APPROVED WITH CONDITIONS The Department of Planning Services has determined through the review that the standards of Section 9-2 E. (1) (a) through (m) of the Wed County Subdivision Regulations have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. Within 30 days of recording, Lot B of RE-1392 shall be re-conveyed to correct the legal description as shown on the previous deed. The access easement across Lot B for the benefit of Lot A shall be shown on the Recorded Exemption plat and shall be a minimum of 30 feet in width. The access agreement shall be amended to show the easement 30 feet in width. The amended access agreement shall be recorded with the Recorded Exemption plat. Lesh and Patricia J. Lesh with regard to the attached Recorded Exemption Application. Below are responses to the Recorded Exemption Procedural Guide. The numbers correspond to the numerical sequence in the Application Requirements : 1 . A completed application form. Attached. 2 . A completed certificate of conveyances on the subject property. Attached. 3. A copy of a deed, purchase contract, or legal instrument indicating that the Applicant has interest in the subject property. Attached. 4. A statement describing the purpose and reason for dividing a lot into two (2) separate lots. As shown on the attached drawing, Lot A and Lot B of the proposed Recorded Exemption are adjacent to the West Side Addition Subdivision to the Town of Pierce . Lot A of the proposed Subdivision contains a residence that originally belonged to the Applicant' s parents . Lot B of the proposed Recorded Exemption is a useful building site and, because it is only 2 .809 acres, is not economically farmable or useful for most other purposes. A statement explaining that the proposal is consistent with the policies of the Weld County Comprehensive Plan. Applicant ' s proposal is consistent with the Comprehensive Plan because it will not take productive agricultural land out of production; i.e. , both parcels are too small to be economi- cally useful for agriculture. Both parcels are adjacent to a subdivision and, therefore, the Weld County Comprehensive Plan goal of having growth next to existing municipalities is met. 6 . A statement explaining the proposal is consistent with the intent of the zone district in which the subject property is located. The property is presently zoned agricultural but has not been used as agricultural for an extensive period of time. Dividing the land into two separate parcels is consistent with the agricultural zone district because residences are permitted in the agricultural district. Both parcels of the proposed Recorded Exemption are too small to farm as agricultural units. 7. A statement explaining what uses will be permitted and how those uses are compatible with existing surrounding land uses. A residence is already located on Lot A of the proposed Recorded Exemption and is compatible with the surrounding uses which are agricultural to the south and west of the property and the West Side Addition Subdivision which is east of the property. 8. A statement explaining the uses permitted will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the County or the adopted master plans of affected municipalities . Applicant ' s use will be compatible with the future development of the surrounding area because there is a subdivision to the east of the proposed Recorded Exemption and agricultural uses to the west and south of the property. The existing zone districts will not be affected by Applicant' s proposal . 9 .
