HomeMy WebLinkAbout900892.tiff AR2229281 RESOLUTION RE: APPROVE QUIT CLAIM DEED CONCERNING MINERAL INTERESTS LOCATED IN SECTION 15 , TOWNSHIP 6 NORTH, RANGE 65 WEST, AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a request to disclaim any rights which it may have in the mineral interests located in the NE} of Section 15, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, more fully described in Exhibit "A" , a copy of which is attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve the Quit Claim Deed conveying all mineral interests the Board may have to the present owners, Kenneth E. Benson; Charles T. Hawley and John C. Hawley, as joint tenants; Violet J. Carlson; Shirley H. Uhrich; and Sonja Benson. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Quit Claim Deed for the hereinabove mentioned parcel , conveying all mineral interests the Board may have to the hereinabove mentioned persons be, and hereby is , approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Quit Claim Deed. Morrison, Assistant County Attorney Quit Claim of Oil and Gas Interests Underlying sohiect: State Highway 392 in the NE} of Section 22 , Township 6 North, Range 65 West Adam Buna, of Colorado Land Services , has approached the County regarding a parcel of land under Highway 392 described as being in the Northeast Quarter of Section 22 , Township 6 North, Range 65 West and containing 1. 530 acres. The tract is described in a Condemnation Decree of August 24, 1953 , at which time a 1. 530 acre parcel was condemned despite the fact that 1 .391 acres were included in the right-of-way for the road as it existed prior to the widening, resurfacing, improving and maintaining of said road. It also appears that the County has no claim to the right-of-way except from the Decree in Condemnation or by use. Condemnation law provides that condemnation for a road does not grant the condemning agency any use of the subsurface except to the extent necessary for the support of the roadway. That is, by condemnation, this Board could not have obtained the oil and gas interest. Furthermore, it doesn't appear that state law would grant the County any interest in oil and gas had they obtained the right-of-way simply by usage. Under these particular facts , there appears to be no basis for the County claiming any interest in the oil and gas and therefore , ? am recommending that the Board sign a Quit Claim Deed of any and all interests Weld County holds in the oil and gas underlying the parcel to the following parties according to their fractional interest: Kenneth E.
