NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1624 submitted by Margaret Nelson be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for the proposed home, and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation has been completed by the Weld County Health Department on all existing septic systems. 3. The ISDS permit shall be finalized and approved by and Environmental Protection Specialist within one (1) year of the application date. 4. The applicant shall add no new access to either Lot A or Lot B. The existing common access on the Northern border of Lot A shall also provide access to Lot B. The applicant shall grant similar easements across such access for the benefit of both Lot A and Lot B. Dear Commissioners: This request for a recorded exemption is submitted by Margaret Nelson. The parcel of land on which this request is being made is described as Lot A of RE- 206, being a part of the NW4 of Section 32, T7N, R65W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1/4 mile south of Weld County Road 76 and east of and adjacent to Weld County Road 39. This request is to divide a 100-acre parcel into two parcels of 82 acres and 18 acres, more or less. There is an existing dwelling and out buildings on proposed Lot A, proposed Lot B is currently in irrigated farmland. The applicant has indicated in the application materials that she intends to deed a family member proposed Lot A and sell proposed Lot B. North Weld County Water District currently provides proposed Lot A with water and is proposed for Lot B. A septic system currently provides Lot A with sewage disposal and is proposed for Lot B. The Town of Eaton has reviewed this request and finds no conflicts with it/s interests. The Weld County Health Department and Public Works Department have reviewed this request and both recommend conditional approval. The Department of Planning Services' staff has concerns that the proposed division will be inconsistent with efficient and orderly development and the agricultural goals and policies as stated in the Weld County Comprehensive Plan. Staff also has concerns with the number of recorded exemptions that have occurred in Section 32, T7N, R65W of the 6th P.M. , Weld County, Colorado. Eight recorded exemptions have been approved in Section 32 since 1975. The parcel under consideration was created in 1979 by RE-206 to correct an illegal land split. The lot is predominantly identified as prime farm ground of National Importance by the Department of Agriculture Soil Conservation Service and Colorado State 94C699 Board of County Commissioners - RE-1624 July 19, 1994 Page 2 University Test Station. This request, if approved, would allow for a residence on proposed Lot B, further intensifying the residential uses on the property and potentially reduce prime agricultural farm ground. The Comprehensive Plan promotes preserving the agricultural use of prime agricultural ground. When the Nelsons purchased the property in ', $ ,;f' 1973 it was their intent that Parcel B would remain under the ownership 1 of Ronald L. and Betty J. Pappenheim, who were the original owners of }. the the entire re parcel. At that time, and since that time, both the Nelsons tr l' ' and ppenheims have been under the assumption that the Pappenheims , actually owned Parcel B. This fact is evident by observing the parcel r `• it1 in question. Mr. Nelson has not farmed Parcel B since 1973, rather assuming that it was owned by the Pappenheims. The error which occurred . ° was not discovered until Pappenheims transferred Parcel B to a third party, who then applied for a building permit on the parcel. At that property which time, through title research, it was discovered that the Pa were not actually, or legally, the owners of the Pappenheims they i had transferred. It was also discovered at that time that a building r permit could not be issued on the parcel until such time as Parcel B 4 , had been legally divided from the larger 105 acre parcel by meeting the requirements of the Weld County Subdivision Regulations.
