AND ALICE M. WOMACK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of February, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Glen H. and Alice M. Womack, c/o Thomas E. Hellerich, Attorney, Suite 300, Bank One Plaza, 822 7th Street, Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review Permit for an industrial use in the A (Agricultural) Zone District to construct storage tanks on the following described real estate, to-wit: Part of the Wz NW* of Section 20, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Thomas E. Hellerich, Attorney, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan's Agricultural and Urban Growth Boundary Goals and Policies. This proposal will not remove any productive agricultural land from production. The City of Fort Lupton has reviewed this proposal and made suggestions. The proposal is provided for in the Weld County Zoning Ordinance as a Use by Special Review. c. The permitted uses will be compatible with the existing surrounding land uses which include rural residences, cropland, storage tanks, railroad tracks, oil and gas production, a pipeline facility, an electrical transformer, an electrical switching station, dryland grasses, a landscaping facility, U.S. Highway 85, and irrigated crops. d. The permitted uses will be compatible with the future development of the surrounding area which is expected to have similar uses, given the location between rail lines, U.S. Highway 85, and the City of Fort Lupton. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Glen H. and Alice M. Womack for a Site Specific Development Plan and Special Review Permit for an industrial use in the A (Agricultural) Zone District to construct storage tanks on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: a. The applicant shall submit information which demonstrates the on-site well will supply an adequate amount of water. b. The plat shall be amended to clarify that the railroad lease area is not a part of the permitted area. c. The plat shall be amended to include a 10-foot right-of-way reservation on the northwest 195-foot section of the site for future use of U.S. Highway 85. 940125 SPECIAL REVIEW PERMIT - WOMACK PAGE 3 d. The plat shall be amended to indicate where on the property the raw materials will be stored. e. The plat shall be amended to indicate where the 20 parking spaces are located. 4. Within 30 days of approval by the Board, the applicants shall enter into an improvements agreement with the Weld County Board of County Commissioners for the proposed trees to be located on the western boundary of the property. Kirkmeyer 940125 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS GLEN AND ALICE WOMACK, C/O THOMAS HELLERICH USR #1037 1. The Site Specific Development Plan and Special Review Permit is for an industrial use in the A (Agricultural) Zone District to construct storage tanks as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. No direct access shall be permitted from the site onto U.S. Highway 85. 4. No trees or buildings shall be placed within the highway right-of-way. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. An Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health, for emissions of hazardous or odorous air pollutants and criteria listed in the Emissions Permit. Sources of such emissions include, but are not limited to the following: sandblasting operations, spray paint booths, haul road traffic, boilers, and incinerators. 7. No permanent disposal of wastes shall be permitted at this site. 8. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the light industrial limit of 70 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 11. Any existing septic system which is not currently permitted through the Weld County Health Department will require an Individual Sewage Disposal System evaluation prior to the issuance of the required septic permit. 12. Adequate toilet facilities shall be provided for the public. 13. An Individual Sewage Disposal System is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 14. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 940125 DEVELOPMENT STANDARDS - WOMACK PAGE 2 15. All potentially hazardous chemicals shall be stored and handled in a safe manner, according to section 25-8-205.5 of the Colorado Water Quality Control Act. 16. All construction activities that disturb more than five acres shall obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 17. The hours of operation shall be 7:00 a.m. to 5:00 p.m. 18. Raw materials and finished product stored outside of the buildings shall be adequately screened from road rights-of-way. 19. No storage tanks shall be used to store material on site. 20. No raw materials or finished product shall be stored off the permitted property. 21. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 22. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 23. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 24. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 25. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 26. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 940125 HEARING CERTIFICATION DOCKET NO. 94-20 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN INDUSTRIAL USE IN THE A (AGRICULTURAL) ZONE DISTRICT TO CONSTRUCT STORAGE TANKS - GLEN H. AND ALICE M. WOMACK A public hearing was conducted on February 9, 1994, at 10:00 A.M. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated January 10, 1994, and duly published January 27, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Glen H. and Alice M. Womack for a Site Specific Development Plan and Special Review Permit for an industrial use in the A (Agricultural) Zone District to construct storage tanks. Lee Morrison, Assistant County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. He submitted a staff recommendation, Exhibit L for the record, for continuance to allow time for the applicant to submit an amended plat and a landscaping plan for staff review. He indicated a recommendation from the City of Fort Lupton was received at this hearing concerning the landscaping sketch; however, staff has not had time to review said recommendation. Mr. Thompson also stated relocation of parking and raw material storage on the amended plat has not been submitted or reviewed. Thomas E. Hellerich, Attorney, represented the applicant and submitted copies of the letter from the City of Fort Lupton