RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1056 FOR
AN ACCESSORY STRUCTURE LARGER THAN 1,500 SQUARE FEET (1,920 SQUARE FEET)
IN AN A (AGRICULTURAL) ZONED SUBDIVISION - WILLIAM F. AND LAURA A. SCHMOLL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
26th day of October, 1994, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of William F. and Laura A. Schmoll,
4225 South Lincoln Avenue, Loveland, Colorado 80537, for a Site Specific
Development Plan and Special Review Permit #1056 for an accessory structure
larger than 1,500 square feet (1,920 square feet) in an A (Agricultural) Zoned
subdivision on the following described real estate, to-wit:
Lot 4, Pleasant View, Weld County, Colorado
WHEREAS, William Schmoll, applicant, was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:

a. This proposal is consistent with the Weld County Comprehensive
Plan's Urban Growth Boundary Area Goals and Polices. The
Urban Growth Boundary area section of the Comprehensive Plan
provides for the County to encourage land-use development
proposals as long as they conform to the desires of the
affected municipalities. This land use is located within the
Urban Growth Boundary area of the Town of Berthoud and the
City of Loveland. The Town of Berthoud indicated in a
referral response that the proposal is compatible with the
interests of the town.
b. This proposal is consistent with the intent of the
A (Agricultural) Zone District and is provided for as a Use by
Special Review.
c. The permitted uses will be compatible with the existing
surrounding land uses that include agricultural production,
pasture, rural residencies, a guyed transmission tower, and
oil and gas production. The uses will be compatible with the
future development of the surrounding area as permitted by the
A (Agricultural) Zone District.
d. No overlay districts affect the site.
e. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of William F. and Laura A. Schmoll for a
Site Specific Development Plan and Special Review Permit #1056 for an accessory
structure larger than 1,500 square feet (1,920 square feet) in an
A (Agricultural) Zoned subdivision on the hereinabove described parcel of land
be, and hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days, of approval by the Board
of County Commissioners.
2. Access shall be limited to one access per legal lot.

1. The Site Specific Development Plan and Special Review Permit is for an
accessory structure larger than 1,500 square feet (1, 920 square feet) in
the A (Agricultural) Zone District as submitted in the application
material on file and subject to the Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The applicant/property owner shall remove, handle, and stockpile manure
from the livestock area in a way that will prevent nuisance conditions.
The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff.
4. The facility shall be operated in compliance with the Confined Animal
Feeding Operations Control Regulations and the Weld County Zoning
Ordinance, Section 47.
5. All liquid and solid waste shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. Fugitive dust shall be controlled on this site.
8. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
9. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
10. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
11. Personnel from the Weld County Health Department, Berthoud Fire Protection
District, and Weld County Department of Planning Services shall be granted
access onto the property at any reasonable time to ensure the activities
carried out on the property comply with the Development Standards stated
herein and all applicable Weld County regulations.

12. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
13. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

A public hearing was conducted on October 26, 1994, at 10:00 a.m. , with

The following business was transacted:
I hereby certify that pursuant to a notice dated October 3, 1994, and duly
published October 6, 1994, in the Windsor Beacon, a public hearing was
conducted on October 19, 1994, to consider the request of William F. and
Laura A. Schmoll for a Site Specific Development Plan and Special Review
Permit for an accessory structure larger than 1,500 square feet (1,920
square feet) in an A (Agricultural) Zoned subdivision. At said hearing on
October 19, 1994, said hearing was continued to October 26, 1994, at
10:00 a.m. , at which time Bruce Barker, County Attorney, made this a
matter of record. Keith Schuett, Planning Department representative,
entered the favorable recommendation of the Planning Commission into the
record as written. William Schmoll, applicant, stated he is occupying the
home on the property in question and explained he moved to the country to
facilitate his wife's horse hobby. He said a larger building is desired
for easier function of the facility and noted the covenants of the
subdivision allow a building as large as 2, 000 square feet. Mr. Schmoll
stated he secured the builder for the out-building at the same time the
house was completed; however, he then found out a building over 1,500
square feet in size was restricted without a Special Review Permit since
his property is only 9.6 acres. He noted he is continuing to utilize the
land for agricultural and recently harvested his first crop of alfalfa.
At the request of Mr. Barker, Commissioner Harbert moved to approve the
submittal of the Planning Commission's recommendation as written into the
record. Commissioner Kirkmeyer seconded the motion, which carried
unanimously. In response to questions from the Board, Mr. Schmoll
estimated his barn to be 15 feet in height and confirmed that all
Conditions of Approval and Development Standards are acceptable. He also
confirmed that the barn is being finished in a coordinated color pursuant
to the covenants. No public testimony was offered concerning this matter.
Commissioner Kirkmeyer moved to approve the request of William F. and
Laura A. Schmoll for a Site Specific Development Plan and Special Review
Permit for an accessory structure larger than 1,500 square feet (1,920
square feet) in an A (Agricultural) Zoned subdivision, based on the
recommendations of the Planning staff and the Planning Commission, with
the Conditions of Approval and Development Standards as entered into the
record. The motion was seconded by Commissioner Baxter, and it carried
unanimously.

