Kirb County Attorney < Gord. 900227 COUNTY OF WELD, STATE OF COLORADO ROAD IMPROVEMENTS AND MAINTENANCE AGREEMENT THIS AGREEMENT, made and entered into this 7th day of March 1990, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called "County" and FRONTIER SAND AND GRAVEL, INC. , hereinafter called "Frontier". WHEREAS, Frontier has applied to the County for a Use by Special Review Permit for an open-cut gravel pit and concrete and asphalt batch plants located in parts of Section 4, Township 2 North, Range 68 West of the 6th Principal Meridian, and WHEREAS, said gravel pit and asphalt and concrete batch plants will generate increased truck traffic, and WHEREAS, the County road serving the property will not efficiently support the increased truck traffic, and WHEREAS, the County and Frontier have reviewed proposed improvements to the existing County roads and acknowledged they will enhance the accessibility and safety of the haul route to the above-mentioned gravel pit and asphalt and concrete batch plants. NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the County and Frontier mutually agree as follows: 1. The designated haul route to be improved will be Weld County Road 7 from the entrance to the gravel pit and batch plants south to State Highway 119. 2. The improvements will consist of a 3 inch thick, 24 foot wide hot bituminous asphalt mat and a total of 6 inches of aggregate base course with a 6 foot shoulder on Weld County Road 7. 3. Frontier will furnish the necessary base material, hot bituminous pavement, equipment and labor to construct the improvements. The County will reimburse Frontier for the cost of the AC-10 liquid asphalt required to manufacture the hot bituminous pavement. 5. Maintenance will consist of regular grading to keep the surface reasonably smooth and to control dust. Frontier is responsible for using materials and methods consistent with any federal, state, or local laws, rules, or regulations pertaining to hazardous materials, health or environmental protection. 6. Portions of road base in place at the time of improvement may be acceptable and incorporated into the base requirement at the option of the Weld County Engineering Department. 7. The County will inspect and replace any culverts that are in a deteriorated condition prior to paving. 8. All construction and materials shall be in accordance with the State Department of Highways, Division of Highways, State of Colorado, Standard Specifications for Road and Bridge Construction 1986. 9. The County will provide testing and inspection for the construction. 10. Frontier will be restricted to hauling exclusively south in direction on Weld County Road 7 from its intersection with the entrance of the gravel pit.
