HomeMy WebLinkAbout930438.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A RECREATIONAL FACILITY (GOLF DRIVING RANGE) IN THE A (AGRICULTURAL) ZONE DISTRICT - HENRY AND MARJORIE RICKERS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of May, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Henry and Marjorie Rickers, 2497 I-25 Frontage Road, Erie, Colorado 80516, for a Site Specific Development Plan and Special Review Permit for a recreational facility (golf driving range) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the N? SE! of Section 21, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, Henry Rickers, applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: PL0907 930438 p oQa' t, . , _, SPECIAL REVIEW PERMIT - RICKERS PAGE 2 a. The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals and Policies. The cities of Northglenn, Broomfield, and Dacono and Adams County Planning Departments have no objections to this proposal. The Town of Erie has recommended conditional approval. This is addressed in the staff's additional comments. b. The proposal is consistent with the intent of the Agricultural Zone District and, as a recreational facility, is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include pasture, rural residences, oil and gas production, and agricultural land. The proposal will be compatible with the future development of the surrounding area. d. The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a recreational facility (golf driving range) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. Hall / L , rkmeya O 930438 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS HENRY AND MARJORIE RICKERS USR #1006 1. The Site Specific Development Plan and Special Review Permit is for a recreational facility (golf driving range) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. Adequate toilet facilities shall be provided for the public. 6. The septic system shall be designed by a Colorado registered professional engineer according to the Weld County Individual Sewage Disposal Regulations. The Individual Sewage Disposal System Permit shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 7. The facility shall utilize the existing public water supply. 8. All construction activities that disturb more than five acres shall obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 9. The minimum distance between access points along the I-25 west frontage road shall be 550 feet. 10. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 12. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 13. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 930438 DEVELOPMENT STANDARDS - RICKERS PAGE 2 14. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Henry Rickers, applicant, was present and explained the proposal. In response to questions of the Board, Mr. Rickers said he has no problems with the Conditions of Approval and Development Standards. He said there is one entrance to the homes and one to the range, confirming no additional entrances will be required. There was no public testimony offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Henry and Marjorie Bickers for a Site Specific Development Plan and Special Review Permit for a recreational facility (golf driving range) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. LEGAL DESCRIPTION: Part of the N2 SE4 of Section 22, T1N, R68W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately .25 miles south of Erie on the west side of I-25 and .25 miles north of Weld County Road 6. Henry Rickers, applicant, said the proposal for a golf driving range is perfect for this area. There is a natural draw with a cement ditch on the property and the area is already in grass. Access is directly from I-25 Frontage Road and is paved to the proposed driving range. Shirley Camenisch asked if they had a problem with run-off in the summer because of the natural draw. Henry Rickers said no. There is an irrigation ditch, a pond and a lake on the property that he owns. Bill O'Hare asked if he owned any other property in the area. Henry Rickers said yes, 80 acres, he has been farming since 1945. Shirley Camenisch asked if there were any plans to continue the frontage road where it now dead ends. Henry Rickers said not in the immediate future, but if and when it is continued, it will not affect the driving range. Bill O'Hare asked if the applicant has secure water rights. Henry Rickers said yes. Bud Clemons wanted clarification about the on-off ramps from I-25. Henry Rickers showed him on the overhead map. Bill O'Hare asked Mr. Rickers if he was in agreement with the Department of Planning Services' staff recommendation. Henry Rickers said yes. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Bud Clemons stated, for the record, there were two letters sent to the Department of Planning Services opposed to this application. Henry Rickers said these letters were sent by surrounding property owners who did not understand the application. They thought he was requesting a rezoning of the property. Juliette Kroekel moved to forward Case Number USR-1006, Henry and Marjorie Rickers, to the Board of County Commissioners with the Planning Commission's recommendation for approval. Bill O'Hare seconded the motion. The Chairperson asked the secretary to poll the members of the Planning Commission for their decision. Rickers ITEM 1 : Application Form ITEM 2 : Description of Proposed Operation The proposed use of the land designated in this Site Specific Development Plan is for a golf ball driving range. The driving range would serve traffic off of 1-25 and surrounding cities and towns. The sport of golf is fast becoming one of the most popular in the United States. The need for golf courses and related recreational facilities is apparent by the overcrowded conditions and long waiting lines at most golf courses in the Denver area. Driving ranges in particular are increasingly becoming a popular source of recreation for the following reasons: 1. Many golfers do not have the four or five hours needed to play a round of golf due to other commitments such as job and family; a quick trip to a driving range to hit a bucket of balls takes perhaps one hour. Applicant anticipates that many people who commute to work on I-25 will stop to hit a bucket of balls before or after work due to the easy access off of I-25 . 