RE: APPROVE INTERGOVERNMENTAL AGREEMENT REGARDING CONSOLIDATION OF EVIDENCE
OPERATIONS AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
regarding consolidation of evidence operations between the City of Greeley and
the County of Weld, by and through the Board of County Commissioners, commencing
January 1, 1993, and ending December 31, 1993, with the further terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement regarding consolidation
of evidence operations between the City of Greeley and the County of Weld, by and
through the Board of County Commissioners, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 25th day of January, A.D. , 1993, nunc pro
tunc January 1, 1993.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT MADE THIS 22nd DAY OF December
19 92 , BETWEEN THE CITY OF GREELEY, COLORADO, A HOME RULE
MUNICIPALITY ORGANIZED UNDER THE LAWS OF THE STATE OF COLORADO
(HEREINAFTER KNOWN AS THE "CITY") , AND WELD COUNTY, A HOME-RULE
COUNTY ORGANIZED UNDER THE LAWS OF THE STATE OF COLORADO,
(HEREINAFTER KNOWN AS THE "COUNTY") .
WHEREAS, it is in the best interest of the people of the
City of Greeley and Weld County, to consolidate the evidence
operations of the Weld County Sheriff's Office and the Greeley
Police Department; and
WHEREAS , such consolidation would result in improved
handling of evidence; and
WHEREAS, such consolidation would be more fiscally effective
for both the City and County, it is therefore mutually agreed by
the City and County as follows:
1. This Agreement shall be effective January 1, 1993 , and
shall be renewable annually.
2 . The City agrees to receive, maintain, transfer and
release all properly packaged, documented, reported, and
submitted evidence or found property as defined by Greeley Police
Department directives from the Weld County Sheriff's Office
commencing January 1, 1993 , until the termination of this
Agreement. This Agreement does not include property seized by
the Weld County Sheriff pursuant to civil process, except in the
case of criminal asset seizure and forfeiture.
3 . Property or evidence designated as contraband will be
destroyed under audited City procedures with the approval of the
Weld County Sheriff, and non-contraband items not returned to
owners or otherwise legally claimed, shall be sold at auction or
released to the Sheriff's Office at the Sheriff's discretion.
Proceeds of all property for the Sheriff's Office cases shall be
forwarded to the Sheriff with full accounting reports.
4 . All records associated with evidence and chain of
custody for evidence or property submitted to the Greeley Police
Department by the Sheriff's Office shall be maintained by the
Greeley Police Department utilizing the existing Police
Department property/evidence storage system.
5 . The City agrees to receive all currently maintained
homicide evidence currently stored by the Weld County Sheriff's
Office, provided that the evidence is packaged and submitted
under Greeley Police Department processes and procedures. Any
other evidence or property which has been held by the Weld County
Sheriff's Office for more than three years shall be accepted by

the Greeley Police Department if it is properly submitted under
Greeley Police Department procedures and processes, provided that
the property has been screened by the Weld County Sheriff's
Office for release or destruction. This screening shall include
but not be limited to, statute of limitations considerations and
case disposition.
6. All evidence currently held by the Weld County Sheriff's
Office which is transferred to the Greeley Police Department
shall be submitted on a quarterly basis and shall include a
detailed inventory and chain of custody records of all
evidence/property being transferred.
7. Weld County Sheriff's Office agrees to adopt the Greeley
Police Department's written directives system governing the
packaging, documentation, recording, and submission of evidence
or found property to the Greeley Police Department' s
property/evidence unit. The Greeley Police Department shall
provide training to the Sheriff's personnel on said procedures.
8. Storage and dispersal of vehicles seized by the
Sheriff's Office shall be the responsibility of the Sheriff's
Office. However, indoor City facilities may be used to
temporarily store a vehicle for the purpose of processing the
vehicle for evidence under the existing directives, procedures
and processes of the Greeley Police Department.
9 . Automated evidence/property records shall be made
available to the Weld County Sheriff's Office by the Greeley
Police Department. All terminals, hardware, and line costs shall
be the sole responsibility of the Weld County Sheriff's Office.
Software maintenance and training of Sheriff's personnel shall be
provided by the City.
10. The City shall accept evidence from the Weld County
Sheriff's Office at all regular Greeley Police Department
reception sites.
11. In consideration for acceptance, processing, and
storage of County evidence/property by the Greeley Police
Department, the County agrees to pay the City the amount of
$25, 800. 00, payable on an annual basis.
12 . This Agreement may be terminated upon thirty-day
written notice by either party.
13 . In the event of termination or non-renewal of this
Agreement, the City shall work with the Weld County Sheriff's
Office personnel to relocate Sheriff's Office property or
evidence held by the Greeley Police Department. The City agrees
to purchase all Weld County Sheriff's Office terminals which have
been used for access to automated evidence records on a pro-
rated basis.

14 . Both the City and County shall maintain control over
its employees and personnel regarding the execution of this
Agreement. The employment rights of either City or County
personnel employees shall not be abridged.
15. Each party assumes legal responsibility for its
individual actions in the event of any litigation regarding
evidence or property by third parties.
16. Any complaint or dispute regarding this Agreement shall
be routed to the designated contract managers for both the City
and County for resolution. In the event they are unable to reach
a resolution of any complaint or dispute, the matter shall be
resolved by the Weld County Sheriff and the Greeley Chief of
Police.

RESOLUTION NO. 54 , 1992
A RESOLUTION ADOPTING AN INTERGOVERNMENTAL AGREEMENT WITH WELD
COUNTY FOR THE CONSOLIDATION OF EVIDENCE SERVICES BETWEEN THE
WELD COUNTY SHERIFF'S OFFICE AND THE GREELEY POLICE DEPARTMENT.
WHEREAS, it is in the best interest of the people of the
City of Greeley and Weld County to consolidate the evidence
operations of the Weld County Sheriff's Office and the Greeley
Police Department; and
WHEREAS , such consolidation would result in improved
handling of evidence; and
WHEREAS, such consolidation will result in less cost to both
the City and the County,
NOW THEREFORE, BE IT RESOLVED BY THE GREELEY CITY COUNCIL:
1. The Mayor of the City is hereby authorized to sign on
behalf of the City, the attached Intergovernmental Agreement
between the City of Greeley, Colorado and Weld County regarding
the consolidation of evidence operations.

Operations
Dear Rick:
Enclosed herein please find copies of the following:
A. The Intergovernmental Agreement for Consolidation of
Evidence Operations which was sent by your office to the
Weld County Sheriff ' s Office in December, 1992 .
B. A version of the Intergovernmental Agreement which I
wrote, using the terms and conditions set forth in your
original agreement. The only changes which I made were
to the introductory paragraph and paragraph 14 . I also
added paragraphs 17 - 19 .
Please review my version of the Intergovernmental Agreement and let
me know if it is acceptable to the City of Greeley. If so, I will
ask Sheriff Jordan to sign it and then place it on the agenda for
the Board of County Commissioners .
