RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1058 FOR
AN 1,800 SQUARE FOOT POLE BARN TO BE USED FOR STORAGE AND AUTOMOBILE
RESTORATION IN THE A (AGRICULTURAL) ZONE DISTRICT - DANNIE MILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 7th
day of September, 1994, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of Dannie Miller, 1473 10th Street,
Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review
Permit #1058 for an 1,800 square foot pole barn to be used for storage and
automobile restoration in the A (Agricultural) Zone District on the following
described real estate, to-wit:
Lots 3 through 12 and Lots 18 through 27,
Block 3, Hardin, Weld County, Colorado
WHEREAS, Dannie Miller, said applicant, and Julie Hoskins, Attorney, were
present, and
WHEREAS, Section 24. 4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. This proposal is consistent with the Weld County Comprehensive
Plan's Agricultural Goals and Policies. No prime agricultural
ground will be taken out of production for the proposed use.
b. This proposal is consistent with the intent of the
A (Agricultural) Zone District and is provided for as a Use by
Special Review.
c. The uses permitted will be compatible with existing
surrounding land-uses and with the future development of the
surrounding area as permitted by the Agricultural Zone
District. Surrounding land-uses include agricultural
production, pasture, and rural residences.

d. The site lies within the Flood Hazard Overly District. The
overlay District is addressed within the Development
Standards.
e. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Dannie Miller for a Site Specific
Development Plan and Special Review Permit #1058 for an 1,800 square foot pole
barn to be used for storage and automobile restoration in the A (Agricultural)
Zone District on the hereinabove described parcel of land be, and hereby is,
granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 7th day of September, A.D. , 1994.

1. The Site Specific Development Plan and Special Review Permit is for an
1,800 square foot pole barn used for storage and automobile restoration in
the A (Agricultural) Zone District as submitted in the application
materials on file and subject to the Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
6. Fugitive dust shall be controlled on this site.
7. All potentially hazardous chemicals shall be stored and handled in a safe
manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules
and Regulations thereof.
8. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
9. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
10. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
11. Should any new building construction occur within the Flood Hazard Overly
District, a Flood Hazard Development Permit shall be required as in
accordance with Section 53 of the Weld County Zoning Ordinance.
12. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.

13. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
14. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on September 7, 1994, at 10:00 a.m. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 22, ].994, and duly
published August 25, 1994, in the Windsor Beacon, a public hearing was
conducted to consider the request of Dannie Miller for an 1,800 square
foot pole barn to be used for storage and automobile restoration in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney,
made this a matter of record. Todd Hodges, Planning Department
representative, entered the favorable recommendation of the Planning
Commission into the record as written. Mr. Hodges stated he had received
new information since the Planning Commission Hearing and recommended that
reason #2d should read as follows: "The site lies within the Flood Hazard
Overly District. The overlay District is addressed within the Development
Standards. "; and Development Standard #11 should be added as follows:
"Should any new building construction occur within the Flood Hazard
Overlay District, a Flood Hazard Development Permit shall be required as
in accordance with Section 53 of the Weld County Zoning Ordinance. "
Dannie Miller, applicant, and Julie Hoskins, Attorney, were present. Mr.
Miller confirmed that he understood the change, and he would obtain flood
hazard permits for any new buildings. Mr. Hodges confirmed that only the
new construction would require a permit and the existing building already
has a permit. Norma Miller, next-door neighbor, said Mr. Miller's
operation does not bother anybody at all and everything is fine.
Commissioner Hall moved to approve the request of Dannie Miller for an
1,800 square foot pole barn to be used for storage and automobile
restoration in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with
the Conditions of Approval and Development Standards as entered into the
record, including the abovementioned changes to reason #2d and the
addition of a new Development Standard #11, with the remaining to be
renumbered consecutively. The motion was seconded by Commissioner
Kirkmeyer. Ms. Hoskins stated the applicant has provided proof of
ownership of the trailer and a bathroom facility; therefore, the septic
system should not be required for the pole barn. Mr. Hodges confirmed Ms.
Hoskins' statement and suggested Condition of Approval #2 be deleted.
Commissioner Hall agreed to amend his motion to delete Condition of
Approval #2, and Commissioner Kirkmeyer agreed. The motion then carried
unanimously.

Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th

August 16, 1994
A regular meeting of the Weld County Planning Commission was held August 16, 1994
in the County Commissioners' First Floor Hearing Room (0101) , Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado. The meeting was called
to order by the Chairman at 1:30 p.m.

