L -}i( ( ,75 u L i„)- LA-, t;l,, ..,� ' 900437 COUNTY OF WELD, STATE OF COLORADO ROAD MAINTENANCE AGREEMENT 51 THIS AGREEMENT, made and entered into this o) I day of May, 1990, by and between the County of Weld , State of Colorado , hereinafter called " County" , and ConAgra Poultry Company , a Delaware Corporation d/b/a Longmont Foods Co. , Inc . , hereinafter called "Longmont Foods" and � m WHEREAS , Longmont Foods has applied to the County for a Use by Special Review permit for a turkey brooding facility in the Northeast Quarter of the Southeast Quarter (NE} SE} ) of Section - - Thirty-three ( 33) , Township Four ( 4) North, Range Sixty-five ( 65 ) West of the 6th P.M. , Weld County, Colorado; and m WHEREAS , pursuant to a public hearing the County approved y N such Use by Special Review on February 21, 1990 as USR-898; and z o WHEREAS , the turkey brooding facility may generate an tVg increase in heavy truck traffic; and WHEREAS , the existing County roads in the general vicinity y that may serve the brooding facility may require increased H o maintenance due to the potential increase in heavy truck traffic; -z ui and w nNJ WHEREAS , the County and Longmont Foods have reviewed z maintenance proposals and both parties agree that a Road x o Maintenance Agreement may be necessary and will benefit both a' ;, parties; and m n WHEREAS, the County has determined that all of the roads z in the general vicinity of the brooding facility are of average 2 width, have suitable horizontal and vertical alignment and have 1361'0 no major structural deficiencies; and o t'lo WHEREAS , in accordance with the Use by Special Review d application the projected increase in traffic is a small n percentage of total traffic on roads in the area based upon o N traffic counts whi-ch have been performed by the County; no o a NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth , the County and Longmont Foods mutually agree as follows: 1 . The County roads which gene-rally service the brooding facility in an East/West direction are County roads 44 , 42 , 38 and 36 ; and the roads which will be generally used for access to the facility in a North/South direction consist primarily of Weld 900437 County Roads 43 and 39 . Heavy hauling will make use of Weld County Road 43 between the facility and County Roads 38 and 44 , the "haul routes" . 2 . Longmont Foods recognizes bridge weight limitations on local bridges as follows : Bridge 43/42A, ( 10-ton weight limit) ; Bridge 42/39A ( 22 , 34 , 34-ton weight limit) ; and Bridge 42/41A ( 16 , 26 , 26-ton weight limit) . As the haul route may use Bridge 43/42A which is currently in structural disrepair having cracks mw in the concrete arches, Longmont Foods agrees , in the event the cm' : bridge is replaced or reconstructed , to pay 10% of the costs of . °' co .4 repair or replacement not to exceed $3 ,000 .00. > g mn 3 . Longmont Foods agrees to be responsible for any road '4p damage to Road 43 caused by Longmont Foods and to control dust z w during periods of heavy hauling. z o trim Ma Ca 4 . Dust control may be required by County when County z receives a complaint and the County determines , in its sole ?AI- discretion and after investigation , that dust control is necessary and Longmont Foods significantly contributes towards Zvi the problem. n .'o C N tx7 5 . The dust control shall consist of treating the haul route in front of residences located between the facility and R, 5 County Roads 44 and 38 . The length of road to be treated in front of each residence shall be 200 feet on each side of the -y ~ occupied residence . The dust control shall consist of water , o asphaltic emulsions , waste oil or commercially available chemicals . Longmont Foods is responsible for using materials and to .,,, methods not inconsistent with any federal , state or local laws , goo rules or regulations pertaining to hazardous materials , health or o0 environmental protection . Longmont Foods will work with the r County Engineer to coordinate any required dust control o applications. no o w 6 . When and if any repair is required due to damage caused o a by Longmont Foods , the details of such repair will be coordinated between the County Engineer and Longmont Foods. Longmont Food' s responsibility for repair will be limited to repair of the roads to match the condition of similar County roads in the immediate vinicity. 7 .
