RE: SUBMITTING TO THE REGISTERED ELECTORS OF THE COUNTY OF WELD,
STATE OF COLORADO, AN AMENDMENT TO SECTION 4-2 (B) OF ARTICLE
IV OF THE HOME RULE CHARTER FOR WELD COUNTY CONCERNING UNION
RECOGNITION AND NEGOTIATION
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, pursuant to Section 17-3 of Article XVII of the Home
Rule Charter and Section 30-11-506 , C.R.S . , as amended, it is
required that this Board call an election to consider an amendment
to the Charter when presented with a petition proposing an
amendment, signed by at least 5% of the registered electors, and
WHEREAS, a petition for the amendment of Section 4-2 (B) of
Article IV of the Home Rule Charter for Weld County was submitted
during the regular Board of County Commissioners meeting of
January 8 , 1990, and
WHEREAS, Mary Ann Feuerstein, Clerk and Recorder of the
County of Weld, has reviewed said petition and found that the
petition is proper in form and contains sufficient signatures to
meet the requirements of Section 17-1- (1) (a) of the Home Rule
Charter for Weld County, and Section 30-11-506 , C.R.S. , as
amended, and
WHEREAS, the petitioners have submitted a question for
submittal to the electorate which reads as follows:
UNION RECOGNITION AND NEGOTIATION
Immediately upon adoption of this amendment, Section 4-2 (B) of the
Weld County Home Rule Charter, which concerns the Division of
Personnel and personnel practices, shall be repealed and the
provisions thereof nullified; the Board of County Commissioners
shall recognize the Communications Workers of America (CWA) as the
sole and legal bargaining agent for all non-managerial employees
of Weld County government; the Weld County Board of Commissioners,
or their designees, shall, within sixty (60) days of passage of
this amendment and every three years thereafter, enter into good
faith contractual negotiations with CWA with regards to wages,
benefits , and working conditions; and, in the event that an
impasse is reached in any contract negotiations with CWA, CWA' s
final bargaining offer shall be submitted to the voters of Weld
County for their approval in a special election to be held within
sixty (60) days of the date that an impasse is declared by either
party to contract negotiations in a written statement to the Weld
County Clerk and Recorder.

WHEREAS , publication of notice and the text of the proposed
election is required within 30 days of initiation or by February
7, 1990 , and
WHEREAS, an election must be held within not less than 30
days or more than 120 days of publication of notice and the
general election is set more than 120 days after the latest date
for publication.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that:
1 . A special election is called to be held on March 20,
1990 , at which there shall be submitted to the
registered electors of the County of Weld, State of
Colorado, for their consideration of approval the
following amendment to Section 4-2 (B) , Article IV of the
Home Rule Charter for Weld County:
"Immediately upon adoption of this amendment, Section
4-2 (B) of the Weld County Home Rule Charter, which
concerns the Division of Personnel and personnel
practices, shall be repealed and the provisions thereof

2 . Each elector voting at said election and desirous of
voting for or against said amendment shall cast his or
her vote as provided by law either "Yes" or "No" on the
proposition set forth in Paragraph 1 of this Resolution.
3 . That notice of the election and publication of the
proposed amendment shall occur prior to February 7 ,
1990 , in The New News.

The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of
January, A.D. , 1990 .

NOTICE OF SPECIAL ELECTION
In accordance with the Resolution by the Board of County Commissioners
of Weld County, Colorado, and pursuant to Section 30-11-506, C.R.S. , as
amended, and Section 17-1 (3) of Article XVII of the Home Rule Charter, a
special election is hereby called and shall be held on Tuesday, March 20,
1990.
At such special election:
(a) Voters shall cast ballots for or against the approval of the
following amendment to Section 4-2(B) , Article IV of the Home Rule
Charter for Weld County, Colorado:
