RE: APPROVAL OF RECORDED EXEMPTION NO. 1508 - SNYDER OIL CORPORATION
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1508, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1508 was submitted by
Snyder Oil Corporation for property which is located in part of the SE4 of
Section 35, Township 4 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which shall be provided
by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 151.25 acres and 2 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar
plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The
plat shall be submitted within sixty days from the date of approval by the Board
of County Commissioners. The applicant shall be responsible for paying the
recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by
the following vote on the 1st day of September, A.D. , 1993.

Subject: Recorded Exemption 1508
Dear Commissioners:
This application for a Recorded Exemption in the A (Agricultural) zone district was
submitted by Snyder Oil Corporation. The parcel of land is described as part of the
SE4 of Section 35, T4N, R66W of the 6th P.M. , Weld County, Colorado. The property
is located approximately 2 miles southeast of the Town of Gilcrest; west of Weld
County Road 37 and north of Weld County Road 38. The request is to divide a 153.25
acre parcel into two parcels of 151.25 and 2 acres, more or less. The applicants
received approval of a Special Review Permit #1018 on August 18, 1993, and wish to
use the proposed 2-acre site for oil and gas equipment storage. The 151.25 acre
parcel will remain in agricultural production. The existing acreage is Lot B of
Amended RE-591, which was approved in June, 1985.
No water or septic service is proposed for either Lot A or Lot B. The Snyder
property will have no employees who remain on-site with a regular shift. The Special
Review permit has provisions to require that a water supply approved by the Health
Department be kept on site, in the event the facility becomes manned on a full-time
basis. No residential use exists or is proposed on Lot B. The Weld County Health
Department provided conditional approval for this request. The Town of Gilcrest and
the Division of Water Resources had no conflict with the application. The Department
of Planning Services' staff received no objections from surrounding property owners.
The Department of Planning Services' staff recommends approval of this proposal. It
is the opinion of the staff that this request complies with the standards of Sections
11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance.

following the Board of County Commissioners hearing of your Use by Special Review

Sections 11.4.4.1 through 11.4.4.6 of the Weld County Subdivision Ordinance, you

RECORDED EXEMPTION
The proposed use of this property is for oil and gas operations and
no prime agricultural land will be taken out of production. This
land was divided into two separate lots so that the smaller tract
could be used primarily for storage purposes.
CONSISTENCY WITH THE INTENT OF THE ZONE DISTRICT
The proposed use of this land is consistent with other similar uses
in the immediate area. It will have a mineral effect on the
surrounding area.
USES TO BE PERMITTED
The property will be used to store pipe, tanks and other oil
industry related equipment. There will be some permanent fixtures
such as storage tanks and meter houses. The surrounding area has
oil and gas operations as well as agricultural uses. The proposal
is compatible with the other land uses in the area. Lot "B" is
agricultural land and will continue to be used in that manner.
COMPATIBILITY WITH FUTURE DEVELOPMENT OF THE SURROUNDING AREA
This parcel of land is located in the southeast corner of the
southeast quarter of the section. No prime agricultural land will
be taken out of production. There is no residential development in
the vicinity and none is anticipated in the near or far future.
The use of the land is consistent with oil industry operations
throughout Weld County. The proposed use will have a minimal
effect on the surrounding area.
PROPOSED WATER AND SEWAGE DISPOSAL METHODS
This will not be a manned facility, therefore water and sewer will
not be necessary. If there is a need for water it would be hauled
in.
FLOOD PLAIN, GEOLOGIC HAZARD
The property under consideration is not located in a flood plain or
a geologic hazard.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. Weld County Septic Permits are required for the proposed home septic
systems and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. An I.S.D.S. Evaluation on all existing septic systems will be necessary
prior to issuing the required septic permits on the existing systems.
3. An Individual Sewage Disposal System must be located at least 100 feet
from any well.
4. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.
5. A Weld County Cistern Permit is required for the proposed cistern system.