Mark Geil, attorney for the applicant, stated that the 1,800 square foot pole
barn is already in place. It is used for personal belongings and restoring of
automobiles.
Curt Moore asked if there would be any flammable products being used on site.
Dannie Miller, applicant, stated it would be mostly mechanical work and if he
does use flammable products he will dispose of them properly.
The Chairman asked if anyone in the audience would like to speak for or against
the proposal. No one wished to speak.
The Chairman asked if the applicant had any concerns with the staff's
recommendation. Mr. Moore stated that they had a concern about Condition of
Approval #2 about a septic system. Trevor Jiricek stated that the application
showed no adequate facilities on the property. Mr. Miller stated that there was
a mobile home 100 to 150 feet from the pole barn under his ownership, which his
sister lives in and can be used for its septic facilites. Trevor stated if this
comment was correct that the Condition of Approval #2 would not be required.

Ron Sommer moved to amend Condition of Approval #2 to state: "If proof of
ownership of the trailer and a bathroom facility is found then a septic system
will not be required for the pole barn." Motion seconded by Marie Koolstra.
The Chairman asked the secretary to poll the members of the Planning Commission
for their decision. Richard Kimmel - yes; Curt Moore - yes; Shirley Camenisch -
yes, Marie Koolstra - yes; Ron Sommer - yes. Motion carried unanimously.

Vern Nelson, representative for the applicant, stated that this land is south and
west of the Town of Windsor. They would like to develop this land into 6 large
lots for rural living. Mr. Nelson stated that the area cannot be farmed
economically because it is in a natural drainageway and cannot be irrigated
because a ravine separates this land. Domestic water will be Little Thompson and
sewer will be by individual septic systems. Mr. Nelson stated they had reviewed
the Planning staff's recommendation and found no conflicts.
Ron Sommer asked if there would be covenants. Vern Nelson stated yes, similar
to Windsong. Mr. Nelson then handed out a map to clarify the location of this
proposal. Marie Koolstra asked if there would be a problem with the natural
drainage and the septic systems. Mr. Nelson stated the septic systems would be
away from the drainageway.
The Chairman asked if anyone in the audience would like to speak for or against
the proposal.
Judy Hartshorn, surrounding property owner, stated that there is a problem with
water in this area, since her basement floods every year. Weld County Road 60
was closed when the water washed out the road this year. Mrs. Hartshorn asked
the Planning Commission members to look closely at applications and to please
save farmland.
Ron Sommer moved that Case Number Z-490 for a Change of Zone from A
(Agricultural) to E (Estate) be forwarded to the Board of County Commissioners
with the Planning Commissions' recommendation for approval. Motion seconded by

I . A detailed description of the proposed operation and use.
Mr. Dannie Miller intends to use his pole-barn primarily for
storage of personal belongings such as car parts and household
furniture. Mr. Miller needs the enclosed space provided by the
pole-barn to store and protect his belongings. Additionally, Mr.
Miller will use the pole-barn to restore automobiles.
The existing uses on the surrounding properties and the
distance of the pole-barn to surrounding property residential
structures are as follows:
1) North of subject property- residential trailer home with
small shed; farm animals (ie. , pigs, geese, ducks and chickens. . . )
are kept and raised on the property; distance of pole-barn to
trailer home is approximately 250 feet. Mr. Miller's cousin, Norma
Miller, owns this property.
2) West of subject property- pasture land; no visible
structures.
3) East of subject property- pasture land; no visible
structures.
4) South of subject property- residential trailer homes, one
frame house; use is residential; distance of pole-barn to
residential structures ranges from approximately 450 feet to 1000+
feet.
Mr. Dannie Miller will be the only user of the pole-barn.
There is no water source. The access route is a driveway that
leads from the pole-barn to a dirt road that connects with Weld
County Road #67. There will be no waste associated with Mr.
Miller's proposed use of the pole-barn, other than occasional
paper/plastic packaging materials (e.g. , spark plug boxes etc. ) ,
therefore, no sewage facility is needed. Mr. Miller's current
trash service will be able to handle this minimal increase in
trash. As for fire protection measures, Mr. Miller plans to attach
a fire extinguisher inside his pole-barn after his application has
been reviewed. Mr. Miller has not landscaped the area surrounding
his pole-barn and he does not intend to do so in the future.
Finally, animals are not part of Mr. Miller's proposed use of the
pole-barn.

