RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #1572 - CARNEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption #1572 was submitted by Robert
M. and Deborah K. Carney, 6938 Willa Lane, Evergreen, COLORADO 80439, for
property which is located in part of the Wi NE,' of Section 4, Township 3 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 68 acres and 7 acres, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the
testimony presented, the Board determined that said request shall be denied for
the following reasons:
1. It Is the opinion of the Board of County Commissioners that this
proposal evades the purpose of the Weld County Subdivision Ordinance
as defined in Section 1.3.
2. The Board feels this division would be inconsistent with efficient
and orderly development.
3. The Board feels this proposal is not consistent with the Weld County
Subdivision Ordinance, Section 11.8. 1
4. It is the opinion of the Board that division of these lots will
create a land-locked parcel requiring access onto Weld County Road
38 through Lot A and will increase the density of the existing
linear subdivision.
5. It is the opinon of the Board that the water supply is not adequate
to meet the needs of these lots.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for Recorded Exemption #1572, submitted by
Robert M. and Deborah K. Carney be, and hereby is, denied.

Subject: Recorded Exemption 1572.
Dear Commissioners:
This request for a recorded exemption is submitted by Robert M. and Deborah K.
Carney. The parcel of land on which this proposal is being made is described as
part of the W2 NE4 of Section 4, T3N, R66W of the 6th P.M. , Weld County,
Colorado. The property lies within the Urban Growth Boundary areas of the Towns
of Gilcrest and Platteville. The Gilcrest and Platteville Planning Boards
reviewed this application and found no conflict with their interests .
Weld County Road. 38 provides existing access to the property. Both proposed lots
would be served by septic systems. The applicant has applied for a permit for
a well to be shared between the two parcels. At the present time, no residence
exists on either lot.
The property under consideration is Lot B of RE-592, which was approved by the
Board in 1983. The approval of RE-592 divided a 75 acre parcel into 68 and 7
acres, more or less . The existing 7 acre parcel, which is Lot A of RE-592, lies
north and west of the subject site and contains a residence. The applicant is
now requesting to further subdivide this property into two parcels of 61 and 7
acres, more or less.
It is the opinion of the Department of Planning Services' staff that sufficient
reasons have not been given by the applicant to warrant creating an additional
lot at this timB. The applicant's wish to provide a rural residence for their
daughter and continue to farm the remainder of the property. The agricultural
policy section of the Comprehensive Plan allows for the property owner to
subdivide for a family member employed on the farm; however, there has been no
indication that the Carney' s daughter will be involved in the operation of the
farm. Staff believes the applicants' intent can be accomplished without a
resubdivision of the parcel, as the parcel is eligible for a building permit as
it exists now.

The staff has concerns in creating a land-locked parcel with no direct public
road access. Because of the lot size and configuration choices requested in this
application and the previous recorded exemption, the proposed 61 acre parcel
would access Weld County Road 38 via a 635' x 30' road located on the smaller
lot. While this may be readily accomplished with an access easement agreement
between the property owners of the two lots, it is the staff's opinion that this
proposal is in conflict with efficient and orderly development.
The staff has additional concerns whether adequate water will be available for
the potential uses of the property. The well permit allows shared use of the
well among as many as three residences on the existing 68 acres. Livestock
watering is also allowed; however, the well water may be used to irrigate only
one acre of the entire 68. If this recorded exemption is approved., the staff
questions the sufficiency of this water source for agricultural uses and how it
would be divided between the lots.
Due to the above-stated reasons, the Department of Planning Services recommends
denial of this request. It is the staff' s opinion that this recorded exemption
does not satisfy the criteria for approval as set forth in Section 11 of the Weld
County Subdivision Ordinance.

