RE: ACTION OF THE BOARD CONCERNING ABATEMENT OF DANGEROUS BUILDING - UNION
PACIFIC RAILROAD
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on April 7, 1993 the Department of Planning Services informed the
Board that Union Pacific Railroad has a building on its property which is
considered to be dangerous to persons under the Uniform Code for the Abatement
of Dangerous Buildings, and
WHEREAS, said property is described as SW! SW,' of Section 18, Township 1
North, Range 68 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, after hearing all testimony presented, the Board deemed it
advisable to continue said matter to April 21, 1993 at 9:00 a.m. , to allow Union
Pacific Railroad to completely remove all debris.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that this matter concerning the abatement of a dangerous
building on property owned by Union Pacific Railroad be, and hereby is, continued
to April 21, 1993.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 7th day of April, A.D. , 1993.

CASE SUMMARY
May 12, 1992 Letter sent with citation of dangerous building under
the Uniform Code for the Abatement of Dangerous
Buildings. Dangerous building ordered to be demolished
by August 12, 1992. Property owner waived appeal of
order to demolish building by not responding within
specified time period.
August 17, 1992 Property inspected. Demolition not started.
December 22, 1992 Telephone call from Randy Dzaman indicating that
Mountain View Fire Protection District will burn the
buildings.
December 29, 1992 Property inspected. Buildings torn down. Debris not
removed.
March 16, 1993 Property inspected. Debris not removed or burned by fire
department.
April 1, 1993 Notice of hearing sent.
April 2, 1993 Property inspected. No change from March 16, 1993
inspection.
The Department of Planning Services' staff recommends that the Board authorize
the clean-up work to remove the debris located on the property and authorize the
Purchasing Department to seek bids for the clean-up and removal of debris.
The staff would also recommend that the Board set July 14, 1993, as the hearing
date to consider recovering the cost of removing the debris by special assessment
or as a personal obligation of the property owner. On July 14, 1993, the staff
will present an itemized account of the expense incurred by Weld County to
complete the work on the property.

Took pictures of rubbish. It has not been burned. I talked to Chuck Bose
of Mountain View Fire District. He was going to check to see if it was dry
enough to burn. They had not burnt the rubbish because of the wet weather.
He will call and let us know when they will be burning. Still in
violation.

ORDINANCE AND THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Weld County Department of Planning Services has referred
certain violations of the Weld County Building Code Ordinance and the Weld County
Zoning Ordinance to the County Attorney's Office, and
WHEREAS, those persons in violation of the Weld County Building Code
Ordinance and the Weld County Zoning Ordinance are UiiA 4 �f5i a C

Dear Building Inspector:
The Town of Erie Planning and Zoning Commission would like to make
a formal request concerning what we believe is a hazardous
structure south of town just beyond the town limits of Erie near
150 Holbrook across the railroad tracks .
There have been many complaints taken by the Police Department and
our Main Office regarding this structure . The nature of the
complaints indicate that this structure is hazardous to the health
and safety of the community.
We are requesting that action be taken to inspect the premises and
that the structure be removed from the property. This property is
in your jurisdiction. ,
According to our aerial maps attained from Weld County Assessors
Office, it appears that it may be partially owned by the Union
Pacific Railroad and/or a Leonard Hobbs, 5921 West 77nd Drive,
Arvada, CO 80003. The map referenced is 1467-18-3, parcel 008.
Enclosed is a copy of the property in question. Please confirm
this with your records.
We would greatly appreciate response on the action taken to resolve