Upon the cessation of the Use by Special Review, Mr. Miller
will remove the pole-barn or size it down to the size permitted by
regulation. Mr. Miller intends to start his proposed use once
approval has been granted by the Weld County Planning Commission.
II. Supporting Statements.
1 . Consistency with Weld County Comprehensive Plan.
Mr. Miller's proposed use of his land, the pole-barn for
storage, is consistent with the intent of the Weld County
Comprehensive Plan for the area. The four main elements of the
Weld County Comprehensive Plan as they relate to Mr. Miller's
proposed use of his land are: 1) Maintaining the land's
agricultural character and use; 2) Identifying the previous use of
the land and how the proposed change in use might effect the land;
3) How the proposed use is consistent with the area's future
development; 4) The environmental impact of the proposed use.
1) The subject land is zoned agricultural. A pole-barn
naturally fits in with agriculturally zoned land because barns are
consistent with farming operations and promote agricultural use.
The agricultural character of the area will not be adversely
effected by the presence of the pole-barn. Neither the pole-barn
nor its use will cause changes to the area that concerned Colorado
Supreme Court Justice Douglas when speaking about the need to
preserve agricultural communities. see, Borass v Village of Belle
Terre. There is no noise pollution associated with the proposed
use and the pole-barn will not increase traffic or increase the
number of people to the area.
2) Prior to the construction of the pole-barn, the only
structure on the subject property was a trailer home. Mr. Miller's
cousin, Norma Miller who owns the adjacent northern property, lives
in the trailer home. The property has not been used in any other
manner since Mr. Miller purchased the property in 1979.
The erection of the pole-barn most likely will not
diminish potential farming land (ie. , raising animals or plant
farming) because it appears that the subject land had not been used
in that capacity in recent history. As stated above, Mr. Miller
has never used the land for farming. Likewise, the previous
owners, the Baca's who purchased the land in the 1940's, apparently
did not use the land for farming. No farming operation was in
existence at the time Mr. Miller purchased the property. Thus, the
subject land apparently is not prime agricultural land since it has
not been used in that capacity in the past.

3) The pole-barn is also consistent with the future
land use of the area in that the area land will maintain its
agricultural zoning classification and barns, as stated before,
promote agricultural use.
4) Finally, the pole-barn only exceeds the allowable
square foot area for a building by 300 sq/ft (see, Weld County
Zoning Ordinance #31. 3) . Mr. Miller's pole-barn is 1800 sq/ft ( 30
feet by 60 feet) and the zoning regulations permit a 1500 sq/ft
building. Consequently, any additional burden the extra size of
Mr. Miller's pole-barn places on the land is minimal since over 3/4
of the barn would have been permissible by regulation. Thus, the
environmental impact on the subject land will be slight.
2. Consistency with intent of district.
The proposed use is consistent with the intent of the
district. The subject land is in the Greeley District. Mike Shay,
an employee of West Greeley Soil Conservation District and a member
of the district board, told me in conversation that Mr. Miller's
proposed use was consistent with the district's intent. The fact
that Mr. Miller's pole-barn exceeds the legal size for a building
structure in Weld County by 300 sq/ft did not concern Mr. Shay. If
the commission needs further confirmation of this statement, please
contact Mike Shay at #356-6506 .
3 . Location decision.
Mr. Miller choose a location that was near the road that
accesses the property so as to shorten the connecting driveway to
the pole-barn.
4. Health, safety and welfare considerations.
The pole-barn should not pose any health, safety or welfare
problems to the area since Mr. Miller only intends to use the barn
for storage of personal belongings.
5. Flood plain, geological hazard and overlay considerations.
The pole-barn is not in a flood plain, geological hazard or
overlay area. For additional confirmation, please contact Freese
Engineering, Jay Freeze at #352-0100.
6 . Noise considerations.
The proposed storage use of the pole-barn will not cause any
noise problems.

district on a parcel of land described as Lots 3 through 12 and
18 through 27, Block 3, Hardin, Weld County, Colorado.
Dear Mr. Miller:
Your application and related materials for the request described above are
complete and in order at the present time. I have scheduled a meeting with
the Weld County Planning Commission for August 16, 1994, at 1:30 p.m. This
meeting will take place in the County Commissioners' Hearing Room, first
floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado.
It is recommended that you and/or a representative be in attendance to
answer any questions the Planning Commission members might have with
respect to your application.
Sometime prior to August 5, 1994, a representative from the Department of
Planning Services will be out to the property to post a sign adjacent to
and visible from a publicly maintained road right-of-way which identifies
the hearing time, date, and location. In the event the property under
' consideration is not adjacent to a publicly maintained road right-of-way,
one sign will be posted in the most prominent place on the property and
post a second sign at the point at which the driveway (access drive)
intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation
concerning this application to the Weld County Planning Commission. This
recommendation will be available twenty-four (24) hours before the
scheduled hearing. It is the responsibility of the applicant to call the
Department of Planning Services' office before the Planning Commission
hearing to make arrangements to obtain the recommendation.

conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal

2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. An individual sewage disposal system, is required for the proposed
facility and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
6. All potentially hazardous chemicals must be stored and handled in a safe
manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules
and Regulations thereof.
