The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This amended proposal is consistent with the Weld County Comprehensive Plan Urban Growth Boundary Goals and Policies. Urban growth boundary areas are maintained to provide an official definition between future urban and agricultural land uses. Urban uses are intended to concentrate in or adjacent to existing municipalities. In a letter dated June 25, 1993, a representative of the City of Greeley Planning staff indicated this amended proposal does comply with the Greeley Comprehensive Plan, with three conditions. These conditions are addressed in the Conditions of Approval and Development Standards. PL0821 930812 pLo IQ SPECIAL REVIEW PERMIT - HOFF PAGE 2 b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include a cemetery, gravel mining, pasture, several rural residences, and a welding company, and will be compatible with the future development of the surrounding area as permitted by the City of Greeley's Comprehensive Plan. Conditions of Approval and Development Standards will ensure compatibility. No objections have been received from surrounding property owners. d. The property is located in the Airport Overlay District, and portions are located within the Flood Hazard Overlay District. Development Standards address these concerns. No other overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit for recreational vehicle storage in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners, an I.S.D.S. evaluation shall be performed on all existing septic systems. The Site Specific Development Plan and Amended Special Review Permit is for recreational vehicle storage in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property shall be maintained in compliance with the requirements of the Airport Overlay District. 4. A Flood Hazard Development Permit will be required for any new construction or substantial improvement of existing structures in the Floodway or Floodprone Districts located on the property. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. A 20-foot all-weather surface shall be provided on the access road to within 150 feet of the furthermost point of the storage buildings, as requested by the Greeley Fire Department. 10. This Permit shall automatically be reviewed in 10 years after the date of initial approval by the Board of County Commissioners, and expire when there is a sale or lease of the property. The Permit will not expire if the property is willed or transferred to a family member. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 930812 DEVELOPMENT STANDARDS - HOFF PAGE 2 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated July 28, 1993, and duly published August 5, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Don Hoff for a Site Specific Development Plan and Amended Special Review Permit for recreational vehicle storage in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record and noted said matter had been continued from August 18, 1993, due to the applicant not meeting sign posting requirements. Mr. Morrison noted for the record that Don Hoff is representing Wanda McNamara and Mary Etta Huff; Mr. Hoff is not the owner. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Don Hoff said he is the attorney for the property owners and stated McNamaras farmed the property until the 1970's, at which time the property to the north was converted to gravel mining. He explained the conversion left only three acres and, since Ms. McNamara is getting very old, they would like to amend the Special Review Permit approved in 1990 for storage of recreational vehicles to allow her daughter to build a home on site to care for Ms. McNamara. He noted the compatibility of the additional residence with the surrounding area and confirmed, on behalf of Commissioner Hall, that no additional access would be required. There was discussion concerning the location of the site, and Mr. Hoff said the Conditions of Approval and Development Standards are all acceptable. There was no public testimony offered concerning this matter. Commissioner Hall moved to approve the request of Don Hoff for a Site Specific Development Plan and Amended Special Review Permit for recreational vehicle storage in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Don Hoff, Attorney, explained the original Use by Special Review permit was approved in 1990. The applicant originally farmed the property and sold it to a gravel operation for better economic use. There are 4.5 acres remaining that would allow 17 spaces to be used as covered recreational vehicle storage and an additional residence for an older parent. The uses which would be permitted will be compatible with the existing surrounding land uses which include a cemetery, gravel mining, pasture, several rural residences, and a welding company, and will be compatible with the future development of the surrounding area as permitted by the City of Greeley's Comprehensive Plan. Conditions of Approval and Development Standards will ensure compatibility. No objections have been received from surrounding property owners. The property is located in the Airport Overlay District, and portions are located within the Flood Hazard Overlay District. Development Standards address these concerns. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property shall be maintained in compliance with the requirements of the Airport Overlay District. 4. A Flood Hazard Development Permit will be required for any new construction or substantial improvement of existing structures in the Floodway or Floodprone Districts located on the property. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. A 20-foot all-weather surface shall be provided on the access road to within 150 feet of the furthermost point of the storage buildings, as requested by the Greeley Fire Department. 10. This permit shall automatically be reviewed in 10 years after the date of initial approval by the Board of County Commissioners, and expire when there is a sale or lease of the property. The permit will not expire if the property is willed or transferred to a family member. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property shall be maintained in compliance with the requirements of the Airport Overlay District. 4. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 930812 DEVELOPMENT STANDARDS, Amended USR-926 Don Hoff Page 2 14. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards.
