RE: RESCHEDULE DATE TO CONSIDER RE #1265 - BAXSTROM
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , on June 6 , 1990, the Board considered the
application for Recorded Exemption No. 1265 , submitted by Glen
Baxstrom, and
WHEREAS, on said date, the Board deemed it advisable to
continue the matter to September 5 , 1990 , to allow the applicant
time to get further information concerning the adequacy of
domestic water source for the proposed five acre parcel, and
WHEREAS, the Board has been advised that the applicant has
the pertinent information and is ready to proceed, and
WHEREAS, the Board deems it advisable to abandon the date of
September 5 , 1990 , and schedule this matter to be heard on July
18 , 1990 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Recorded Exemption
No. 1265 , submitted by Glen Baxstrom, be, and hereby is, scheduled
for July 18 , 1990 , with the previously scheduled date of September
5 , 1990 , being abandoned.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 16th day of

Subject: Recorded Exemption #1265
Duriug the June 6 meeting of the County Commissioners, the Board decided to
continue Recorded Exemption #1265 for 90 days to allow the applicant to
gather further information from the State of Colorado, Division of Water
Resources.
The information regarding adequate water for both parcels has been submitted
to the Department of Planning Services. On behalf of the applicant, the
Department of Planning Services requests that a new date be established to
consider Recorded Exemption #1265 as soon as it is convenient.

Dear Mr. Schuett:
We have previously commented on the above referenced application split a 57 acre parcel into
two lots of 5 and 52 acres in our letter of May 21, 1990. In that letter we commented on the
adequacy of the water supply for the 5 acre lot, however we did not provide any comment on the
water supply for the 52 acre parcel.
The 52 tract is intended for agricultural use. We consider this to be a one-time exemption
and thus we would be opposed to any future splits of this tract. The availability of a domestic well
for this tract will be the same as any tract over 35 acres.

PLANNING: CONSIDER RESOLUTION RE: VIOLATIONS OF THE BUILD IINUON
ORDINANCE - THOMAS; WEST HILL-N-PARK; AND KIRK: Commissioner
Harbert moved to approve this Resolution authorizing the County
Attorney to proceed with legal action against Gayle Thomas; West
Hill-N-Park; and Bryce Kirk for violations of the Weld County
Building Code Ordinance. Commissioner Kennedy seconded the
motion, and it carried unanimously.
RE #1265 - BAXSTROM: Keith Schuett, representing the Department
of Planning Services, said this request for a Recorded Exemption
was submitted by Glen Baxstrom. Mr. Schuett entered the written
recommendation of the Planning staff into the record. He
explained concerns which the staff has, including the adequacy
of domestic water source for the proposed five acre parcel.
Burl Van Buskirk, representing the applicant, came forward to
make comments to the Board. Mr. Van Buskirk said the applicant
has received a permit from the State Division of Water Resources
for domestic use. There was no public comment offered
concerning this request. Following discussion, Commissioner
Kennedy moved to continue this matter to September 5, 1990.
Commissioner Harbert seconded the motion, and it carried
unanimously.
CONSIDER DEMOLITION OF DANGEROUS BUILDING - ZEBBE (CONT. FROM
5/2/90) : Chuck Cunliffe, Director of the Department of Planning
Services, said this property has been inspected, and it is still
not in compliance. Mr. Cunliffe recommended that this matter be
referred to the County Attorney to proceed with appropriate
legal action. Commissioner Kennedy moved to accept said
recommendation in total. Seconded by Commissioner Harbert, the
motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed
on the consent agenda. There were no Ordinances.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
9:45 A.M.
