APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
A Weld County septic permit is required for the proposed home and its
septic system shall be installed according to the Weld County Individual
Sewage Disposal System (ISDS) regulations.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The Recorded Exemption plat shall show a 50 foot right-of-way reservation
west from the centerline of Weld County Road 33.
Within 60 days of approval of this recorded exemption, the applicant shall
submit evidence to the Department of Planning Services' staff that the well
on the 10 acre parcel has been late registered for the existing uses on the
parcel.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for

RE: Three (3) Residences on Lot A of Recorded Exemption 1396 (located in Part NE4 of Section 34, T7N,
R66W, Weld County)
Dear Mr. Hoist,
The Department of Planning Services has reviewed and discussed your letter dated May 4, 2009 and has
determined that two (2) of the existing residences are considered non-conforming uses by the Weld
County Code. Per Section 23-7-30 of the Weld County Code, the definition and criteria for non-
conforming uses is as follows:
Where at the time of passage of this Chapter, or of passage of future amendments of this Chapter, a lawful
use of land exists which would not be permitted by the regulations imposed by this Chapter or future
amendment, the use may be continued so long as it remains otherwise lawful provided that the following
conditions are met:
A. Extension or expansion.
1. No such nonconforming use shall be enlarged or increased, nor extended to occupy a greater area of
land than was occupied at the effective date of adoption of the ordinance codified herein or amendment
of this Chapter without first having received a special review permit pursuant to the procedure
established in Article II, Division 4 of this Chapter.
2. A nonconforming USE shall not be extended or enlarged after adoption of the ordinance codified
herein or amendment of this Chapter by erection of additional SIGNS intended to be seen from off the
premises, or by the addition of other USES which would be prohibited in the zoning district involved.
3. No such nonconforming USE shall be moved in whole or in part to any portion of the LOT or
parcel other than that occupied by such USE at the effective date of adoption of the ordinance
codified herein or amendment of this Chapter.
Abandonment. If any such nonconforming USE of land ceases for any reason for a period of more
than six (6) months, any subsequent USE of such LOT or parcel shall conform to the regulations
specified by this Chapter for the zoning district in which such LOT or parcel is located.

The three (3) residences were constructed prior to adoption of the Weld County Code. While the
nonconforming situation of three (3) residences on a single parcel should have been documented at the
time that Recorded Exemption RE-1396 was processed in 1992, it does not change the fact that two of
the homes are nonconforming uses (assuming that they had not been abandoned since the recorded
exemption was approved as you had previously indicated).
Fortunately, there are county applications and procedures that would (if approved)grant you the ability to
make all three (3) residences conforming uses that could be rebuilt. A review of the layout of the site
appears to indicate that that the residences would be able to meet offsets to property lines should be
property be divided (the required offset in the Agricultural zone district is— 3 feet or 1 foot for every 3-feet
of building height, whichever is greater). Therefore, there are two options:
Option #1:
• Apply for a Two-Lot Recorded Exemption to divide Lot A of RE-1396 into two lots.
• Apply for a Subdivision Exemption in conjunction with the Two-Lot Recorded Exemption.
This is the preferred option. If this is approved, this would allow each residence to be located on
its own individual lot.
Option #2:
• Apply for a Two-Lot recorded exemption to divide Lot A of RE-1396 into two lots.
• Apply for a Use by Special Review Permit to allow two single-family residences on a single
parcel in conjunction with the Two-Lot Recorded Exemption. A Pre-Application Request
would be required prior to submitting the Use by Special Review Permit so that staff could
discuss of the Use by Special Review requirements and procedures with you.
If approved, this would allow one residence to be located on one lot and two of the remaining
residences to be located on the other lot. The Use by Special Review permit requires approval by
the Board of County Commissioners. Also keep in mind that there is a possibility that staff would
not recommend approval of this application. Under this scenario you would definitely need to
justify why you are choosing this option over option #1.

The subject property was approved for division on March 5, 1992. Records show
that there are no entries, notes, exceptions or stipulations that this property was
being used in a non conforming manner. This property was not approved for
division subject to. It was approved for the use that it was used for March 5, 1992.
Again it was not approved subject to a non conforming use. These homes have
been on this property for 100 years and there has been no change in use since the
approval for division on March 5, 1992. As owner of the subject property I am
requesting this property be shown as a legal property in its present use and not a
non conforming property.
As long as nonconforming is labeled on this property financing is not available
which keeps me from improving the property and I hate to think about what it
will do in case of sale. Exorbitant cost (there is a question if water taps are even
available) and location of homes makes division of this property not possible.

OWNER: Hattie Johnson Estate
We have had the farm for sale for over a year , and
need to get the farm sold in order to settle the
estate. The majority of the interest has been in
the farmland from neighboring farmers, but they have
no interest in the improvements .
We have entered into a purchase agreement to sell the
improvements subject to the approval of this
exemption . Also, the improvements are now all rental
units , and are a hardship to the estate with
reference to managing , upkeep , etc .
Your consideration to this exemption would be greatly
appreciated .
Item 5 . This proposal is consistent with the policies of the
Weld County Compreshensive Plan because:
(A ) No lot has been created by a recorded
exemption within the last 5 years
( B) The smaller parcel is non productive
agriculture land improved by 3 single
family residences as it has been for many
years .
( C ) The recorded exemption shall have access
from Weld Co. Rd. 33 on the east side
Item 6 . This proposal is consistent with the intent of the
Zone District which is agriculture .
Item 7 . The large parcel will be operated as an agriculture
farm unit as it has been used in the past . The small
parcel will be used as a rural residence .
Item 8. The uses permitted will be compatible with future
development, because there has been no lot split
within the last 5 years, and the land is surrounded
by irrig . agriculture land and rural residences . It
is unlikely that there would be any major future
development in the area other than those approved by
the planning and zoning regulations of Weld County.
The location of this property will not affect any
master plan of any municipality .

Dear Ms. Swanson:
We have reviewed the above referenced application to split a 10 acre lot from a 145 acre parcel.
The proposed water supply for the 10 acre lot is to be from an existing unregistered well. The plat
sketch shows 3 houses, a quonset building and a barn on the 10 acre lot. We have no objection
to approval if the applicant can demonstrate that well that serves the 10 acre lot was constructed
and put to use prior to May 8, 1972, and well use has been for ordinary household purposes inside
no more than 3 single family dwellings, the watering of domestic animals and irrigation of not more
than 1 acre of home lawn and garden. We recommend that the well be late registered to protect
the interest of the well owner.
The North Weld County Water District has indicated they can make water service available
for the larger lot. We recommend approval if the conditions related to the existing well can be met.
