It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Regulations as defined in Section 1-3. 2. The Board feels this division would be inconsistent with efficient and orderly development. 3. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. 4. It is the opinion of the Board that any further division of these lots will create additional accesses onto State Highway 392 and will increase the density of the existing linear subdivision. 5. The Board feels this proposal increases the need for more urban-type services in the area. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption No. 1467, submitted by Richard Schlagel be, and hereby is, denied. GREELEY, N. ORAAVENUEO631 COLORADO 80631 COLORADO February 17, 1993 Board of County Commissioners Weld County Centennial Center 915 Tenth Street Greeley, CO 80631 Subject: Recorded Exemptions 1467 and 1468 Dear Commissioners: These requests for recorded exemptions are submitted by Richard Schlagel. The parcels of land are described as the east half of the southeast quarter and the west half of the southeast quarter of Section 18, T6N, R66W of the 6th P.M. , Weld County, Colorado. The properties are located north of Highway 392, west of Weld County Road 27. The requests are to divided two 80-acre parcels into 72 acres and 8 acres, more or less, and 70 acres and 10 acres, more or less. The proposed smaller lot of Recorded Exemption 1468 contains a residence. The residence is served by North Weld County Water District and a septic system. The proposed larger lot is in agricultural production and is proposed to be served by North Weld County Water District and a septic system. Both proposed lots of Recorded Exemption 1467 expect to use North Weld County Water District and a septic system. The City of Greeley and the Towns of Windsor and Severance have no conflicts with this proposal. The staff has concerns that the proposed divisions will be inconsistent with efficient and orderly development. As shown on the attached aerial photographs, the level of development in this area and the potential for continued divisions may evade the intent of the Weld County Subdivision Ordinance. Two subdivision exemptions and one recorded exemption have been approved on the property immediately adjacent to the west. Each of the three lots contains a dwelling. The continuation of development along this highway is creating a linear subdivision which is inconsistent with efficient and orderly development. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, police and fire protection and school busing. The service demands increase as the density is increased. 930173 Board of County Commissioners Recorded Exemptions 1467 and 1468 Richard Schlagel Page 2 The staff requests that the Board of County Commissioners consider these applications and determine if the standards of Section 11.5 and 11.8 of the Weld County Subdivision Ordinance have been met. Very truly yours, Lanell J. Adler Current Planner CONDITIONS OF APPROVAL RE-1467 AND 1468 Richard Schlagel 1. Owner: Richard Schlegel Requirement No. 4 : The reason for dividing this parcel into two lots is because the 8 acre parcel located in the Southwest 1/4 corner of the subject property is of little economic value from a farming stand point. The existing terrain and ditch system makes it very hard to irrigate. Requirement No. 5: This proposal is consistent with the policies of the Weld County Comprehensive Plan due to the following factors: (1) The 8 acre parcel is of little use as a part of this farm. This parcel has an existing access from Hwy 392 as does the remaining 72 acre parcel . Requirement No. 6: This proposal is consistent with the intent of the Zone District which is agricultural. Requirement No. 7 & 8 : The intended use of the property will be rural residence and agricultural. Requirement No. 9 : This proposal is not inconsistent with efficient and orderly development. Requirement No. 10: There is an existing North Weld Water tap along Hwy 392 which can be tapped into. The sewage disposal will be controlled with a septic system. Requirement No. 11: To my knowledge this property is not located in a flood plain or in the Weld County Airport Overlay District. Ms. Lanell Swanson V Dept. of Planning Services JAN 2 1 1993 Weld County11 1400 N. 17th Ave. I Greeley CO 80631 'VW rnum,Planning, We have reviewed the two Richard Schlegel applications for Recorded Exemptions. (East parcel lies north of SH 392 approximately 100+, west of Weld County Road 27 . West parcel lies north of SH 392 approximately . 25 miles west of Weld County Rd 27 coming from Bracewell. The two properties share a common north-south boundary. ) The original diagram as submitted for the east parcel shall be revised to indicate exclusion of the two parallel strips of land lying adjacent to WCR 27 as indicated by the attached aerial view of the section. This review is based upon this change and verbal information you provided stating that the two existing accesses shown along WCR 27 cannot be used for this parcel . We have the following comments: 1. Projected traffic on SH 392 indicates the need for a 150-foot total right of way, 75 feet each side of the highway centerline. ROW width is not indicated on the applications. If additional width is required to meet the projected need, this width should be protected by reservation or, preferably, dedication, as permitted by County regulations. The highway centerline and the section line are the same along this property. 2 . The site plan for the east parcel as revised (attached) shows two existing accesses along SH 392 entering Lot A, and no existing accesses entering Lot B. The site plan for the west parcel shows one existing access entering Lot A, and one entering Lot B. Use of these four accesses as they exist may continue at this time, with no others permitted in accordance with the State Highway Access Code since it appears that there is no immediate change of use of these properties. At such time as use does change all will be reevaluated in accordance with the definition of a Category 3 highway and Section 2 . 10 - Use of Access. For the present time the two contiguous portions identified as Lot B of the east property and Lot B of the west property shal gib, , e RICHARD SCHLAGEL Schlagel Application January 15, 1993 Recorded Exemptions ( 2 ) Page Two served by the existing access near the east property line of the west-most parcel. Our comments on state highway access are based on the information presented for these two contiguous properties only. If the owner has any interests or ownership in other adjacent property along the highway, this information should be provided since it may affect our comments. 3 . As Lot A of the west parcel may invite future construction be advised that prior to any such utility work, Mr. Henry Rangel of this office should be contacted at 350-2111 regarding the need for a Utility Permit. Weld County U 1400 N. 17th Ave. IV FEB 0 9 1993 Greeley CO 80631 ML .. ... a rt+9n ra•14A^ Dear Lanell, This second review of the Schlagel Exemptions is based upon your request dated February 4, 1993 . Access to the property is re-evaluated based upon continued access from the County Road to the east. We have the following additional comments regarding access: All accesses to the property may continue as they exist. At such time in the future as development of lots occurs, a re- evaluation of access will be required. Access will then be dependant upon boundaries of new ownership and property use. The current owner requests subdivision in order to establish Lot A in the W 1/2 of the SE 1/4 due to the difficulty in irrigating this portion of land. If that property is used for another purpose in the future, reconstruction or relocation of the access in that corner may be necessary. This will require an access permit. It appears that access to the storage tanks in the NW corner of the property is currently being made through the west- most driveway. Future access to these tanks shall be coordinated upon sale of these lots in order that an additional access point is not necessary. The Colorado Department of Transportation will not allow any additional access. These additional comments are based upon verbal information given regarding the allowance for the owner to continue to cross 930172: Page 2 of 2 Re-evaluation - Schlagel the USA property to the east.