as Exhibit M. Mr. Thompson reiterated the landscaping plan had not been reviewed by staff and stated it appears it would screen the highway, but not the east, north, or south surrounding properties. In response to a question from Commissioner Hall, Mr. Thompson reiterated the amended plat with the applicant's desired relocation of the parking and the raw material storage had not been submitted or reviewed by staff. Mr. Hellerich explained the letter from the City of Fort Lupton was just faxed to him at 9:30 a.m. today. Curtis Pittman, Manager for Permian Tank, indicated he was not able to meet with the City of Fort Lupton until February 8, 1994, at 7:00 p.m. He explained the City of Fort Lupton's main concerns were the storage of raw materials and the cosmetics of the facility; and, by relocating the parking and storage to the east side of the building, the building would serve as the screen. Mr. Pittman requested the Board proceed with the Permit today to allow them to proceed with building contracts, etc. , and stated they want to meet the necessary requirements. He indicated the types of trees would be selected from a list provided by the Platte Valley Soil Conservation District and explained they do not want to hide the facility by screening because they want to advertise their product. Mr. Pittman stated the City of Fort Lupton agreed to disregard the fence if attractive landscaping were provided. During discussion between Mr. Pittman and Commissioner Harbert, he indicated one of the neighbors is installing a six-foot privacy fence. In response to 940125 Pt o9 cc_ ; r_, RE: HEARING CERTIFICATION - WOMACK, C/O HELLERICH PAGE 2 a question from Commissioner Kirkmeyer, Mr. Hellerich indicated the amended plat has not been completed and confirmed there were no problems with Condition of Approval #3a through #3f; however, he requested Development Standard #18 be eliminated. Mr. Thompson indicated the Planning Commission's recommendation included screening road rights-of-way and adjacent properties and stated it is the applicant's responsibility to screen, not the surrounding property owners' responsibility. He reiterated concern about not receiving a landscaping plan, other than the one from the City of Fort Lupton, which was received today and has not been reviewed. Commissioner Harbert agreed it was the responsibility of the applicant to screen and suggested screening to the north with trees. Mr. Pittman indicated they had not previously been asked to do that, but he would agree if necessary. He explained the neighbor who is building the fence also uses Permian's easement on a daily basis. Mr. Thompson stated further concerns with problems arising prior to recording the plat as to whether the landscaping plan adequately screens, thereby putting the burden on staff. He reiterated he would like to review the amended plat prior to Board approval. Mr. Pittman described the surrounding properties, and Commissioner Harbert recommended screening on the north and west. After further discussion, Mr. Hellerich noted no adjacent landowners objected to the request and their intent is to screen from the highway, with trees being sufficient. Commissioner Baxter agreed the burden should not be staff's and screening would not be necessary to the east and south, with trees on the north to screen from the highway. Commissioner Webster agreed with Commissioner Baxter that the trees should extend 200 feet to the north and Mr. Pittman and Mr. Hellerich agreed. Mr. Hellerich stated the trees would be placed in a V-shape to display the tank. In response to a question from Mr. Thompson and Commissioner Harbert, Mr. Pittman stated the types of trees had not been decided upon, but the trees would be selected from the Soil Conservation District's list and would grow to about 20 feet in height. He indicated the trees would be watered by a well, for which they will get a permit; an irrigation system will probably be installed; and the trees on site will be one to one and one-half inches to start. Mr. Hellerich referred to the letter dated January 4, 1994, from the Soil Conservation District concerning the types of trees. Mr. Thompson indicated the letter was received January 24, 1994, and was sent to the Board accompanied by a memo and a pamphlet. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Glen H. and Alice M. Womack for a Site Specific Development Plan and Special Review Permit for an industrial use in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the language in Condition of Approval #3 being changed from "Prior to the Board of County Commissioner's meeting: . . ." to "Prior to recording the plat: . . ."; the deletion of Condition of Approval #3e since the landscaping plan and the information regarding the trees have now been adequately addressed, with no screening necessary to the north since the adjacent landowner is not present and is working with the applicant; Development Standard #18 to remain, with the screening considered adequate by the materials being stored behind the building and the amended plat showing the storage and parking; with the remaining Conditions of Approval and Development Standards as entered into the record. Mr. Pittman and Mr. Hellerich agreed to said changes, and the motion was seconded by Commissioner Baxter. Mr. Thompson suggested the words: "adjacent properties and" be deleted from Development Standard #18 since no screening will be provided for surrounding and/or adjacent properties and the facility will only be screened from road rights-of-way. Commissioners Kirkmeyer and Baxter agreed to said deletion. Mr. Pittman indicated if they outgrew the screening provided by the building, then it would be screened in some other manner. Mr. Thompson indicated that matter would need to be provided to staff in writing. The Commission reviewed a formal landscaping sketch presented by Mr. Pittman of Permian Tank. The Commission would like to rescind their original fence request if Weld County will make this sketch a part of the Special Use Requirements. The plan would consist of trees on both sides of the building tapering at a 45 degree angle toward the center of the building. The center area would be used as a tank display with lights set to shine on the tank and the signage on the building. The Commission also requests that tank storage only be permitted in the area indicated on the site plan, and that all other storage remain out of sight of the highway. Sources of such emissions include, but are not limited to the following: sandblasting operations, spray paint booths, haul road traffic, boilers, and incinerators. 7. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the light industrial limit of 70 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 11. Any existing septic system which is not currently permitted through the Weld County Health Department will require an Individual Sewage Disposal System Evaluation prior to the issuance of the required septic permit. 12. Adequate toilet facilities shall be provided for the public. 13. An Individual Sewage Disposal System is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 15. All construction activities that disturb more than five acres shall obtain a stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division. 17. The hours of operation shall be 7:00 a.m. - 5:00 p.m. 18. Raw materials and finished product stored outside of the buildings shall be adequately screened from adjacent properties and road rights-of-way. 19. No storage tanks shall be used to store material on-site. 20. No raw materials or finished product shall be stored off of the permitted property. 21. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 22. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 23. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 24. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 25. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Centrifugal action, reduced velocity and retention time combine to allow gas to separate from the liquid and flow upward through the mist extractor to the gas outlet. Oil and water travel downward through the large internal conductor pipe and are released below the firebox. Free-water continues downward to be discharged from the bottom portion of the treater. Oil and entrained water are distributed by the spreader and rise around the firebox through the heated water section. The increase in temperature breaks the emulsion resulting in small droplets of water coalescing into drops which enlarge in size and weight until they start settling downward to the water sec- tion. This settling action continues as the oil rises at minimum velocity through the full diameter settling section. Clean oil at the top of the settling section spills over and travels through piping to the head operat- ed dump valve. Water is removed from the bottom portion of the treater through an externally adjustable water siphon and head operated dump valve. Projected traffic on SH 85 indicates the need for a 150-foot total ROW, 75 feet each side of the highway centerline . As it appears that the north 195 feet of Lot 2 only provides 65 feet of available ROW, the additional 10 foot strip to meet the projected need should be provided. That strip should be protected by reservation or, preferably, dedication, as permitted by County regulations . ACCESS The Plot Plan and the narrative address access for Lot 2 . The Plot Plan shows a 30 foot access road easement from WCR 20, and the narrative addresses access for deliveries by semi truck to be made by that route . The narrative further proposes that the finished products be hauled off of the site in smaller trucks . The explanation provided indicates a loop type delivery, with entry by way of the county road, and exit directly to SH 85 . As the property clearly has access by way of the county road, no direct access to the state highway should be allowed. Access to the highway is controlled by deed, and every effort is made to limit the number of accesses directly to the highway. It appears that the 495 foot distance from the county road to the north end of the site provides reasonable access, and as the site is 540125 Mr. Greg Thompson December 22 , 1993 Page 2 of 2 Womack Special Review undeveloped, site planning should provide for internal circulation of traffic to ensure that the loop type drive is not needed. DRAINAGE The Plot Plan shows drainage slopes both toward the highway ROW and to the east, directed to an existing drainage pond area at the southeast corner of the site . The narrative states that gravel parking and drive are planned, with the only hard (impervious) surfacing planned for the building sites . There is no mention if grading work will be required. It should be noted that the highway drainage system is for the protection of the state highway ROW, and is not intended to accommodate drainage from abutting properties beyond that which has historically been accepted. This condition requires verification. PLANTINGS The tree line as proposed is located east of the ROW line, which is proper, as no trees should be allowed within the highway ROW. UTILITIES No utility information has been provided. As plans for development progress, keep in mind that should any new utility lines or connections be required within the state highway ROW, a utility permit will be required. The following is submitted on behalf of Glen Womack the applicant, as a part of his request for a Use by Special Review of a part of Lot 2 of a Recorded Exemption No. 1309-20-2-RE1039, recorded October 15, 1987 . The applicant, Glen Womack, is the owner and operator of a business entitled Permian Tank, of 1762 Denver Avenue, Fort Lupton, Colorado. Mr. Womack has recently acquired ownership of Lot 2 of a certain Recorded Exemption, being a part of the W 1/2 of the NW 1/4 of Section 30, Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, which lies between Weld County Road 20 and Weld County Road 18 1/2 . This parcel of ground is approximately 2 1/2 miles North of Fort Lupton, and lies along and abuts the East side of Highway 85, between Weld County Roads 20 and 18 1/2 . This property is presently zoned agricultural, but has not been used for agriculture purposes for numerous years. The property was previously owned by Lillian Elliott, and has not been farmed by her for several years. The adjoining property around it is being used for both commercial and agricultural purposes. The property immediately to the East is not being farmed, the property to the West across Highway 85 is presently being farmed. The property to the South is presently being used for commercial operations. In addition to the commercial operations there are extensive oil and gas operations to the South. The property presently is of little value or