Development Standards will ensure that these goals and policies are met. The open space, parks, and recreation section of the Weld County Comprehensive Plan encourages the location of parks, recreational areas, and open space in nonproductive agricultural areas. (WATER SKI FACILITY) PAGE 2 b. The proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a use by special review. c. The uses which would be permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area. The surrounding land uses include agricultural production, an equipment repair facility, and U.S. Highway 85. Conditions of Approval and Development Standards will ensure compatibility. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a recreational water ski facility with overnight camping in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the Special Review Permit plat: a. Evidence shall be submitted to the Department of Planning Services that a dust control plan has been approved by the Weld County Health Department. b. The plat for Change of Zone #473 shall be recorded. 4. A bathroom with adequate toilet facilities approved by the Weld County Health Department shall be installed on-site by May 1, 1993. A minimum of two portable toilet facilities shall be installed on- site for use until adequate toilet facilities are installed; however, in no event shall adequate toilet facilities be installed later than May 1, 1993. 920657 SPECIAL REVIEW PERMIT - COTTONWOOD WATER SKI CLUB, LTD. Webster 920657 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS USR-969 COTTONWOOD WATER SKI CLUB, LTD. 1. The Site Specific Development Plan and Special Review Permit is for a recreational water ski facility with overnight camping in the A (Agricultural) Zone District, as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be controlled on this site. 7. The maximum permissible noise level shall not exceed the Industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 11. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 920657 DEVELOPMENT STANDARDS - COTTONWOOD WATER SKI CLUB, LTD. Any other changes shall be filed in the office of the Department of Planning Services. 13. A public hearing was conducted on July 22, 1992, at 10:00 A.M. , with the following present: Commissioner George Kennedy, Chairman Commissioner Constance L. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated June 8, 1992, and duly published July 9, 1992, in the Windsor Beacon, a public hearing was conducted to consider the request of Cottonwood Water Ski Club, Ltd. , for a Site Specific Development Plan and Special Review Permit for a recreational water ski facility with overnight camping in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Mr. Schuett said the lake that is being mined will be used for water skiing. He noted that Condition of Approval #4 requires adequate toilet facilities to be installed within 30 days of approval by the Board. Commissioner Harbert, pursuant to discussion in the previous hearing for Docket #92-36, recommended extending the 30 days to May 1, 1993. Commissioner Lacy recommended including the requirement of two portable toilet facilities being on site between now and May 1, 1993. Chairman Kennedy questioned the date for the augmentation plan. Mr. Schuett said that was included in the water supply plan, which will also be extended until May 1, 1993. There was no public testimony offered concerning this matter. Commissioner Lacy moved to approve the request of Cottonwood Water Ski Club, Ltd. , for a Site Specific Development Plan and Special Review Permit for a recreational water ski facility with overnight camping in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as changed and entered into the record. The motion was seconded by Commissioner Kirby. Commissioner Harbert questioned the supply of drinking water. Steve O'Brian, consultant, represented the applicant and stated that generally all persons bring their own water. Jean Hoffman asked if this use would be restricted to club members only. Steve O'Brien said yes, at this time, but local meets would be arranged. Jean Hoffman was also concerned about the access roads onto the property. Steve O'Brien stated this would not be a problem. Bud Clemons said restroom facility concerns and well permit concerns could be addressed to the Weld County Health Department and the State of Colorado pending the Board of County Commissioners Hearing. Their intention was to setup a slalom course on which they can practice for competition. This sport involves a considerable commitment of time from the participants. Slalom course water skiing is a very specialized sport and can not really be called a recreational past time. Besides using the lake for the club practice sessions and enjoyment there may come a time when the Club hosts a local tournament. These Club events could occur 1 to 2 times per year. A typical participant for one of these meets would supply all water and food they consume. These events are not advertised and open to the public. Normally the only people attending one of these meets would be a competitor and their family. Please see the USE BY SPECIAL REVIEW (RECREATION) - PLOT PLAN MAP for the location of the parking areas, and viewing areas to be used. The APPENDIX contains a drawing showing a typical regulation layout of a water ski course. The boat follows a straight line path between a set of paired buoys at a set speed, while the skier attempts to round the outer buoys starting with 11 and ending by rounding #6 and passing between the exit buoys at the end of the boats' path. All this is done while the boat travels a consistent 36 m.p.h. . A copy of the Clubs Rules are also in the APPENDIX to show that the skiing on this lake is taken seriously. The lake is a modified gravel lake that sets into the hillside where the gravel was removed. This has created an amphitheater like setting where noise will not be a problem since the open side of the lake faces the Highway and not residential areas. EXPLAIN NEED FOR USE (24 . 