NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, acting as the Board of Equalization, that the evidence presented at the hearing clearly supported the value placed upon the Petitioner's property by the Weld County Assessor. Such evidence indicated the value was reasonable, equitable, and derived according to the methodologies, percentages, figures and formulas dictated to the Weld County Assessor by law. Board of Assessment Appeals: You have the right to appeal the County Board of Equalization's (CBOE's) decision to the Board of Assessment Appeals (BAA) . Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, CRS) Selecting the Arbitrator: In order to pursue arbitration, you must notify the OBOE of your intent. You and the OBOE select an arbitrator from the official list of qualified people. If you cannot agree on an arbitrator, the District Court of the county in which the property is located will make the selection. Arbitration Hearing Procedure: Arbitration hearings are held within sixty days from the date the arbitrator is selected. Both you and the OBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public, upon mutual agreement. The arbitrator's written decision must be delivered to both parties personally or by registered mail within ten (10) days of the hearing. Such decision is final and not subject to review. Fees and Expenses: The arbitrator's fees and expenses are agreed upon by you and the OBOE. In the case of residential real property, such fees and expenses cannot exceed $150.00 per case. Assessors comment regarding my protest of the 1994 assesses value of Junk/Salvage personal Property - he was following the law 'artd instructions of State Division of Property Taxation. I can not believe such state laws and instructions made the assessor increase my junk personal property 36% over the previous year along with all other such property in the State - that is exactly what his comments say. Therefore, please review the data in the attached letter before arriving at a decision. f" z / � r -A-F 1 a' !'. 5555 .940128 Vµ eR V a 1 wur D rrmerry A & A APPRAISAL COMPANY 28213 LOBROOK DRIVE RANCHO PALOS VERDES CA 90274(2131 544-2515 July 4, 1994 WELD COUNTY BOARD OF EQUALIZATION 915 10th Street - PO Box 758 Greeley, Colorado 80632 SUBJECT; appeal of 1994 Assessed Value of Personal Property, Holland #4, (now shut in) 1485A Leasehold Int., SW4SW44 34 12 57. Prior year value $9,133, current year assessed value $ 12,440 - an increase of $3,307. Either there has been an error in this assessment or the party making this assessment is unaware of the current market for salvage/junk oil and gas personal property in the immediate and general area of the subject. Since the decrease in oil price, coupled with additional and/or proposed operating requirements, there exist little to no market for such salvage as that of the subject. In the evaluation of market value of such personal Property there are three accepted approaches to value - 1) Market Data Approach, 2) Income Approach and 3) the Cost Approach. All of these approaches were considered. INCOME APPROACH - this property has not produced any income for the past 3 years. The only way it could produce income would be through rental and/or relocation for production and there exist no market for rental in place or after relocation - Therefore, this approach has no reliability or validity in the valuation of the subject. COST APPROACH - here again we have A problem with 940728 © this approach. The age and past utility of the property have placed this property in a category of Salvage/Junk. In evaluation of such property the big problem exist in finding out what is salvage and what is junk. These facts can only be found out after spending many many thousands of dollars - it would cost more than $10,000 to remove the down hole property and another $2,000 dollars to test it - plus, when removing equipment from down hole, you never know just how much can be removed and what problems will be encountered in the removal thereof. Therefore, no one in their right mind would attempt this approach in arriving at a market value of such personal property as that of the subject. MARKET DATA APPROACH - this is the best approach in valuation of such properly as that of the subject. The market reflects offerings of $3,000 to $7,000 for similar leases to be shut-in by the buyer. The $7,000 offers fall in the best locations and with equipment in field run condition. The $3,000 offers are for leases to be shut-in similar to the subject. In 1992 a leasehold interest, 1/2 mile south of the subject sold for $7,500 - however oil was selling for $21-22 per BBL and most of the equipment was superior to that of the subject - for example - the sale had two 300 BBL, welded, storage tanks whereas the subject has an old bolted, with leaks, 500 BBL tank; the sale had a 6X20' treater with good treater house and the subject has no treater nor treater house; the sale had a good FM engine where the subject has an old stripped MM with no radiator, no electrical system, cracked oil pan and head; both had a 228D Pumping unit but the subject is in poor condition with a bad saddle bearing.
