APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the standards
of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met.
This Recorded Exemption is approved with the following conditions in accordance with
information submitted in the application and the policies of the County.
A Weld County septic permit is required for any proposed home. The septic system shall
be installed according to the Weld County Individual Sewage Disposal System (ISDS)
regulations.
Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation
has been completed by the Weld County Health Department on all existing septic systems.
Individual Sewage Disposal System permits shall be finalized and approved by an
Environmental Protection Specialist within one (1) year of the application date.
' The following note shall be placed on the recorded exemption plat prior to recording:
A Flood Hazard Development Permit will be required for any new construction or
substantial improvement of existing structures in the Floodway or Floodprone Districts
located on the property.
The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared
in accordance with the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty (60) days from the date of approval
by the Department of Planning Services. The applicant shall be responsible for paying
the recordi fees.

AMENDED RECORDED EXEMPTION QUESTIONNAIRE:
1 . EXPLAIN THE REASON FOR THE PROPOSED RECORDED EXEMPTION AND
HOW EACH PROPOSED LOT WILL BE USED.
Proposed Lot A contains the existing residence at which
the applicant's father lives and proposed Lot B is the
existing farm ground owned by the applicant. The intent
of the proposed Amended Recorded Exemption is to adjust
the existing boundary lines by taking some of the existing
acreage from Lot B and adding it to Lot A. The uses for
the exchanged land will remain agricultural .
2. DESCRIBE THE LOCATION, SIZE AND PRESENT USE OF THE AREA
WHERE EACH NEW LOT WILL BE CREATED.
The proposed Amended Recorded Exemption contains
approximately 21 . 14 Acres, more or less , and is located
in the Northwest Quarter of the Southwest Quarter of Section
19, Township 4 North, Range 68 West of the 6th P.M. . The
proposed Amended Recorded Exemption is located in an area
that is predominantly agricultural .
3. EXPLAIN HOW THE PROPOSAL IS CONSISTENT WITH THE WELD
COUNTY COMPREHENSIVE PLAN AND ANY ADOPTED MUNICIPAL PLAN,
IF APPLICABLE.
The proposal is consistent with the Weld County Comprehensive
Plan in that it is an amendment to an existing recorded
exemption that originally and still does comply with said
comprehensive plan.
4. EXPLAIN HOW THE USES PERMITTED WILL BE COMPATIBLE WITH
EXISTING USES SURROUNDING THE PROPOSED RECORDED EXEMPTION.
No changes in land use are proposed. The surrounding land
uses consist of agriculture and large lot residential .
Lot A contains an existing residence and some of the
existing farm ground and Lot B will remain the balance of
the existing farm. These uses will be consistent and
compatible with the surrounding land uses.
5. EXPLAIN HOW THE PROPOSAL IS CONSISTENT WITH THE INTENT OF
THE ZONING DISTRICT IT IS LOCATED WITHIN.
This proposal is located within the Agricultural Zone
District . This district allows by right Agricultural and
Residential uses . The intent of the district is to preserve
and protect agricultural uses . This proposal is consistent
with the intent of the district in that agricultural uses
of the parcel will remain unchanged.
6. EXPLAIN HOW THE PROPOSAL IS CONSISTENT WITH EFFICIENT AND
ORDERLY DEVELOPMENT.

No new uses are proposed by this Amended Recorded Exemption.
Existing utilities will continue as they exist today. No
new impact to Weld County will occur.
7. EXPLAIN HOW ADEQUATE PROVISION FOR THE PROTECTION OF THE
HEALTH, SAFETY AND WELFARE OF THE INHABITANTS OF THE
NEIGHBORHOOD AND THE COUNTY WILL BE ACCOMPLISHED.
No changes are proposed by this Amended Recorded Exemption
and therefore no impact will occur to the existing
protections of the health, safety and welfare of the
neighborhood or the County.
AMENDED RECORDED EXEMPTION STANDARDS:
. The existing Little Thompson Water District water source
will remain in use for both lots of the proposed amended
recorded exemption.
. Septic system is currently in place for Lot A, and
is adequate to continue to provide service. Lot B will also
utilize a proposed septic system.
. Both lots A and B will continue to utilize their existing
access drives to Weld County Road No. 1 .
. The proposed amended recorded exemption is not located within
an airport overlay district, however, a portion of said
exemption does fall within the flood plain. Please see
attached map for the approximate location of said flood
plain.
. The minimum lot size for both lots is at least one acre in
size.
. Existing or future right of way will be dedicated or reserved
as required by the comprehensive plan.
. The amended recorded exemption is the total contiguous land
ownership.
. The proposed amended recorded exemption is not part of an
approved recorded exemption within the last five years .
. The proposed amended recorded exemption is not a part of
an approved subdivision or recorded subdivision plat or
unincorporated community.
. The proposed amended recorded exemption does not evade the
requirement and statements of the purpose of the Weld County
Subdivision Ordinance.

On December 14, 1993, an evaluation of the existing individual septic disposal
system at 20294 Weld County Road 1, Berthoud, Colorado; Section 19, Township 04
North, Range 68 West, was conducted by Pam Smith.
The existing individual septic disposal system is not of sufficient size and
capacity to adequately handle the proposed load.
Therefore, be advised that you are recommended to have the following alteration
made to accommodate the proposed alterations to the structures(s) served:
The absorption field is undersized by 368 square feet or 34 percent
according to current regulations. A repair permit is required
before any alterations are made.