7.3 .15) When we purchased this property we intended to use it for slalom skiing only. We did not know at the time that the In- dustrial Zoning would preclude us from using the property for 1 SECTION 2 (cont.) Cottonwood Water Ski Club, Ltd. recreational purposes. This property provided two advantages over others we looked at. One it was partially mined, but not so far that we could not customize it to our needs and two it was in a prime location close to Denver. We have been able to work with the mine operator, Albert Frei and Sons, Inc. , to create a lake that specifically meets our needs. This lake is ideal for the clubs needs, in that it is sheltered from the wind, and the number of boats operating at one time is limited to one (1) . In addition to using it for private purposes we also want to use the lake for Local Competitions. As we note throughout this application text this use would be limited. We have never planned to use it exclusively for non-club competitions. It's prime use will always remain for the club members and their guests. Once mining is complete and the final lake configuration is known we will have a lake that will offer the ideal conditions sought by slalom skiers. It will provide a strictly controlled and limited access lake where only boat types approved by the American Water Ski Association (AWSA) can be operated, see list of Club rules in APPENDIX. EXPLAIN THE TYPES OF EXISTING USES ON SURROUNDING PROPERTIES (24 . 7.3 .2) Immediate Neiahbors: The east side of the property is bordered by agricultural land A-1, crops are grown on it each year. The south side has a welding shop, an equipment repair yard and a parcel zoned residential. The north is bordered by Industrial land, it is vacant now and had been used as a feed lot in the past. To the west Highway 85 adjoins the property and this property was recently rezoned from Industrial (I-3) to Agricultural (A-1) as suggested by Planning and Zoning. PATRONS: Except during those limited times when the lake is being used for club functions, inter-area meets or as a practice site for local competitions there are no patrons. However during the local meets and other non club functions we estimate there would be as many as 75 persons involved, either participants in the competition or spectators. BUYERS: There are no products or services for sale associated with this use. The only use of the property is for enjoyment of tournament water skiing. THE NUMBER OF EMPLOYEES, NUMBER OF SHIFTS, AND HOURS OF OPERATION This is a private lake for use by members of the Cottonwood Water Ski Club, Ltd. . The lake is available for use during daylight hours starting approximately March 1st and ending in Late October depending on the weather. Some members choose to camp over night at the lake occasionally. Camping is allowed along the western perimeter of the lake Please refer to the PLOT PLAN MAP for the location of the camping areas. Once the mining operation is completed the best locations will be in the southwest sector of the shore. This is behind a natural berm that shields the campers from Highway 85. Only Club members of their families use the property for camping, the property is not open for public camping. The gate is locked at night. The heaviest use occurs during holidays and weekends. THE TYPE OF WATER SOURCE FOR THE OPERATION There are no central water requirements for the proposed use, there are no permanent structures on the site. Drinking water is hauled to the site by individual users for their own consumption. The Division of Water Resources required the mine operator, augment the evaporative loss from the lake. At this time Albert Frei and Sons, Inc. is working on a Temporary Supply Plan addressing this need. EXPLAIN THE ACCESS ROUTE(S) FOR THE PROPOSED OPERATION The entrance to the property is at the end of a short service road along the east side of Highway 85 at WCR 4. We have a locked 4 C -in 9-Ft, 4-0—A-1:.f SECTION 2 (cont.) Cottonwood Water Ski Club, Ltd. gate at the end of this road. The service road is dirt as are all roads on the property. There is one other access on the central part of the west, it is not used now since it requires anyone entering the property to turn directly off HWY 85. The Colorado Highway Department would discourage us from using this access since it is not safe when we have a better access off the service road. EXPLAIN TYPE, SIZE, WEIGHT, AND FREQUENCY OF VEHICULAR TRAFFIC ASSOCIATED WITH THE PROPOSED USE The typical types of vehicle that enter and leave the site are passenger cars, pickup trucks pulling boat trailers and self con- tained motor homes. The automobiles are used for local transpor- tation, the pickup trucks typically pull boats or camp trailers are use by the members of the club. The boats used are competition water ski boats. They have to meet very rigid specifications dictated by the American Water Ski Association (AWSA) . These boats are designed to run quietly by reducing exhaust noise to a minimum, they ARE NOT loud racing boats. During a normal day only 1 to 5 boats will be at the lake, but only one can be operating at a time as noted in the Clubs Rules. On average 1 to 6 light duty vehicles will enter and leave the property during the day. Typically there are 2 to 3 camper units that enter and leave on any given weekend. The exception is, if the lake is used for local competitions or meets, at which time there could be 40 vehicles entering and leaving the lake on a given day. It should be understood this would be the exception to the rule as explained previously. These vehicles would be parked on the property in the 4. 