RE: EXCHANGE OF CONTROL AND MAINTENANCE OF ROADWAYS WITH THE STATE OF COLORADO
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado Statute and Weld County Home Rule Charter, is vested with
the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to the provisions of § 43-2-101(4) (a), C.R.S. , the State
of Colorado has controlled and maintained a roadway known as State Highway 392
from State Highway 37 easterly and northeasterly to the town of Briggsdale,
Colorado, at its intersection with State Highway 14, and
WHEREAS, pursuant to the provisions of § 43-2-109, C.R.S. , Weld County,
Colorado, has controlled and maintained a roadway known as Weld County Road 49
from U.S. Highway 34 south to Interstate Highway 76 in Weld County, and
WHEREAS, the State of Colorado now desires to remove the above-described
portion of State Highway 392 from its highway system and to transfer control and
maintenance of said stretch of roadway to Weld County, and
WHEREAS, Weld County now desires to remove the above-described portion of
Weld County Road 49 from its primary highway system and transfer control and
maintenance for said stretch of roadway to the State of Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the control and maintenance of Weld County Road 49, from
U.S. Highway 34 south to Interstate Highway 76 be, and hereby is, transferred to
the State of Colorado for its control and maintenance.
BE IT FURTHER RESOLVED by the Board of County Commissioners that the County
of Weld be, and hereby accepts control and maintenance of State Highway 392, from
State Highway 37 easterly and northeasterly to the town of Briggsdale, Colorado,
at its intersection with State Highway 14, upon abandonment by the Colorado State
Transportation Commission.
BE IT FURTHER RESOLVED by the Board of County Commissioners that the
Chairman's signature be, and hereby is, authorized on any documents necessary to
effectuate this exchange and that this exchange shall become effective upon
approval by the Colorado State Transportation Commission.

NOTICE OF HEARING
On Wednesday, January 20, 1993, the Board of County
Commissioners of Weld County, Colorado, will conduct a public
hearing to consider accepting control and maintenance
responsibilities from the State of Colorado for State Highway 392,
from State Highway 37 to Briggsdale (State Highway 14) . The Board
will also consider relinquishing control and maintenance
responsibilities to the State of Colorado for Weld County 49,
between U.S. Highway 34 and Interstate 76 . A public hearing on
this matter is set for 9 :00 a.m. in the first floor meeting room of
the Weld County Centennial Center Complex, 915 Tenth Street,
Greeley, Colorado. Those persons interested in providing public
testimony regarding this matter should attend the hearing.

Dear Mr. Barker:
In reading the draft resolution you have prepared, we have found the following
changes in order:
A) Paragraph 2 should be reworded to identify the beginning point on
S.H. 392 as the intersection with .S.H. 37, commencing easterly and
northeasterly to the junction with S.H. 14.
B) Paragraph 6 should be reworded to include the wording "Upon approval
by the Colorado State Transportation Commission. "
C) Paragraph 7 should be reworded to include "Upon abandonment by the
Colorado State Transportation Commission. "
This paragraph should also identify the beginning point as the junction
with S.H. 37 commencing easterly and northeasterly to the intersection
with S.H. 14.
We find all other elements in the draft resolution as acceptable.

recommendations.
