ORDINANCE NO. 89-Z
IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS OF CERTAIN
SECTIONS, AND THE ADDITION OF CERTAIN SECTIONS TO ORDINANCE NO. 89, WELD COUNTY
ZONING ORDINANCE, AS CURRENTLY AMENDED, REVISING AND ADDING CERTAIN PROCEDURES,
TERMS, AND REQUIREMENTS
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE
OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of
Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is
vested with the authority of administering the affairs of Weld County, Colorado,
and
WHEREAS, the Board of County Commissioners has the power and authority
under the Weld County Home Rule Charter and State statute, including Article 28
of Title 30, CRS, to adopt zoning regulations for the unincorporated areas of the
County of Weld, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has
previously adopted Ordinance No. 89, Weld County Zoning Ordinance, establishing
a comprehensive revision of the zoning regulations and zoning maps for
unincorporated areas of the County of Weld, and has adopted amendments in
Ordinances No. 89-A through 89-Y, and
WHEREAS, said Ordinance No. 89, as amended, is in need of revision and
clarification with regard to procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of the
County of Weld, State of Colorado, that certain existing sections of said
Ordinance No. 89, as amended, are repealed and re-enacted, with amendments, and
the various sections are revised to read as follows:
Amend Section 36.2.3.9 to read:
36.2.3.9 OIL AND GAS PRODUCTION FACILITIES
Renumber existing Section 36.2.3.9 to 36.2.3. 10 with no change to text.
Amend Section 42.1 to read:
42. 1 Signs in the Estate, R-1, R-2, R-3, R-4, and R-5 Districts.

43. 1.1 After the effective date of this Ordinance no MOBILE HOME or
Accessory Dwelling Unit may be located or relocated in Weld
County except in accordance with Section 43 of this Ordinance,
including the issuance of any zoning permit which may be
required by that Section. Each MOBILE HOME located or
relocated in Weld County after the effective date of this
Section must have a BUILDING permit for a MOBILE HOME issued
pursuant to the Weld County Building Code Ordinance. An
application for any zoning or building permit for a MOBILE
HOME or Accessory Dwelling Unit required by Section 43 shall
include the following:
Amend Section 43.2 to read:
43.2 Mobile Homes and Accessory Dwelling Units Permitted in the A
District
MOBILE HOMES and Accessory Dwelling Units are allowed in the A
District for the following USES upon the issuance of the appropriate
zoning or BUILDING permits according to the following requirements:
Amend Section 43.2.3 to read:
Accessory Farm Use
Amend Section 43.2.3. 1 to read:
43.2.3.1 One MOBILE HOME or Accessory DWELLING UNIT may be permitted in
the A District as an ACCESSORY FARM USE upon a determination
by the Department of Planning Services that:
Amend Section 43.2.3.1.5 by deleting the word "Zoning" in the last sentence of
the text.
Add a new Section 43.2.3.1.6 to read:
43.2.3.1.6 The applicant must obtain a BUILDING permit for the MOBILE
HOME and comply with all installation standards of the Weld
County Building Code Ordinance.
Amend Section 43.2.3.2 by changing "43.2.3. 1.5" to "43.2.3. 1.6" and deleting the
word "such" in the text.
Amend Section 43.2.3.3 by changing the term "ACCESSORY USE" to "ACCESSORY FARM
USE".

Amend Section 43.2.5.2 to read:

43.2.5.1.6 are met, upon information contained in the
application, and upon independent evidence as may be available
or which the staff may reasonably require.

STRUCTURE in the A District may be permitted upon a
determination by the Department of Planning Services that:

Amend Section 43.2.7.5 to read:
43.2.7.5 The applicant must obtain a BUILDING permit for the MOBILE
HOME and comply with the installation standards of the Weld
County Building Code Ordinance.
Amend Section 43.2. 7.6 to read:
43.2. 7.6 The Department of Planning Services shall make its
determination in the issuance of a BUILDING permit for a
MOBILE HOME used as an accessory STRUCTURE on the basis of a
signed statement by the applicant that the conditions of
Sections 43.2. 7. 1 through 43.2. 7.5 are met, upon information
contained in the application, and upon independent evidence as
may be available or which the staff may reasonably require.

Renumber existing Section 43.2. 7.7 to 43.2.7.8 and amend to read:
43.2.7.8 All MOBILE HOMES used as accessory STRUCTURES are temporary.

STRUCTURE.
Amend Section 43.3.1 to read:

an ACCESSORY USE to the principal USE in certain C or I zone
districts, upon a determination by the Department of Planning
Services that:
Add new Section 43.3.1.4 to read:
43.3.1.4 The applicant must obtain a BUILDING permit for the MOBILE
HOME and comply with the installation standards of the Weld
County Building Code Ordinance.

