Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated January 29, 1992, and duly published January 30, 1992, in The New News and in the Longmont Daily Times Call, a public hearing was conducted to consider the request of Jay L. Goom to amend the Weld County Comprehensive Plan and the first reading of Ordinance #147-B, concerning said amendment. Lee Morrison, Assistant County Attorney, made this a matter of record. Rod Allison, Planning Department representative, recommended the Resolution of the Planning Commission and the Planning staff's recommendation be entered into the record as written. Jay L. Groom, applicant, was present and said the property has been through the gravel mining process and reclaimed to become low density residential. There was no public testimony offered. Commissioner Lacy moved to approve the request of Jay L. Groom to amend the Weld County Comprehensive Plan, based on the recommendation of the Planning staff and the Planning Commission. The motion was seconded by Commissioner Webster and tabled while Mr. Morrison read Ordinance #147-B into the record. Commissioner Lacy moved to approve Ordinance #147-B on first reading, and Commissioner Harbert seconded the motion. There was not public testimony offered concerning said ordinance, and the motion carried unanimously. The motion regarding the amending of the Weld County Comprehensive Plan carried unanimously. Be it resolved by the Weld County Planning Commission that the application for: APPLICANT: Jay L. Groom REQUEST: To amend the Weld County Comprehensive Plan LEGAL DESCRIPTION: N2 NE4 of Section 16, T2N, R68W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately 2-1/4 miles southeast of the City of Longmont; west of and adjacent to Weld County Road 7, and 1 mile south of Colorado State Highway 119. be recommended favorably to the Board of County Commissioners for the following reasons: 1. The existing Comprehensive Plan is in need of revision as proposed. The subject parcel is zoned A (Agricultural) with a special use permit approved in 1983 for an open-cut sand and gravel mining operation. The mining operation has been completed. The reclamation plan is complete with final reseeding scheduled for the spring of 1992. The majority of the parcel has been reclaimed as a fifty-two (52) acre lake. A low density residential planned unit development could be designed to preserve and enhance this reclamation plan. 2. The proposed amendment will be consistent with existing and future goals, policies, and needs of the County. As gravel mining operations in this area are completed and reclaimed it appears that some parcels are suitable for low density residential uses. The I-25 M.U.D. area conceptual land use plan map also identifies similar residential uses north and east of the subject parcel. The City of Longmont and the Tri-Area Planning Commission reviewed this request and had no objections. 3. The proposed amendment will not place a burden upon planned service capabilities. Jay Groom, applicant, introduced Carol Aspenwald, consultant, who has been helping him through the process. Originally this property went through a Mining Special Use permit. The reclamation is complete. They now want to use the property for a residential development. Jean Hoffman asked if they were planning 7 residential lots on the remaining 25 acres. Jay Groom replied it would be 9 residential lots on the 25 acres. There is a 52 acre lake included on this property. Jean Hoffman asked how many acres each lot would consist of. Jay Groom said each lot would be about 1/2 acre. Jean Hoffman asked about sewer lines going in under Highway 119. Jay Groom said this was correct. Rod Allison explained to the Planning Commission that the applicant is attempting to amend the Mixed-Use Development Area portion of the Comprehensive Plan. After this is accomplished, the applicant would then be eligible to go through the Planned Unit Development process. Details on how he plans to develop the parcel, once this portion is over, will come back before the Planning Commission. Don Feldhaus asked if the Comprehensive Plan would be an action item for the Planning Commission to look at in the near future. Rod Allison said nothing was planned as of now. He explained in 1987 there was a process to amend the plan and that's the process that Mr. Groom is taking advantage of now. Jan Allison, said there is a provision in the Comprehensive Plan that allows the Commissioners to amend the plan. There is also a specific provision in the plan that allows for an individual to come before the Planning Commission, and the Board of County Commissioners to accomplish amendments as well. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Richard Kimmel moved that the request of Jay L. Groom, to amend the Weld County Comprehensive Plan, be forwarded to the Board of County Commissioners with the Planning Commissions' recommendation for approval. M. , Weld County, State of Colorado, more particularly described as follows: North one-half (N 1/2) of the Northeast Quarter (NE 1/4) of said Section 16 containing 80 acres more or less. Location: Southwest of the intersection of Weld County Roads 7 and 22, approximately 1 1/4 miles south of Colorado Highway 119. Owner: Jay L. Groom, 9777 Weld County Road 7, Longmont, CO 80504 (residence) ; (mailing address) : P. O. Box 509, Niwot, CO 80544-0509 Land Use Designation: Agricultural Land Use Amendment Request: Mixed Use Development/I-25 M.U.D. Background: The Weld County Comprehensive Plan is "for the general purpose of guiding and accomplishing the coordinated, adjusted, and harmonious development of Weld County. " (Weld County Comprehensive Plan, p. 1 ) The Plan allows County officials to re-examine its goals and policies, as stated in the Plan, and if in the public interest, to make changes to the Plan. The Applicant respectfully requests a land use change on the subject property from Agricultural to Mixed Use Development, specifically I-25 M.U. D. The subject parcel is located immediately southwest of the intersection of County Road 7 and designated Weld County Road 22, and is diagonally adjacent to the existing 1-25 M. U. D. boundary at its southwest corner. Why the Comprehensive Plan is in need of revision: The Applicant believes the Comprehensive Plan is in need of revision for three reasons. First, traditional agricultural uses are no longer viable or even possible on the subject parcel . The parcel is an 80 acre tract that was in cultivation until 1983, when mining for gravel was undertaken. It was subsequently reclaimed as a 52 acre lake (surface) and an eight acre area suitable for redevelopment into low density residential use. The bulk of the remaining acreage would be