Dear Ms. Dunn:
We have reviewed the above referenced application to split a 6 acre lot from a 68 acre
parcel. The water supply is to be from individual on lot wells. A preliminary review under
Senate Bill 5 rules indicates that there is NO non tributary water available for
appropriation underlying this property. We may be able to issue one inhouse use well
permit for the proposed 6 acre lot, after the county approves the split, if the following
conditions can be met:
1. The property has not been previously subdivided or exempted since June 1,
1972.
2. The well would be the only well exempted under Section 37-92-602, located on
the 6 acre tot.
3. The return flow is to the same stream system as the well is located in.
4. The waste water treatment system must not have a consumptive use greater than
10 percent. A septic and leach field system is considered to have a consumptive use
not exceeding 10 percent.
The well permit which will be available will be limited to use for ordinary household
purposes inside one single-family dwelling. Outside use for lawn and garden irrigation or
watering of domestic animals is prohibited. The rate of pumping will be limited to 15
gallons per minute. Plat notes and covenants should reflect these limitations on well use.
Prospective lot purchasers should be made aware of the limitations on water use. We
recommend that a copy of this letter be given to prospective lot purchasers and submitted
with the well permit application in order to expedite our evaluation.

A permit for a domestic well will be available for the larger lot the same as for any
lot of 35 acres or more. If the conditions stated above can be met and the :limitations
on well use are satisfactory to the applicant, then we have no objection to the proposal and
recommend approval.

Dear Ms. Dunn,
In regard to our R. E. #1572. I spoke to John Schurer on January 18th
regarding a well. He said that under S. B. 37-92-602 (3) (B) (II) in
part says if we own 35 acres or more we may apply for a domestic
well permit which can supply 3 residences, water livestock and
irrigate 1 acre.
With this in mind we should be able to supply water to the future
home on the lot in question.
Mr. Schurer said I should write to you and your office would send a
letter to his office for verification that this is possible.
I have filled out a well permit application and will mail to him by
the end of this week.

1. Weld County Septic Permit is required for the proposed home septic system
and shalt- be installed according to the Weld County Individual Sewage
Disposal Regulations.
2. An Individual Sewage Disposal System shall be located at Least 100 feet
from any well.
3. An Individual Sewage Disposal System permit shall Le finalized and
approved by an Environmental Protection Specialist within one (1) year of
the application date.
4. Prior to recording the plat, a water well access easement and maintenance
agreement approved by the County Attorney's Office shall be established in
the form of a covenant to allow the noncustodial party access to the well
and to share appropriately in the maintenance cost of the well. . The
agreement shall be recorded in the Office of the Weld County Clerk and
Recorder.
5. The Recorded Exemption plat shall show the water well access easement for
the benefit of the noncustodial user.
6. The appl ,cant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County' Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall
be submitted within sixty (60) days from the date of approval by the
Department of Planning Services . The applicant shall be responsible for
paying the recording fee.

1. Explain :he reason for the proposed recorded exemption and how each
proposed lot will be used.
The proposed recorded exemption will provide the owners a large rural lot for
their daughter. The proposed lot will be used for a rural home.
2 . Describe the location, size and present use of the area where each
proposed new lot will be created. The location of the proposed lot will
be the N.E. corner of lot B Sec 4 T 3 N R 66 W. The size of the proposed
lot will be 6-7± acres; the proposed lot is currently 4± acres in alfalfa
3± acres in pasture. Lot B is currently 50± acres in alfalfa 10± acres
pasture and 2± acres in gas wells & apparatus.
3. Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable.
Lot B has been improved greatly since purchased 32 years ago and will not
change from agricultural. The proposed lot will be a large rural lot &
home which certainly is consistent with the surrounding area & the Weld
County Comprehensive Plan.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption.
There will be no change in the uses of the proposed lot thereby making it
totally compatible with other large rural lots and homes in the area.
Lot B will remain productive farm land.
5. Explain 1ow the proposal is consistent with the intent of the zoning
district it is located within.
The property is located in agricultural zoning and lot B will remain
agricultural and the proposed lot will be a large rural lot. No change
is contemplated and the uses are fully compatible with existing
surrounding uses.
6. Explain how the proposal is consistent with efficient and orderly
development.
The proposal is consistent with efficient and orderly development in that
it provided additional tax base and adequate housing without and burden
on the Weld County Infrastruture.
7 . Explain how adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County will be
accomplisled.