43.3.1.4 are met, upon information contained in the
application, and upon independent evidence as may be available
or which the staff may reasonably require.
Amend Section 43.3.4 to read:
43.3.4 All MOBILE HOMES as ACCESSORY USES to the principal USE in
certain C or I zone districts are temporary. The MOBILE HOME
shall be removed from the property upon the cessation of the
USE of the MOBILE HOME as an ACCESSORY USE to the business,
commercial, or industrial activity.
Amend Section 46. 1. 1 to read:
46. 1. 1 After the effective date of this Ordinance no MANUFACTURED
HOME may be located or relocated in Weld County, except in
accordance with Section 46 of this Ordinance, including the
issuance of any zoning permit which may be required by that
Section. Each MANUFACTURED HOME located or relocated in Weld
County after the effective date of this Section must have a
BUILDING permit for a MANUFACTURED HOME issued pursuant to the
Weld County Building Code Ordinance. An application for any
zoning or building permit for a MANUFACTURED HOME required by
Section 46 shall include the following:
Amend Section 46.1. 1.9 to read:
46.1. 1.9 An application fee. Each request for a MANUFACTURED HOME
zoning or BUILDING permit shall be accompanied by the
appropriate fee.
Amend Section 46.2 to read:
46.2 Manufactured Homes Permitted in the A District
MANUFACTURED HOMES are allowed in the A District for the following
USES upon the issuance of the appropriate zoning or BUILDING permits
according to the following requirements:

BE IT FURTHER ORDAINED, that the effective date of this Ordinance shall be
in accordance with Article III, Section 3-14(2) , of the Weld County Home Rule
Charter, but further, that as of April 1, 1993, the failure to obtain a zoning
permit for mobile and manufactured homes and accessory dwelling units to be used
as accessory farm use, accessory structures, accessory offices, and accessory
uses in the certain Commercial and Industrial Zone Districts shall not be
considered a violation of this Ordinance.

BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided
to be unconstitutional, such decision shall not affect the validity of the
remaining portions hereof. The Board of County Commissioners hereby declares
that it would have enacted this Ordinance in each and every section, subsection,
paragraph, sentence, clause, and phrase thereof irrespective of the fact that
anyone or more sections, subsections, paragraphs, sentences, clauses, or phrases
might be declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 89-Z was, on motion duly made and
seconded, adopted by the following vote on the 28th day of June, A.D. , 1993.

I hereby certify that pursuant to notices dated April 28, 1993, and duly
published May 6, 1993, in the Windsor Beacon, a public hearing was
conducted to consider amendments to the Weld County Building Code
Ordinance, Ordinance No. 119-L, and the Weld County Zoning Ordinance,
Ordinance No. 89-Z. Bruce Barker, County Attorney, made both a matter of
record. Mr. Barker read Ordinances No. 119-L and 89-Z into the record.
There was no public testimony offered. Commissioner Webster moved to
approve Ordinance No. 119-L on first reading, based upon the
recommendations of the Planning Commission. The motion, seconded by
Commissioner Kirkmeyer, carried unanimously. Commissioner Kirkmeyer moved
to approve Ordinance No. 89-Z on first reading, based upon the
recommendation of the Planning Commission. The motion, which was seconded
by Commissioner Baxter, carried unanimously.

determination on the basis of a signed statement by the
applicant that the conditions of Sections 46.2.5.1.1 through
46.2.5.1.6 are met, upon information contained in the
application, and upon independent evidence as may be available
or which the staff may reasonably require.

all installation standards of the Weld County Building Code
Ordinance. Electricity is the only utility which is permitted
to be connected to the MANUFACTURED HOME.

NOTICE OF PUBLIC HEARING
The Weld County Planning Commission will conduct a public hearing on Thursday,
April 20, 1993, at 1:30 p.m. in the County Commissioners Hearing Room (#101) ,
First Floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado,
for the purpose of considering amending Sections 36, 42, 43, and 46 of the Weld
County Zoning Ordinance.
The Proposed Amendments will establish requirements for oil and gas production
facilities and signs in the Estate zone district and delete the requirements for
staff-issued zoning permits for mobile and manufactured homes to be used as
accessory farm use, accessory structures, accessory offices, and accessory uses
in the Commercial and Industrial zone districts.
All persons in any manner interested are requested to attend the hearing and may
be heard.

The Department of Planning Services recommends that the proposed amendments be
approved for the following reasons;
1. The existing Zoning Ordinance is in need of revision. The proposed
amendments will establish requirements for oil and gas production
facilities and signs in the Estate zone district and delete the
requirements for staff-issued zoning permits for mobile and manufactured
homes to be used as accessory farm use, accessory structures, accessory
offices, and accessory uses in the Commercial and Industrial zone
districts.
2. The proposed sections will be consistent with the future goals and needs
of the County as set out in the Weld County Comprehensive Plan.
3. The proposed amendments will be consistent with the overall intent of the
Weld County Zoning Ordinance.
