All of the requirements contained in the above-mentioned Acquisition and Drilling Title Opinion dated September 16, 1991, are either satisfied or advisory in nature or they are reimposed below. Requirement: None, advisory only. 2. The primary terms of the subject oil and gas leases have expired, but Francis Energy, Inc. , recorded an Affidavit of Production dated October 8, 1991, for the Payne No. 2-26 Well , and FEI-1991 Joint Venture recorded an Affidavit of Production dated December 11, 1991, for the Irving No. 1-26 Well and the Edith No. 1-26 Well . However, none of these wells were drilled on lands covered by Lease B. Although the above-mentioned Declaration of Pooling dated October 8, 1991, states that it is effective as of the date of first production from the Payne No. 2-26 Well , it would appear that Lease B expired in 1985 in absence of a ratification from the Lessor of Lease B. Requirement: A ratification of Lease B should be obtained from the Board of County Commissioners of Weld County, Colorado, and recorded in the records of Weld County, Colorado. This opinion is limited to matters reflected by the data examined, as described above. Colorado Land Services advised that the Payne No. 2-26 Well was drilled prior to the expiration of the primary term of Lease A, and that first production from Irving No. 1-26 and Edith No. 1-26 Wells commenced on December 11, 1991. Upon satisfaction of Requirement No. 2 above, in my opinion, title to the E%SW} of Section 26, Township 6 North, Range 66 West, 6th P.M. , will be adequate to support payments made under division orders prepared in accordance with the division of interest set forth above as of August 1, 1991. Title to the W3/4SW3/4 of Section 26, Township 6 North, Range 66 West, 6th P.M. , in my opinion, is adequate to support payments made under division orders prepared in accordance with the division of interest set forth above as of the date of first production.