LOCATION: Approximately 1.5 miles south of Greeley city limits; south of and
adjacent to Weld County Road 52 and west of and adjacent to 47th
Avenue.
Ken Merritt, representative for Joyce Allely, gave an overview of the
application. He explained their are no concerns from surrounding property owners
and Ms. Allely has addressed all concerns regarding dust control, noxious weeds,
road accesses, quality of homes, and loss of farmland.
The Chairman asked if there was anyone in the audience who wished to speak for
or against this application.
Steve and Deanna Butherus, Richard Marshall, and Dick Pirnie all spoke about the
quality of,the proposed subdivision, road maintenance, horse bridle path areas,
flooding concerns if the historic drainage patterns are altered. Mr. Pirnie had
major concerns about drainage because he has always been able to utilize water
runoff in that area.
Bud Clemons moved Case Number S-362, Dos Rios Estates, 2nd Filing, c/o Joyce
Allely, be forwarded to the Board of County Commissioners with the Planning
Commission's recommendation for approval with the addition of a condition that
as part of the final plat application a proposed agreement regarding delivery of
water to Mr. Pirnie's property be reached between the applicant, Mr. Pirnie, and
Weld County. Shirley Camenisch seconded the motion.

William Schmoll, applicant, explained he and his wife are very involved in the
care of horses for their private use. His wife is an avid barrel racer and they
built this outbuilding as a "home" for their horses. Mr. Schmoll stated that he
checked the covenants for the subdivision before building and they stated nothing
in excess of 2000 square feet for outbuildings and he did not realize that County
rules of 1500 square feet maximum (which he was not aware of) would supersede the
covenants for the subdivision.
The Chairman asked if there was anyone in the audience who wished to speak for
or against this application. No one wished to speak.
Ron Sommer moved Case Number, USA-1056, William F. and Laura A. Schmoll, be
forwarded to the Board of County Commissioners with the Planning Commission's

Federal Regulations (40 cfr 144.6) in the A (Agricultural) zone
district.
LEGAL DESCRIPTION: Part of the S2 of the E2 of the NW4 and approximately 1
acre in the SW4 of Section 10, T1N, R67W of the 6th
P.M. , Weld County, Colorado.
LOCATION: One mile south of State Highway 52; approximately 1/2 mile east of
Weld County Road 19.
Ken Lind, Attorney, explained the injection well has been in existence since 1976
for the disposal of brine water. This application for the disposal of Claes I
and II nonhazardous liquid waste has been approved through the Colorado Oil and
Gas Conservation Commission, the Colorado State Health Department, and the Weld
County Health Department. He asked if the Planning Commission had any questions
regarding this application. Discussion followed. The applicant had concerns
about the wording on Development Standards #18, 22, and 24. Keith Schuett had
no problems with the changes. Martin Vorlick gave and overview of the facility.

from the livestock area in a way that will prevent nuisance conditions.
The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff.
4. The facility shall be operated in compliance with the Confined Animal
Feeding Operations Control Regulation, and the Weld County Zoning
Ordinance, Section 47,
5. All liquid and solid waste shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. Fugitive dust shall be controlled on this site.
8. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
9. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
10. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
11. Personnel from the Weld County Health Department Berthoud Fire Protection
district and Weld County Department of Planning Services shall be granted
access onto the property at any reasonable time to ensure the activities
carried out on the property comply with the Development Standards stated
hereon and all applicable Weld County Regulations.