13 acre ± area shown on the PLOT PLAN MAP. 5 SECTION 2 (cc. _.) Cottonwood Water Ski Club, Ltd. THE TYPE OF SEWAGE FACILITIES FOR THE PROPOSED USE A number of the members own self contained camping units, for those that do not we will install a vaulted type toilet facility. This facility will be consistent with the Weld County Health Departments requirements. We propose to locate them in the southwest sector of the property as shown on the PLOT PLAN MAP. Since this area is still being mined we can not construct them there until mining is complete. These facilities will also serve anyone attending a non-club function that does not have a self contained camping units. If there are more than 30 people at one of these functions we will bring in portable units from one of the local companies that supplies them. These units will be on the site for no more than 5 days, similar to what is done at the Weld County Fair. The PLOT PLAN MAP attached shows the proposed tem- porary locations of the portable units. A DESCRIPTION OF THE FIRE PROTECTION MEASURES ASSOCIATED WITH THE PROPOSED USE The U.S. Coast Guard requires all boats over 16 ft. be equipped with an approved fire extinguisher. All our boats meet this requirement. The area is currently protected by: Brighton Volunteer Fire Department, Inc Brighton, CO 80601 (303) 659-2629 See letter in the APPENDIX confirming this fact. THE TYPES AND MAXIMUM NUMBER OF ANIMALS TO BE CONCENTRATED ON THE USE BY SPECIAL REVIEW AREA AT ANY ONE TIME The only animals associate with this use are family pets that may accompany their masters to the lake, these animals are not allowed to run. To stay within the Counties guidelines no more than 8 household animals will be allowed on the property at one time. 6 SECTION 2 (cL__t.) Cottonwood Water Ski Club, Ltd. THE TYPE AND SIZE OF ANY WASTE, STOCKPILE, OR STORAGE AREAS ASSOCIATED WITH THE PROPOSED USE No waste or stockpiles are associated with this use. On a limited basis the members may park boats or camper units on the property. There will never be more than 9 campers and boats stored at one time. The property will not become as storage yard for recreational vehicles. This short term parking will only occur during the ski season and the boats and campers will not be stored on the property over the winter. TYPE OF STORM WATER RETENTION FACILITIES ASSOCIATED WITH THE PROPOSED USE No storm water retention facilities are need at this site. All storm water enters the lake and is retained on the property until it has filtered thru the underlying alluvial sand and gravel strata. There will be no paved lots or roads on the property so all storm water should soak in or enter the lake. The existing drainage pattern will remain unchanged when mining is complete. THE TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK, AND OTHER WASTES ASSOCIATED WITH THE PROPOSED USE There is no debris or junk associated with this use. Thrash collection and disposal will be handled by members that use the lake, see rules. If the lake is used for non-club functions trash receptacles will be provided and emptied as needed. EXPLAIN PROPOSED LANDSCAPING PLANS AND EROSION CONTROL MEASURES ASSOCIATED WITH THE PROPOSED USE There are no specific landscaping plans. The mine operator will be required to reclaim the areas around the perimeter of the lake. Reclamation plans call for grading the slopes around the lake resoiling as needed and planting native grasses to control erosion. Under the State standards all slopes from 5 feet above to 10 feet below the water line have to be sloped a minimum of 3H to 7 •r SECTION 2 (coa t.) Cottonwood Water Ski Club, Ltd. 1V, all others can be 2H to 1V. Once reclamation is complete the area will be resoiled and revegetated. There will be 100 trees planted around the property to enhance the area. There has been a natural invasion of trees along the perimeter of the lake, they are mostly cottonwoods. We intend to keep as many of them as possible when reclamation is done. In addition the mining company will be planting more trees once a final lake configuration is complete. RECLAMATION PROCEDURES TO BE EMPLOYED UPON CESSATION OF THE USE BY SPECIAL REVIEW ACTIVITY No reclamation will be needed if we ever quit using the lake for water skiing. Because the lake was created by a mining operation, certain standards have to be met to insure it is reclaimed. The Colorado Mined Land Reclamation Board (MLRB) issued the permit in 1981 and the mine operator must complete the require- ments under the approved plan. They currently have a bond for $6,700.00 to cover this reclamation. The extraction process will not affect the usability of the lake for skiing purposes, however is equipment and large stockpiles of processed gravel on the site that will delay construction of the vaulted toilet facilities and the parking/camping area in the southwest sector of the property. The area left to remove will only increase the total length of the lake. This will make it easier to turn the boats around and widen the central area of the lake. TYPE, NUMBER, AND USES OF THE PROPOSED STRUCTURES TO BE ERECTED