used for open space and access. Given its non-agricultural status in an agricultural zone, the highest and best use of the land is for low density residential use. The present agricultural land use designation is unduly restrictive on the subject parcel in that it does not allow the next step in the progression of the use of the land to its highest and best use. The second rationale for a land use designation change is the need for housing options in the Del Camino area. 1-25 Mixed Use District offers few existing housing options to business owners, employees, and other residents and potential residents. The increased number and diversity of commercial and industrial uses situated within the I-25 M. U. D. have been great over the past decade. Housing options in the vicinity have not kept pace with this development. While the subject parcel is just south of the Resource Management System for Southwest Weld County Study Area (City of Longmont, March 1987) , the proposed low density residential designation is compatible with the same designation of the Study Area. The third reason the Weld County Comprehensive Plan is in need of revision is related to public services. The- Applicant proposes extending a service line from the St. Vrain Sanitation District line, located north of State Highway 119, under the highway, and south along Weld County Road 7 to the property. Adequate line and treatment capacity exists for the subject parcel as well as additional service connections by others along this 1 .25 mile route. Extension of this sewer line would initiate the elimination of individual septic systems, a potential health hazard in rural areas. The Applicant also currently holds options on six water taps with Left Hand Water Supply Company, which has "substantial excess capacity" ( at its filtration plant north of Boulder (Resource Management Study, SW Weld County Study Area, City of Longmont, March 1987) . The applicant is presently seeking three additional taps. How the proposed amendment will be consistent with existing and future goals: Weld County Comprehensive Plan Agricultural Goal 6 (p. 25) states "Develop policies and regulations to permit low density residential development on non-prime agricultural land as recognized by the Soil Conservation Service. " While the Applicant's request is to change the land use designation from Agricultural to M.U. U. , he feels that the proposed change would support Goal 6 by offering low density residential use (approximately 9 Dwelling Units per 7 Acres, inclusive of jointly held open space) on non-prime agricultural land, in point of fact on land that has no viable agricultural use. Agricultural policy 3 (p. 26) states that the " . . . policy is intended to promote conversion of agricultural land in an orderly manner that is in harmony with the phased growth plans of . . . the County" and that " It is intended to minimize the incompatibilities that occur between uses in the agricultural district and districts that allow urban-type uses. In addition, . . . (it) is intended to 92012,1 minimize the costs to Weld County taxpayers of providing additional public services in rural areas for uses that require services on an urban level . " The Applicant is proposing a modest (nine single family lots) urban-type use that will be surrounded on all sides by reclamation lakes and an access road. He believes this separation serves both the agricultural uses to the north, south, and west, and potential urban-type uses to the east (presently agricultural and M. U. D. ) . The Applicant is not requesting taxpayers' assistance in providing public services to the site. Agricultural policy 4 (p. 26) states that the Applicant "must demonstrate that the proposed use cannot reasonably be located" elsewhere, and he must "demonstrate how the adjoining agricultural uses will not be adversely impacted. " The project site is unique in that it is a mining reclamation site that is suitable for development, i . e. , it has no unsolvable drainage issues. The adjoining agricultural uses include undevelopable reclamation lands to the north, and its own reclaimed lake to the west, south, and east. Minimal vehicular traffic will be created by nine single family lots. This type of site is not available in more densely developed locations. Detailed data and analyses regarding public services will be provided with the Planned Unit Development application. Residential goals (p. 40) are to "Promote the development of affordable, quality housing for all Weld County residents; Insure that adequate public services and facilities are available to serve the . . . development . . . : and Promote efficient and cost-effective delivery of public facilities and services to . . . developments. . . " The Applicant is proposing a nine lot, rural residential quality, single family subdivision which will offer high end, quality homes on large lots, with joint ownership and control of the lake. Public service availability and delivery are discussed above (St. Vrain Sanitation District and Left Hand Water Supply Company) , and are otherwise listed on page 45 of the Comprehensive Plan. This application is consistent with P. U. D. goals (p. 42) in that county officials will have review and approval powers over the proposed project, its public services and facilities, and service delivery. The Applicant is creatively seeking the land' s highest and best use through the proposal of low density residential use on the site. The I-25 M. U. D. Area and Activity Center goals (p. 48) seek " . . . to balance relevant fiscal , environmental , aesthetic, and economic components of the area, . . . assure a well -integrated, balanced transportation system. . . , . . . delivery of adequate public facilities and services, . . . maintain . . . the natural state of environmental resources . . . promote governmental cooperation . . . to provide economies of scale, and . . . to maintain an attractive working and living environment. " The addition of nine low density single family households will bring approximately 33 persons into the area (or relocated within the area) which has minimal environmental impact but adds to the County economy in a positive manner through increased property taxes and consumer spending. 1-25 M. U. D. Area and Activity Centers policies (p. 48) direct that "New development shall avoid adverse impacts to surface and ground water quality. . . " With use of the St. Vrain Sanitation District for sewage removal and treatment and the Left Hand Water Supply Company for domestic water there should be no adverse impacts to surface and ground water quality. The proposed development is well below the maximum, with approximately one dwelling unit per seven acres.