A. The proposed structure is a five stall horse barn.
Which will include a tack room and wash rack. This
barn is exclusively for our personal non-commercial
use. The proposed structure is 1920 sq. ft. in size.
B. The purposed barn will be located 80 feet from our home
and more than 500 feet from any existing homes.
C. There are no employees or shifts regarding this
structure. Family members only.
D. The proposed structure is designed to accommodate five
horses. We may have friends coming over to ride horses
from time to time. This proposed structure is intended
for non-commercial use by our family.
E. Five horses and two barn cats are proposed at this
time.
F. No processing equipment will be utilized with the
proposed structure.
G. One 1920 sq. ft. pole barn for the purpose of housing
horses and tack.
H. One three quarter ton pickup truck and 25 foot horse
trailer. Coming and going through the driveway of our
house off of Pleasant View Drive.
I. There will not be any sewage facilities with this
structure. Bathroom facility are available in our
residence if necessary.
J. Horse waste will be recycled as fertilizer in the
adjacent seven and a half acre hay field which we own.
K. Waste will be removed from area daily to spreader and
spread weekly.
L. Planned construction scheduled for mid July and
completed within one month.

keeping between two and five horses for personal
pleasure. Are desire was to have a place large enough

facilitate the quality care of our animals. The
proposed structure is designed to have a total of five
stalls with a 12 ' X 12' wash rack and tack room. If we
were not able to construct the purposed structure we
would stand to lose our investment and the joy of
taking care of horses in a quality environment. This
property is designed to be compatible with the
neighborhood.

GEOTECHNICAL AND PERCOLATION REPORT
INTRODUCTION
The following report presents the results and
recommendations of a Geotechnical and Percolation
Investigation for Lot 4 Pleasant View Acres , Weld County,
Co. This investigation was performed to ascertain the
bearing capacity , percolation capabilities and stability
of subsurface soils . It is our understanding- single
family type of house is to be constructed. -
SITE LOCATION AND DESCRIPTION
The site is located east of Weld County Road 1 and south
of State Highway 60. The building and leach field area
slopes toward the east at about 1%. Vegatation on the
site is mainly weeds and wild grasses .
FIELD INVESTIGATION
The test holes were made on 4/13/94. The percolation
holes were filled with water on the same date. The
percolation tests were performed on 4/14/94, by a member
of this firm. Percolation rates varied from 12 to 30
minutes per inch. Tests were performed on Lots 2 and 4 at
the same time. The soils were fairly uniform consisting
of 8" to 12" of topsoil followed by silty sands (see test
pit logs) . No groundwater or bedrock was encountered in
any of the test holes .
FOUNDATION RECOMMENDATIONS
The proposed structure can be founded on spread footings
and/or pad and grade beam type of foundation, designed
for a maximum bearing capacity of 1 ,000 pounds per square
foot (dead load plus full live load) .
Provisions should be made for a underdrain system in the
basement , under the basement slab and into a sump pit .
The foundation and slabs should not be placed on
uncompacted fill , frozen ground , topsoil, organic
material or within 2 feet of seasonal groundwater . The
bottom of the foundation should be placed a minimum of 30
inchs below final grade for frost protection.
Bearing capacities are based on soil type , laboratory
testing , excavation characteristics and prior experience
in the area. Based on our recommendations , anticipated
differential movement should be less than 0. 75 of an
inch.

CONCRETE
All concrete and reinforcement should be placed in
accordance with ACI 318 . All slabs in living areas should
have a minimum of 6 inchs of 3/4 inch washed rock placed
beneath them to provide a capillary break. Type II cement
should be used in all concrete.
BACKFILL AND DRAINAGE
Backfill should be placed around the foundation in 12
inch lifts and compacted, or a berm should be added to
provide for future settlement . Water settling should NOT
be used. Trash, frozen material and organic material
should not be used in backfill.
The final grade should have a 10% slope away from the
foundation in the first 10 feet . Downspouts and sillcocks
should discharge into splash blocks or long downspout
extensions that extend beyond the backfill limits or at
least 10 feet whichever is greater. Sprinkler heads must
not be placed within 10 feet of the foundation and their
spray should be directed away from the foundation.
SEPTIC SYSTEM RECOMMENDATIONS
Based on a percolation rate of 30 minutes per inch and
from page 30 of the Weld County Individual Sewage
Disposal Regulations a 325 square foot, per bedroom,
leach field is required. The leach field should be
preceeded by a 1 ,000 gallon compartmented septic tank,
for a three bedroom home. The septic tank should be
increased by 250 gallons for each additional bedroom over
three. The system should be placed and installed in
accordance with Weld County and State Of Colorado Health
Department Regulations .
Care should be taken to divert all drainage water and
irrigation water from the field. The septic tank should
be pumped at least once every four years . This system
should not be placed within 100 feet on any well , steam
or irrigation ditch.