2 . Women are tired of being "golf widows" and are now taking up the sport of golf so they can golf with their husbands and friends. Many women like to practice on driving ranges before they "take on" a full length golf course. 3 . Driving ranges provide an excellent recreational facility for family outings with children, where the children can learn and participate in the sport of golf. The surrounding land is used mainly for agricultural , residential and commercial purposes. The land to the east of I-25 has a facility for trailer sales. The nearest residential structure is approximately 600 feet away. This house is owned and occupied by the owner of the land, the Applicant. There is a residential structure owned by the son of the Applicant located approximately 750 feet away. Residential homes not owned by the Applicant or his family are approximately 1/2 mile away. The proposed driving range would consist of twenty-eight driving platforms. These platforms would be ten feet in width, for a total of 280 hundred feet of driving area. Therefore, twenty-eight golfers could be driving golf balls at one time. Participation would be on a first-come, first-serve basis. There would be no membership required. Based on an estimated twenty- eight golfers per hour, for fifteen hours (in the summer) , the maximum number of users would be approximately 420 per day. A more realistic estimate would be approximately 200 customers per day. The hours of operation would be from dawn to dusk. There would be approximately two eight-hour shifts. The number of employees per shift would be one or two. The employees would be there to oversee the driving range and sell buckets of balls, assure the safety of the customers, and pick up golf balls in a protected tractor. Applicant intends to install a single-phase, 230-volt power source, through United Power, in order to provide electrical power to the proposed site. A copy of this estimate from United Power is attached. Applicant has a permit from the Central Colorado Water Conservancy District to use 360 gallons per minute of water from the well located south of the proposed site. The water available with this permit has been used to irrigate the land for fifteen years and will continue to irrigate the driving range. A copy of the permit from the Central Conservancy District is attached. Applicant owns a water tap from Left Hand Water District. Left Hand Water District has agreed to upgrade that tap from a residential tap to a business and light commercial water tap. Applicant intends to run a water line from the tap at his residence to the site. A copy of the confirmation letter from Left Hand Water District is attached. Also attached is a letter agreement from Farmers Reservoir and Irrigation Company indicating their willingness to grant a license for Applicant to install this water line beneath the irrigation ditch situated next to the site. This water will be available for bathrooms and potable drinking water. A septic system complying with Weld County Health Department regulations will be constructed to dispose of sewer from the bathrooms. The access route to the site would be off 1-25 and Weld County Road 8 down the existing southwest frontage road, which leads straight to the parking lot. This is a paved frontage road which dead-ends at the south border of Applicant's property, and is used primarily by Applicant and occasionally by oil field employees. The type of vehicular traffic would be strictly passenger-type vehicles. Applicant has spoken with Bud Hooper, of the State Department of Highways, concerning use of this frontage road as an access for the driving range. At this time, he does not anticipate a problem with using the paved frontage road for this purpose. Attached to this application is an Application for State Highway Access Permit, which will be obtained prior to construction of the driving range. -2- 91;0 k33 Applicant will construct a small building from which to sell balls and refreshments (the "Pro Shop") . A sketch of the floor plan of the building is attached. Applicant intends to install a septic system and leach field to dispose of sewage resulting from two bathrooms housed in the Pro Shop. The location of the septic system and leach field is shown on the USR Plan Map. Fire protection measures would consist of strict compliance with all regulations, including the placement of smoke detectors and fire extinguishers in the Pro Shop. The site is protected by the Mountain View Fire Protection District, with the nearest fire station being situated in Erie, five miles to the west. Sufficient entrance and exit access will be provided for rescue and fire vehicles. There will be no animals located in the Use by Special Review area at any time. There will be one 5X7 foot trash dumpster in a fenced enclosure located in the area of the Pro Shop for trash collection associated with operation of the facility. The trash will consist mainly of any debris resulting from the sale of refreshments at the site. The trash will be collected from the dumpster at two week intervals. Applicant believes that storm water retention facilities will not be needed. The parking area will consist of a cinder base covered with pea gravel, therefore allowing storm