HomeMy WebLinkAbout941034 AR241.31.05 RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #1662 - MARKHAM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption #1662 was submitted by Glenn D. and Patricia A. Markham, 18360 Weld County Road 3, Berthoud, Colorado 80513, for property which is located in part of the SW* of Section 32, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 4.750 acres and 4.748 acres, and WHEREAS, after reviewing the Planning staff's concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Ordinance as defined in Section 1.3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. 4. It is the opinion of the Board that any further division of these lots will increase the density of the existing linear subdivision. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption #1662, submitted by Glenn D. and Patricia A. Markham. The parcel of land under consideration is described as part of the SW4 of Section 32, T4N, R68W of the 6th P.M., Weld County, Colorado. The property is located east of and adjacent to Weld County Road 3 and approximately 320 feet north of Weld County Road 38. The parcel is 9.498 acres, more or less, in size and was created by deed in 1971. The applicants are requesting to divide this parcel into two parcels of 4.750 acres and 4.748 acres, more or less. The land has no existing improvements on it and appears to be planted as a part of the sod farm. This parcel is not the total contiguous land holdings of the applicants. The Markhams, in fact, own a substantial portion of the south half of Section 32, which is used in part for their sod farm operation. There is no direct access to the parcel existing from Weld County Road 3, from which it fronts. The property owners access the property by way of road(s)through adjacent parcels to the east and/or north. The proposal is to convert the 9.498 acres into two residential homesites. Little Thompson Water District has indicated its willingness to provide water for this use. Septic systems are proposed for sewage disposal on the sites. The Town of Mead, located approximately two miles southeast of the property, has no objection to the request. The Weld County Health Department recommends conditional approval. The Department of Planning Services' staff recommends denial of this proposal based on noncompliance with the Weld County Comprehensive Plan's Agricultural goals and policies and Transportation goals and policies as well as lack of efficient and orderly development. Two other recorded exemptions are being requested by the applicants in conjunction with this application. RE-1663 is located approximately 3/8 mile to the east of the subject site. RE-1661 941034 • is adjacent to and north of this parcel;the proposal is to divide a 10.47 acre parcel, more or less, also containing no improvements, into two parcels of 5.235 acres and 5.235 acres, more or less. If both RE-1661 and RE-1662 are approved, four buildable sites would be created where there are presently no residences. It is the staffs opinion that this proposal does not encourage or enhance agricultural land uses as intended by the County Comprehensive Plan . Agricultural policy#1 states: "The agricultural zone district is intended to preserve prime agricultural land and to provide areas for agricultural activities and uses dependent upon agriculture without the interference of incompatible residential...land uses." The 9.498 acre property is identified as prime farmground by the Department of Agriculture Soil Conservation Service. Staff does not see the benefits to the Agricultural zone district for establishing the potential for increased development at this location. The two proposed lots would access Weld County Road 3, classified as a county local road. The County Comprehensive Plan states: "Local county roads are designed for low speed and low traffic volumes. They provide the first access link between individual properties and the higher mobility highway system. Local roads carry traffic volumes that are less than two hundred (200) vehicles a day." The one-mile stretch of road along Weld County Road 3 between Weld County Roads 38 and 40 already has 14 residential and 3 agricultural accesses existing. Two additional dwellings have the potential of generating an average of 24 trips per day, according to the County Public Works Department. This request does not comply with the transportation goals and policies because of the request for the addition of two residential accesses onto the county road which already has numerous accesses. In order to consider the realistic impact of this recorded exemption, RE-1661 must also be considered. What we have are two small parcels, each under the minimum lot size of 80 acres, which are presently undeveloped. By dividing both parcels, four buildable residential sites are created, each with one access, where no access is existing now. Allowing linear subdivisions to occur in the Agricultural zone district is in conflict with efficient and orderly development. This property may lie within the Urban Growth Boundary of the Town of Mead; however, Mead provides no services to this area. The level of development along Weld County Road 3 is already high, due to the piecemeal splitting of ground which has taken place in the surrounding area. Due to the above-stated reasons, the Department of Planning Services' staff requests that the Board of County Commissioners deny this recorded exemption request. It is the staff's opinion that this proposal does not meet the criteria for approval as stated in Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance, nor does it comply with the Weld County Comprehensive Plan. We currently have capacity available in our 8" line along WCR 3 . We can provide service to the each of the 2 lots by means of a single 5/8" X 3/4" standard residential water tap with the following conditions: 1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of $1000 per lot for all lots ("A" & "B") to be added to the system. This is due upon recording of the final plat for the new lots. 2 .