No permanent structures are planned at this time. We may install a couple of floating boat docks and an additional boat ramp along the west side of the lake. The docks will be most likely be hauled on to the shore before freeze-up in the fall. LOCATION OF ANY FLOOD HAZARD, GEOLOGICAL HAZARD, OR MINERAL RESOURCE AREAS This property is not located with in any Flood Hazard areas, it is approximately 15 feet above and 2,250 east of the South Platte River. There are no Geologic Hazard areas on the parcel. This is located on a proven source of gravel and is currently being mined. The change in zoning to Agriculture returns it to the zoning it had before 1963 when the area was blanket zoned by the Weld County Commissioner. We have discussed our planned use with the Brighton County Planner and he has indicated this use would be consistent with what Brighton wants the area to become. We are surrounded on three sides by industrial uses makes this change desirable to them. This would become an oasis within the industrial area and will improve the austenitics of the area. During 4 month of the year it will actually be an open space area used by few people. We are also adjacent to a large tract of Agriculture land to the east. This ground is currently farmed by the Brancucci family. In our conversations with them they are pleased that we are finally going to be able to use the property for the reason we bought it. As allowed in the Weld County Zoning Resolution the recreational uses are a Special Use allowed in an Ag. District, reinforcing the acceptability of this use. A STATEMENT EXPLAINING HOW THE PROPOSAL IS CONSISTENT WITH THE INTENT OF THE DISTRICT IN WHICH THE USE IS LOCATED As we see it, the Agricultural zone district is intended to preserve valuable agriculture land. This ground no longer has any value for crop land, however this intended use will be consistent with 31.4.3 regarding Recreational facilities. A STATEMENT EXPLAINING WHAT EFFORTS HAVE BEEN MADE, IN THE LOCATION DECISION FOR THE PROPOSED USE, TO CONSERVE PRODUCTIVE AGRICULTURAL LAND IN THE AGRICULTURAL ZONE DISTRICT IF APPLICABLE The sole reason the Cottonwood Water Ski Club, Ltd. purchased this property was to make it a private ski lake. They have rezoned it 10 SECTION 3 (coat. ) Cottonwood Water Ski Club, Ltd. from Industrial to Agriculture because the use as a recreational facility is compatible with that zoning. This property has not been used as crop land for many years and we question if it was ever valuable for that use, since it was blanket zoned in 1963 to the Industrial Use. A STATEMENT EXPLAINING THERE IS ADEQUATE PROVISION FOR THE PROTECTION OF THE HEALTH, SAFETY AND WELFARE OF THE INHABITANTS OF THE NEIGHBORHOOD AND THE COUNTY. This is a low intensity use on private ground. As originally zoned many forms of manufacturing could have been done on it. The Agriculture Zoning is more restrictive and our intended use poses no threat to the Health, Safety and Welfare of county inhabitants. Recreational uses are allowed as a Special Use in the Agriculture Zone District as described in the Weld County Zoning Resolution of 1989. It also will improve the neighborhood and protect the environment in the area. It will serve as a buffer-open space area within the surrounding Industrial uses. A STATEMENT EXPLAINING THE USES PERMITTED WILL BE COMPATIBLE WITH THE EXISTING SURROUNDING LAND USES (INCLUDE A DESCRIPTION OF EXISTING LAND USES OF ALL PROPERTIES ADJACENT TO THE PROPERTY) This parcel will serves as a buffer-open space area within the surrounding Industrial uses. Once the property is rezoned to Ag there are more restriction to the uses allowed than in the Industrial Zoning. There are 15 parcels of property within 500 feet of the property line. Of these 15 parcels, 4 are zoned for agriculture or rural residential, one is residential, and the remaining 10 parcels are industrial zoned. Brighton has indicated they would like to see this area cleaned up and have told us they think our proposed use would be good for the area. Mining started on the property in 1957 and has continued to date. 24.5. 1.5. 1 The lake that exists can retain storm runoff that occurs at the site. All drainage from the property is directed to the lake as required by the mining plan approved by the NLRB. 24 . 5. 1. 6 There is adequate room on the property for parking. We will not park vehicles on public roadways. We will have ap- proximately 4 . 13 acres ± available for parking at the lake. Camping will be along the western side of the lake. 24.5. 1.7 There is a 25 foot setback from the property line to the slope into the lake. The lake is no closer than 30 feet to the property line. The minimum setback allowed in this zone district is 20 feet. 24.5. 1.8 The current access has been in place as far as our records go back, that is to 1957. The access road is owned by the Colorado Department of Highways according to County Records. This service road is accessed from WCR 4 and the limited traffic entering and leaving the property will in most cases be less that the truck traffic associated with the mining operation over the past 20 years. 24.5. 1.9 No new access is needed so this standard does not apply. 24.5. 1. 10 This lake was created by mining into a bank slope. The only the view into the lake area from the south, east and north is if one is standing close to the property line. As noted above this use will be less affect on the surrounding neighborhood than the existing mining operation. When the final lake shape is know the mining operator will plant trees around the lake area.