use, but can be efficiently used for a small business in the nature of the Mr. Womack's business. Mr. Womack would be essentially assembling the tanks and storing the raw materials on this property, which would be used in the area for agriculture and the oil and gas industry. The applicant believes that the request for a Use by Special Review is consistent with the Weld County Comprehensive Plan, and is consistent with the changing conditions and needs of the area. At present the property is unused and is covered by weeds. The property would be converted to useful property, and would not remove any property or land from agricultural adventures. The type of assembling proposed by the applicant, would not create air and water pollution, nor create any noise or dust problems on the property, or adjoining properties. All manufacturing would take place indoors. The applicant believes that the Use by Special Review is consistent with the conditions in this area as there are existing uses of commercial and related uses. The property is further separated to the East, by the Union Pacific Railroad tracks and the Union Pacific Railroad right-of-way. Thus, there is a natural barrier between the property and the adjoining lands to the East, and U.S. Highway 85 is a natural barrier to the West, dividing the property from other properties. Further, the property is 16. 372 , plus or minus, acres, and cannot be successfully used in agricultural endeavors. The operations of the applicant will have very limited affect on the environment, including the air and water traffic, dust or noise. Further, as you proceed South towards Fort Lupton, the changing conditions include growing commercial and related uses. The applicant ' s use of the property is also consistent with the goals of the industrial development, as it will provide diversified industrial economic base, provide service and products to the agriculture industry and to the oil and gas industry, will promote efficient and cost-effective delivery of these services and products, and will expand the job base. The applicant believes that the Use by Special Review would be consistent with the existing land uses, as the property to the South is extensive commercial as well as oil and gas facilities. Further, the operation of the applicant' s business is consistent with the oil and gas industry, and the uses being conducted on the property to the South. The property directly to the North and to the East is presently not in agricultural production and it does not appear it will be in agricultural production. The applicant proposes that the land will be serviced by a private well presently available and on the property, or a new well to provide domestic water for drinking and bathroom facilities. The applicant anticipates a maximum of 10-15 employees, and a 2 940125 typical day between the hours of 7 : 00 a.m. and 5: 00 p.m. There is no water necessary to be used in the applicant's manufacturing process. The applicant further proposes that sewer facilities will be provided by a septic system. The applicant would build and install adequate septic system to accommodate the needs. The septic system would be consistent with the surrounding uses and can readily be installed on the 16 plus or minus acres. The applicant anticipates that raw materials would be delivered in a semi load, one load every 10-14 days for the steel deliveries, and that the applicant would be delivering the finished products after manufacturing, from 4 to 6 times per week. The applicant would take the raw materials and will store the raw materials outside and during manufacturing, will be moved indoors and welding will take place to construct the tanks and stairways, and the finished product then will be delivered to the customers, whether in the agricultural industry or the oil and gas industry. Access to the property for delivery of raw materials will be off of Weld County Road 20. Deliveries will be made by semi trucks delivering the raw steel, and the finished products will be made by smaller trucks hauling individual tanks. After entering on to Weld County Road 20, access will then be made to U.S. Highway 85. The applicant does not anticipate that any additional fire protection measures will be necessary on site, and there will be no animals on the property. Applicant further does not anticipate any stockpiling of waste or storage of waste products on the property and the applicant has provided for storm water retention facilities on the property. Applicant will provide for removal and disposal of debris, junk and other waste associated with the manufacturing on a weekly basis through standard garbage removal. In the event additional disposal of debris, junk or other waste is necessary, applicant will provide for that in a timely manner. The applicant proposes adequate landscaping by a line of trees to be planted along the western boundary of the property as indicated on the map. These trees would provide a buffer to reduce any visual impact of the use by the applicant. Applicant would provide for the necessary watering and fertilizing of all such trees and for the replacement of any trees that may die, in a timely manner. The applicant anticipates that the time for construction of the improvements would be approximately 90 to 120 days, and would be done all at one time. The applicant proposes a gravel driveway to the property, and gravel parking lots. The parking lots would not be hard surfaced and the only hard surfaced areas would be where the building would be constructed for manufacturing and for an office building. Applicant does not anticipate any reclamation 3 940125 procedures would be necessary upon cessation of the use of the property by the applicant. The applicant believes that there is adequate provisions for the protection of the health, safety and general welfare of the habitants of the neighborhood where there are natural boundaries around the property, and that the surrounding properties are presently consistent with the applicant' s use. The applicant's use will be consistent with the existing Conoco plant and other commercial endeavors in the immediate area, and there are natural buffers on each side of the property. To the knowledge of the applicant the area requested for a Use by Special Review is not in a flood plain, a geological hazard or the Weld County Airport overlay district area.
