AR1133DD7b RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING SPECIAL REVIEW PERMIT #689 - GONZALES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 14, 1993, a Show Cause Hearing was conducted to consider revocation of Special Review Permit #689, issued to Joe Alvin and Romona Gonzales, and WHEREAS, Ruben Gonzales is the owner of the property described as part of Lot 8 in the NW4 NW4 of Section 30, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, at the hearing of April 14, 1993, the Planning staff advised the Board that said Permit should have expired on October 16, 1990; therefore, staff recommends revocation of said permit with Mr. Gonzales being allowed to apply for a recorded exemption and special review permit at a new location, and WHEREAS, the Board, after hearing all testimony presented, deemed it advisable to revoke Special Review Permit #689, direct Planning staff to issue a violation notice, and allow 45 days before referring to the County Attorney's Office for legal action. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Review Permit #689, issued to Joe Alvin and Romona Gonzales, be, and hereby is, revoked. BE IT FURTHER RESOLVED by the Board that Planning staff be, and hereby is, directed to issue a violation notice and allow 45 days before referring to the County Attorney's Office for legal action. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Lanell Adler The following business was transacted: I hereby certify that pursuant to a notice dated March 17, 1993, and duly published March 25, 1993, in the Windsor Beacon, a public hearing was conducted to consider the revocation of USR #689 issued to Joe Alvin and Romona Gonzales. Lee Morrison, Assistant County Attorney, made this a matter of record. Lanell Adler, Planning Department representative, entered the Planning staff's recommendation into the record. Ms. Adler explained that Joe Gonzales is the operator and Ruben Gonzales is the owner of the property. She said the Permit was to expire October 16, 1990; however, Mr. Gonzales is still operating, and no amended permit has been received nor has the business been moved. Ms. Adler said staff received a lease for a different location on April 9; however, a recorded exemption needs to be approved for that property. Ruben Gonzales, Joe Gonzales' brother, said he would like Joe Gonzales off the property by the end of April. In response to a question from Chairman Harbert, Ms. Adler said Mr. Gonzales needs time to find a place in which to move the large ditch cleaning equipment. Commissioner Kirkmeyer noted that the Permit expired in 1990. Ms. Adler explained that is why staff is recommending revocation and reiterated that the landowner wants Mr. Gonzales out by April 30. She said there are two applications needed with the new property. Chairman Harbert suggested moving the property to a leased area and asked the opinion of legal staff. Mr. Morrison recommending directing questions to the respondent. He explained if the Board proceeds to revoke the Permit effective today, another 30 days will be allowed through the zoning process before being referred for legal action. Mr. Morrison said Ruben Gonzales has the alternative of using the eviction process. Ms. Adler said Ruben Gonzales would like to avoid the eviction process. Commissioner Webster suggesting revoking the Permit as of April 30. Mr. Morrison said if Mr. Gonzales moves his equipment onto the proposed two- acre leased area, it will create a separate parcel which requires a recorded exemption. Joe Gonzales, permit holder, was present and stated he has signed a one-year lease for two acres north of Andersen's Salvage. He said the property is zoned agricultural, and he has not filled out any papers yet. Ms. Adler said a Special Review Permit is required, as well as a recorded exemption per the County Attorney's Office. She said the applicant would be allowed to apply for both at the same time, which would require between 60 and 90 days for approval. In response to a question from Chairman Harbert, Ms. Adler explained that once the applications are filed, Mr. Gonzales can ask the Board for permission to move onto the property. Mr. Morrison said it is a judgement call whether to extend the time at the present site or to allow Mr. Gonzales to move to the new site. Commissioner Webster reiterated that the present landlord would like Mr. Gonzales off the property as soon as possible. After further comments, 930313 RE: HEARING CERTIFICATION - GONZALES PAGE 2 Mr. Morrison noted that, technically, Mr. Gonzales is in violation on either site. Ms. Adler said if there is a problem with the applications, the current problem with compatibility could still exist at the new location. Mr. Morrison suggested allowing Mr. Gonzales to remain at the present site with the new application to be submitted and the order to be effective in three to four weeks. In response to a question from Chairman Harbert, Mr. Gonzales said he thought his brother would allow him to stay until June. Ms. Adler said she understands the lot is to be used for other purposes. Again in response to Chairman Harbert, Mr. Gonzales said he has not tried to find a place other than the property for which he had a lease. He said he would like to move away from a residential area because the equipment is noisy, and most of the work is done in the country for farmers. Mr. Gonzales said he could meet with Ms. Adler tomorrow to start on the paperwork. Commissioner Baxter said he would like to revoke the permit, leave the equipment where it sits, and have the applications filed immediately. Commissioner Webster stated the permit should be revoked effective April 30. Mr. Morrison reiterated the notice of violation is given with 30 days to cure. After comments by Commissioner Kirkmeyer, Mr. Morrison said a hearing is required to expire the permit and a finding of cause should be made. Ms. Adler said after receiving the recorded exemption and special review permit applications, it will be approximately 30 days before the hearing to allow time for the referral process. There was no public testimony offered concerning this matter. Commissioner Kirkmeyer moved to find cause to revoke the Permit today, direct Planning staff to issue a violation notice, and allow 45 days before referring to the County Attorney for legal action. The motion was seconded by Commissioner Baxter, and he questioned what the action would be if the application process is not completed. Mr. Morrison said after the 45 days, they will proceed with legal action. Commissioner Baxter said if the permits are not applied for, he would like to see the 45 days forfeited. After further comments by Commissioner Kirkmeyer, the motion carried unanimously on roll-call vote. This Certification was approved on the 19th day of April, 1993.
