RE: APPROVE AMENDED PLOWING PERMIT NO. 89-3B AND AUTHORIZE
CHAIRMAN TO SIGN - NATIONAL HOG FARMS, INC.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board did by Resolution dated August 9 , 1989 ,
approve Plowing Permit #89-3 , and by Resolution dated September
27 , 1989 , approve Plowing Permit #89-3A for National Hog Farms,
Inc. , and
WHEREAS, National Hog Farms, Inc. , desires to obtain a second
amended Plowing Permit to cultivate certain grasslands described
as parts of Sections 25 , 26 , 35 , and 36 , Township 5 North, Range
63 West; Section 1 , Township 4 North, Range 63 West; and Sections
16, 17 , 18, 19 , 30 , and 31 , Township 5 North, Range 62 West of the
6th P.M. , Weld County, Colorado, certain sections of which are
also included in Plowing Permits #89-3 and #89-3A, and
WHEREAS , pursuant to Ordinance #108-A, National Hog Farms
previously submitted proof of collateral in the form of a cashiers
check in the amount of $1 , 200 .00 and a certified check in the
amount of $3 ,600 .00 for a total amount of $4 ,800 . 00, and all other
pertinent documents necessary for the issuance of a Plowing
Permit, said collateral being sufficient for Plowing Permit #89-3,
Plowing Permit #89-3A, and Plowing Permit #89-3B, and
WHEREAS, National Hog Farms, Inc. , has also submitted the
required additional permit fee in the amount of $96 . 00 , and
WHEREAS, the Board deems it appropriate to approve the
issuance of an amended Plowing Permit to National Hog Farms, Inc. ,
for those grasslands described in the approved Soil Conservation
Plan, a copy of which is attached hereto and incorporated herein
by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that Amended Plowing
Permit No. 89-3B be, and hereby is, issued to National Hog Farms,
Inc.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Plowing Permit.

This Permit is issued pursuant to Ordinance No. 108-A adopted by o N
the Weld County Board of County Commissioners on March 11 , 1986,
and requiring the issuance of permits for the plowout and
cultivation of grassland (s) . Pursuant to said Ordinance, the
Permittee is required to follow a conservation plan approved by
the local Conversation District Board, must pay all applicable
fees pursuant to Ordinance 142 , and must submit collateral in an
amount as set by Ordinance 142. Said collateral must be approved
by the Board prior to the issuance of this Permit.

Note : A mixture of grasses is preferred over a single species . Ci.c. I season

improve the quality of the pasture and extend the period of active growth and

Dear Mr. Lacy:
This letter will serve as a formal reply to your letter to
Bill Haw dated June 10 , 1991 .
National Hog Farms intends to establish and have in operation
four new 120 acre center pivot systems on Sections 15 and 16
Township 6 Range 62 by or before July 15 , 1991 . In addition,
we intend to have established and in operation by or before
September 1 , 1991 , three new 170 acre pivot systems on
Sections 20 and 21 Township 6 Range 62 . These 990 additional
acres , as well as another 280 acres already under pivot
systems which require replanting, will be sown with a
rye/bromegrass combination and put to use during the Fall and
Winter of 1991 . The piping system for these new pivots will
be sized to allow for additional acreages in the future
should they become necessary.
I spoke with Wes Potter by telephone yesterday morning. In
addition to clarifying some communications procedures , we
spent quite some time discussing these matters . It is my
understanding that Mister Potter viewed these steps in a
positive manner.
National Hog Farms shares the Weld County Board of
Commissioners' commitment to promotion of agricultural
development as well as protection of the county's residents'
quality of life. We agree with Weld County Health that these
acreage additions are necessary and indicated by our
monitoring data. You have our assurance that if our data
indicate further modifications are necessary, we will make
such changes beyond those outlined in this letter.

This letter will serve as a follow-up to our June 26 meeting.
At this meeting, our discussion centered on three topics :
1 . You asked that I provide some projected nutrient application
rates after the new acreages come on stream. I have
provided these in tabular form along with 1990 and 1991
figures .
2 . We agreed that five new monitoring wells should be installed
as soon as possible. These will be located in Sections 15 ,
20 and 21 all in Township 5 North, Range 62 West .
3 . We also will include the site for Pivot 29 in our
application study already underway at Pivots 1 , 4, 16 and
20.
These new wells and further expansion of our monitoring program
will allow us to evaluate the system as we develop it further.
This intensified monitoring will give us the necessary
information to make whatever adjustments we deem necessary. I
will keep you posted on dates for well drilling and pivot
construction.

After our telephone conversation today, I wanted to reiterate
National Hog Farms' commitment to expand our disposal systems
further If our monitoring program indicates expansion is
necessary.
The 990 acre expansion going on now will decrease our application
rates one-third (from approximately nine inches per acre per year
to six Inches per acre per year) .
Wes, If you and I decide that our monitoring results Indicate
more land Is required, more land will be developed . I will be
talking to you in the next week to update you on development of
Pivots 23 through 29 .
