RE: APPROVE INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF GREELEY FOR PAVING OF
20TH STREET FROM 59TH AVENUE TO 71ST AVENUE AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
for paving of 20th Street from 59th Avenue to 71st Avenue between the City of
Greeley and Weld County, Colorado, with the terms and conditions being as stated
in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for paving of 20th Street
from 59th Avenue to 71st Avenue between the City of Greeley and Weld County,
Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 1st day of March, A.D. , 1993.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT, made and entered into this 16th day of
February , 1993, by and between the COUNTY OF WELD, State
of Colorado, hereinafter called "County' , and the CITY OF GREELEY,
Colorado, hereinafter called "City".
WHEREAS, the City of Greeley Public Works Department and the
Weld County Department of Engineering jointly determine it to be in
the City's and County's best interest to cooperate in the paving of
20th Street between 59th Avenue and 71st Avenue.
WHEREAS, this section of roadway is jointly owned in portion
by the City of Greeley and Weld County.
WHEREAS, funding for the City's share of the project cost is
budgeted in the 1993 Food Tax budget, and the City is designing and
administering the entire project.
NOW, THEREFORE, in consideration of the mutual covenants and
conditions hereinafter set forth, the County and City mutually
agree as follows:
The City of Greeley will administer the design and
construction administration of the project. The County will
process payment to the City for the actual amount of their share of
the construction cost of the project estimated at approximately
$76,750.
IN WITNESS WHEREOF, the parties hereto have duly executed the
Agreement the day and year first-above written.

CITY OF GREELEY, COLORADO
Ordinance No. 5 , 1993
AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF GREELEY,
COLORADO, TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH WELD
COUNTY, COLORADO, FOR THE PAVING OF 20TH STREET FROM 59TH AVENUE TO
71ST AVENUE.
BE IT ORDAINED BY THE CITY COUNCIL OF GREELEY, COLORADO:
Section 1. The Greeley City Charter, Section 3-7, permits the
City Council, by ordinance, to enter into contracts and cooperative
or joint activities with other governmental bodies and that C.R.S. ,
29-1-201, gt seg. , articulates a state policy encouraging
governmental cooperation.
Section 2. An agreement has been reached between the City and
Weld County to have the City contract for the paving of 20th Street
between 59th Avenue and 71st Avenue. The County will pay for their
share of the construction cost based on that portion of
construction located outside the City limits. There are no
administrative or engineering costs involved.
Section 3. The City of Greeley desires to enter into such an
Intergovernmental Agreement for the purposes named in said
agreement.
Section 4. It is in the best interests of the City of Greeley
to enter into said Intergovernmental Agreement.
Section 5. The City of Greeley authorizes the Mayor to enter
into the Intergovernmental Agreement according to the terms of the
agreement described in Attachment "A" .
Section 6. This ordinance shall become effective five (5)
days after its final publication, as provided by the Greeley
Municipal Charter.
PASSED AND ADOPTED, SIGNED AND APPROVED this 16th day of
February , 1993.