water to be absorbed into the ground. The Pro Shop will be approximately 30 feet by 40 feet and will not affect storm water retention to any significant amount. As shown on the USR Plan Map, the beginning of Little Dry Creek drainageway provides a natural draw which will continue to carry storm water runoff as it does now. The driving range will consist mainly of a landscaped tee area for the golfers to stand on (the "Tee Area") and an area approximately 980 feet long and 400 feet wide on which the balls will land (the "Range") . Seating in the form of benches or chairs and tables will be provided for spectators. Applicant intends to build up target greens, approximately three feet high and 80 feet in diameter, at 75, 100, 135, 185 and 235 yards from the Tee Area on the Range. These greens will allow the practicing golfers to aim at a green, just as if they were on a golf course. The Range will be planted in drought resistant grass to reduce the amount of water needed to irrigate the area. Trees will be planted on the east border of the area, along the highway fence. A netting fence will surround the driving area. The Applicant has corresponded with Farmers Reservoir and Irrigation Company (copy of letter attached) regarding this matter. -3- 138 The parking lot will have 42 regular spaces plus one handicap space and comply with all necessary regulations, as shown on the USR Plan Map. There will be very little reclamation required upon cessation of the Use by Special Review area, if such cessation occurs. The land required for the driving range can easily be converted back to its original state (growing alfalfa) . The "Pro Shop" can either be torn down or converted to a storage shed, for example. Applicant hopes to begin construction of the driving range in the spring of 1993 , with an anticipated opening date in the summer of 1993 . Future plans for expansion include a turf farm and nursery, a putting green, and lights to enable the customers to use the driving range at night. The turf farm and nursery will be used to grow trees and replacement turf specifically for use on the driving range. It will not be a commercial nursery. The lights would not adversely affect drivers on I-25 as they would be directed to the west, nor would they adversely affect any surrounding landowners. ITEM 3 : Supporting Statements and Documents "The urban growth boundaries and the I-25 mixed use development corridor are the areas intended to accommodate commercial development. " (Page 38, Weld County Comprehensive Plan. ) Applicant believes that the construction of a driving range complies with the commercial uses intended for the I-25 mixed use development corridor, in which this site lies. The driving range is anticipated to use approximately 19 . 8 acres of the Applicant's land. The majority of the Applicant's land will continue to be used for agricultural purposes (growing grass) . "open space is desirable because it performs many natural functions and satisfies many human needs. . Open space is used for outdoor recreational activities and other leisure time pursuits which promote the health and welfare of the people. " (Page 82 , Weld County Comprehensive Plan. ) Applicant believes a driving range meets this requirement of promoting productive open space. Because the driving range will be located in such a way that the balls will be hit to the southwest, away from the highway located to the east of the site, there is adequate provision for the health, safety and welfare of the people driving on I-25. Applicant intends to purchase liability insurance. Applicant believes that the driving range will be compatible with the existing surrounding land uses, which are agricultural , -4- ;30 :4 +3 residential and commercial. The land to the east of the site across I-25 has a facility for trailer sales. The Applicant and his son's family own residences on the land. The land immediately to the north, south and west of the land is used for agricultural purposes. The site is not located in a 100 year flood plain or Weld County Airport overlay district. The site is located in a geologic hazard area, caused by underground coal mining done in the area in the 1950s. However, according to Jeffrey L. Hynes, Senior Engineering Geologist for the Colorado Geological Survey, the mining was done 400 feet below the surface of the earth, and there is very little chance of future subsidence in the area which would cause damage to any building constructed on the site. Mr. Hynes stated to Applicant that he would be willing to write a memorandum to this effect if asked to do so by the Weld County Planning Commission. However, due to the dead end condition which currently exists, allowance of the second access point seems reasonable. The location of the north access to the property should be reviewed in relation to any existing access to the north (others not shown of the Plan) . A minimum distance of 550 feet between access points along the frontage road should be maintained for safety reasons. Impact to the frontage road is not a factor at this time; however, should the frontage road ever be continued to the south, the access should be reevaluated in order to determine the need for acceleration/deceleration lanes which improve the safety of the highway. The narrative mentions addition of a turf farm and nursery in the future. This would require reevaluation of access to the property, and it is probable that a joint access would be required, as an third access to this property would not be looked upon favorably. This should be considered in the current planning process. DRAINAGE The highway drainage system is for the protection of the state highway right-of-way and is not intended to accommodate drainage from abutting properties beyond that which has historically been accepted.
