Box 1303 Boulder, Colorado 80306 Dear Mr. Hart: We have reviewed your request for Department of the Army authorization to place fill material, in 0. 012 acres of wetlands and 0.025 acres of waters of the United States for the construction of a low water crossing of the St. Vrain River located in Section 4 , Township 2 North, Range 68 West, Weld County, Colorado. Based on the information you provided, this office has determined that your work within Colorado can be authorized by the Department of the Army Nationwide Permit found at 33 CFR Part 330 Appendix A, (B) (14) . Enclosed is a fact sheet which fully describes this Nationwide Permit and lists the General and Section 404 only conditions which must be adhered to for this authorization to remain valid. In addition to the enclosed fact sheet, the following conditions must be met to remain in compliance with this Department of the Army Authorization. 1. That 0. 012 acres of wetlands will be created on the project site in accordance with the mitigation plan proposed by the applicant. 2 . That the mitigation wetlands will be monitored for a period of 5 years, or until the Corps of Engineers has determined them to be viable and self-sustaining. 3 . That annual reports documenting the progress of the wetlands will be submitted to the Tri-Lakes Project Office by 30 October of each year beginning in 1995. Although an Individual Department of the Army permit will not be required for the project, this does not eliminate the requirement that you obtain any other applicable federal, state or local permits as required. Please note that deviations from the original plans and specifications of your project could require additional authorization from this office. You are advised that this verification of the nationwide permit authorization is valid until July 18, 1996. Fish and Wildlife Service Colorado Department of Health Colorado Division of Wildlife Environmental Protection Agency O O Fact Sheet #14 33 CFR Section 330.6 Nationwide Permits (b) Authorized Activities: (14) Road crossing. Fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than 1/3 acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; c. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected high flows and tidal flows, and to prevent the restriction of low flows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the district engineer in accordance with the "Notification" general condition. The notification must also include a delineation of affected special aquatic sites, including wetlands. Some road fills may be eligible for an exemption from the need for a Section 404 permit altogether. Also, where local circumstances indicate the need, district engineers will define the term "expected high flows" for the purpose of establishing applicability of this nationwide permit. (Sections 10 and 404) (c) General Conditions: The following general conditions, where applicable, must be complied with for the Nationwide Permit authorization to remain valid: (1) Navigation. No activity may cause more than a minimal adverse effect on navigation. (2) Proper maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public safety. (3) Erosion and siltation controls. Appropriate erosion and siltation controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills must be permanently stabilized at the earliest practicable date. (4) Aquatic life movements. No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody, including those species which normally migrate through the area, unless the activity's primary purpose is to impound water. (5) Equipment. Heavy equipment working in wetlands must be placed on mats or other measures must be taken to minimize soil disturbance. (6) Regional and case-by-case conditions. The activity must comply with any regional conditions which may have been added by the division engineer and any case specific conditions added by the Corps. (7) Wild and Scenic Rivers. No activity may occur in a component of the National Wild and Scenic River System: or in a river officially designated by Congress as a "study river" for possible inclusion in the system, while the river is in an official study status. Information on Wild and Scenic Rivers may be obtained 0 0 from the National Park Service and the U. S. Forest Service. (8) Tribal Rights. No activity or its operation may impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights. (9) Water Quality Certification. In certain states, an individual state water quality certification must be obtained or waived. (10) Costal zone management. In certain states, an individual state coastal zone management consistency concurrence must be obtained or waived. (11) Endangered Species. No activity is authorized under any Nationwide Permit which is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. Non-federal permittees shall notify the district engineer if any listed species or critical habitat might be affected or is in the vicinity of the project and shall not begin work on the activity until notified by the district engineer that the requirements of the Endangered Species Act have been satisfied and that the activity is authorized. Information on the location of threatened and endangered species and their critical habitat can be obtained from the U.S. Fish and Wildlife Service and National Marine Fisheries Service. (12) Historic properties. No activity which may affect Historic properties listed, or eligible for listing, in the National Register of Historic.Places is authorized, until the district engineer has complied with the provisions of 33 CFR 325, appendix C. The prospective permittee must notify the district engineer if the authorized activity may affect any historic properties listed, determined to be eligible, or which the prospective permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shall not begin the activity until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence of historic resources can be obtained from the State Historical Preservation Office and the National Register of Historic Places. (13) Notification. (Not Applicable) O O SECTION 404 ONLY CONDITIONS In addition to the General Conditions, the following conditions apply only to activities that involve the discharge of dredged or fill material and must be followed in order for authorization by the nationwide permits to be valid: (1) Water Supply Intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake except where the discharge is for repair of the public water supply intake structures or adjacent bank stabilization. (2) Shellfish production. No discharge of dredged or fill material may occur in areas of concentrated shellfish production, unless the discharge is directly related to a shellfish harvesting activity authorized by nationwide permit 4. (3) Suitable material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash, debris, car bodies, etc.) and material discharged must be free from toxic pollutants in toxic amounts. (4) Mitigation. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the maximum extent practicable at the project site (i.e. on-site), unless the district engineer has approved a compensation mitigation plan for the specific regulated activity. (5) Spawning areas. Discharges in spawning areas during spawning seasons must be avoided to the maximum extent practicable. (6) Obstruction of high flows. To the maximum extent practicable, discharges must not permanently restrict or impede the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). (7) Adverse impacts from impoundments. If the discharge creates an impoundment of water, adverse impacts on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow shall be minimized to the maximum extent practicable. (8) Waterfowl breeding areas. Discharges into breeding areas for migratory waterfowl must be avoided to the maximum extent practicable. (9) Removal of temporary fills. The Service finds the report acceptable and agrees that the threatened species Spiranthes diluvialis (Ute ladies'-tresses orchid) habitat is not present within the subject area where the survey was performed. Thus, the Service concurs with Keammerer Ecological Consultants' determination that the proposed project should not adversely affect the continued existence of this orchid. The purpose of this letter is to discuss WMI's desire to construct a low water crossing of the St. Vrain River and to also install a conveyor across the river beginning this fall. WMI would like to know what approvals will be required from Weld County in order to construct the desired river crossings. For the past few years WMI has been mining sand and gravel from an area known as the Hamm pit which is a 210 acre parcel of land lying on either side of the St. Vrain River immediately north of state highway 119 in southwest Weld County. To date, mining activities have been concentrated on the east side of the St. Vrain; However,in the near future WMI will begin mining sand and gravel from the west side of the river and transporting the aggregate to the east side for processing. The Hamm pit was originally permitted by Frontier Materials Company in 1987. Under the Approved special use permit from Weld County,Frontier proposed to construct a bridge over the St. Vrain and transport sand and gravel by haul vehicle from the west side of the river to the east side. After operating in the Hamm pit for the past few years, WMI has concluded that the west side of the pit can be mined more efficiently and with less environmental impact if conveyors are used to transport aggregate from the west pit to the plant on the east side. In order to accomplish this WMI proposes to construct a low water crossing for the periodic movement of heavy equipment and to install a conveyor across the river to move the sand and gravel. The construction of the low-water crossing will consist of excavating both the east and west banks of the river in order to create a driveable slope down to the river channel. The crossing itself involves the placement of a minor amount of washed gravel onto the river channel bottom in order to create a driveable, underwater surface. The crossing is a temporary feature that will be used during WMI's mining and reclamation activities on the west side of the river. The crossing will be used on a limited basis (approximately 6 crossings per day)for heavy equipment only. WMI has previously met with the U.S. Army Corps of Engineers, at the Hamm pit,in order to determine their permit requirements for the low-water crossing under Section 404 of the Clean Water Act (see enclosed 404 Permit application). Along with this letter I have enclosed a construction drawing of the conveyor crossing design prepared by the civil engineering firm of Scott, Cox &Associates, Inc. of Boulder. To the best of my knowledge the installation and operation of the conveyor system will have minimal impact if any on the river. Once mining activities on the west side have been completed the conveyor and trestles will be removed. As with the low-water crossing the Corps of Engineers have been consulted(see enclosed letter). At the present time,WMI would like to begin installation of the conveyor crossing and low water crossing this fall. The location of this crossing is in the southwest one quarter of the southeast one quarter of Section 4, township 2 north, range 68 west of the 6th p.m. in Weld County, Colorado (see enclosed map). The latitude of the crossing is 40° 09' 47" and the longitude is 105° 00' 26". The project at this site involves the installation of a temporary belt conveyor crossing over the Saint Vrain River. The conveyor will be used to transport excavated sand and gravel from WMI's mining operation on the west side of the river to the east side for processing. Once mining on the west side has been completed the conveyor crossing will be removed. Colo.Highway 121 Littleton, CO 80123-6901 Re: Hamm Pit PDN Dear Terry: This letter is written as a follow-up to your field inspection on May 23, 1994 of a portion of Western Mobile, Inc.'s (WMI)Hamm Pit sand and gravel operation. The purpose of the field inspection was to discuss WMI's plans to construct a low water crossing of the St. Vrain River. The location of this crossing is in the southwest one quarter of Section 4, Township 2 North, Range 68 West of the 6th p.m. in Weld County (see vicinity map). The latitude of the crossing is 40° 90' 47" and the longitude is 105° 00' 26". The project at this site consists of constructing a service access road and a low- water crossing of the St. Vrain River. The total length of the service road on the east side of the river is approximately 330 feet with approximately 30 feet of roadway on the west side of the river. At the point of crossing the creek is approximately 110 feet wide. The construction of the road will disturb a few hundred square feet of wetlands. The construction of the low water crossing will consist of excavating both the east and west banks of the river in order to create a driveable slope down to the river channel. The crossing itself involves the placement of a minor amount of washed • gravel into the river channel bottom in order to create a driveable, underwater surface. The access road leading to the crossing on the east side will impact a few hundred square feet of wetlands that will be lost when the road is constructed. The total affected area is approximately 5,000 square feet of which 1,100 square feet is river channel and approximately 500 square feet is wetlands. The crossing is a temporary feature that will be used during WMI's sand and gravel mining activities on the west side of the river. Once all mining and reclamation activities have been completed on the west side of the river the crossing and access road will be reclaimed. Wetlands lost through the construction of the access road to and from the low water crossing will be mitigated through the mining and reclamation plan for the Hamm Pit which calls for the construction of a number of ponds for fish and waterfowl habitat (see enclosed). • P . Keammerer,Ph.D. recently conducted a survey of the project area in order to evaluate the site for the presence of Ute Lady's Tresses orchid and wetlands. Dr. Keammerer's report is included with this letter. Also enclosed with this letter please find a permit application for coverage of the proposed activity under nationwide #14 along with the additional information necessary to process WMI's pre-discharge notification (PDN) application.
