Kirkmeyer Re: USR-1037 Dear Barbara, I'm writing to you to first of all to say thanks for all your help in reference to the USR- 1037, however, based on the continual resistance from the WELD COUNTY PLANNING DEPT., specifically Mr. Greg Thompson, we Permian Tank & Mfg. have decided to pull out of Colorado all together. It seems every time we have answered any and all objections to this USR-1037, we get a new set different from the first or the first isn't good enough. As a Weld Co. resident transferred in from Texas with the intention's of making this my new home and opening a new business capable of creating approximately 15 new jobs and tax revenues for Weld Co., I cannot believe the resistance met from the Planning Dept. I would like to point out just a few of the problem's encountered: 1)With the wheel's in motion and paper work in progress through our appointed atty. Mr. Tom Hellerich, which started with the first letter to the Planning commission on Sep.. 21,1993; we were issued a letter from Mr. Greg Thompson stating we were in noncompliance with the zoning and had five working days to contact him. I did via phone and was instructed to totally off the premises within five days. At this time, which the letter was dated Nov. 4, 1994 I decided to call the Commissioner's for help. That is when I first spoke to Ms. Barbara Kirkmeyer 11-5-93 on a Friday afternoon. I explained the situation to her and on Monday the 8th day of November she called and said not to worry, we could stay on the property. 2)Next was the topic of Adequate screening. What I would like answered and still trying to get answered is whom is determining what is ADEQUATE! In my opinion nothing is adequate till Mr. Greg Thompson decides it is. For example at the Commissioners hearing it was obvious Mr. Thompson expected us spend a fortune and surround our whole property with trees. "ADEQUATE SCREENING" COST PROHIBITIVE SCREENING around railroad tracks and oilfield gathering facilities for example. Thanks to the commissioners for agreeing with me on this issue. 3)Again ADEQUATE WATER SUPPLY-To be specific please submit information which demonstrates the on site well will supply an adequate amount of water. The State Engineer's eIl 940947 Cv raikiY` c ; !"L; )lLI Boer- eAcLM) PL0946 said what does he mean by this? I went to Mr. Thompson and asked what do you mean by ADEQUATE. He could not give me a answer. I informed him of what information I had received from the Engineer's. He said great, just get that to me in writing. I did. GUESS WHAT. The well now does not provide ADEQUATE WATER. What does the planning dept. want?, adequate supply which is 900 GPM or now adequate water. These are just a few examples of the problems encountered with many others. I just don't want it to go unnoticed of the disservice I feel the Planning Dept. is doing for Weld Co. I personally know of several other companies that are having the exact same problem. Permian Tank may be pulling out but how many other tax revenues are going to be lost because of the reputation of Weld Co's. Planning Dept. They set up business just outside the county line with a more aggressive county that is willing to help .You can take this for what it's worth. CC:W.H. Webster Dale K. Hall George E.