CONCLUSION
The soils on the site have a low bearing capacity and a
hydroconsolidation potential, therefor the soils near the
foundation should be prevented from becoming wet:
The soils in the area of the percolation test have a fair
percolation rate. The findings of this report do not
reflect changes which may occur between test holes or at
any distance away from them. In view of this and known
conditions , a Engineer from this firm must be called upon
to inspect the excavation prior to construction , to
ascertain that conditions are in accordance with this
report .

AND ROAD MAINTENANCE FOR
PLEASANT VIEW ACRES
The developers of Pleasant View Acres have established a Homeowners'
Association to benefit all owners with the subdivision. The Association
administers the covenants, upholds design guidelines and manages the
affairs of the subdivision.
Membership is automatic upon purchase of a lot. The covenants and
design guidelines provide a flexible procedure for the overall
development of Pleasant View Acres. They also establish methods for
administration, maintenance and enforcements of the Homeowner' s
Association.
These covenants and guidelines are designed to enhance the value,
desirability and long-term attractiveness of Pleasant View Acres.
The undersigned, being the Declarant and owner-of all the land in—
Pleasant View-Acres, being a portion of the Northwest Quarter of Section
6, Township 4 North, Range 68 West of the 6th P.M. Weld County, Colorado
as shown by a plat of said subdivision dated the /3 day of 4ufua4'
1993 , do hereby make this Declaration of Protective Covenants applicable
to all lots in Pleasant View Acres.
1. ARCHITECTURAL ADVISEMENT COMMITTEE
a. The Architectural Advisement Committee shall consist of three
persons. The managing partner for the Declarant shall have the
right to appoint the initial Committee members whose terms shall
expire at such time as the Declarant has transferred title on all
lots within Pleasant View Acres subdivision. Thereafter, the
Committee shall be as specified by the Lot owners. The decision
of any two members of said Committee shall determine all
questions as to the conduct of said Committee. No Committee
member shall be entitled to compensation for services rendered
pursuant to these covenants .
b. Should the Committee fail to approve or disapprove plans and
specifications submitted to it by the owner of a lot in the
subdivision within sixty days after written request therefore, "
then such approval shall not be required provided that no
building or other structure shall be constructed, erected,
altered, placed, or allowed to remain on any lot which violates
any of the covenants or restrictions herein contained.
c. No member of the Committee or the Declarant shall be liable
for any loss, damage, or injury arising out of or in any way
connected with the performance of the duties of the Committee.
The Committee shall not be responsible for safety requirements,
whether structural or otherwise, or of being in conformance with
building codes or other governmental laws or regular . .

d. The Architectural Advisement Committee may grant a variance
on any requirements specified in paragraphs 3, 4 or 5 of these
covenants.
2. LAND USE
a. No lot shall be used except for a single family residential
purpose and no building shall be erected, altered, placed or
permitted to remain on any lot other than one single family
dwelling, one private garage for not more than four vehicles, and
accessory buildings or barns not to exceed three. Each single
family residence shall be owner occupied.
b. No obnoxious or offensive activity shall be permitted on any
lot nor shall anything be permitted which may be or may become an
annoyance or nuisance to the neighborhood.
c. No manufacturing, industrial, or commercial enterprise shall
be permitted on any lot, except those associated with horse-
related activities, and-specifically-excluding feed lots, pig
farming, junkyards, rendering facilities and breeding and/or
training kennels .
d. No oil drilling, oil exploration, oil development operations,
oil refining, or other quarrying or mining operations of any kind
shall be permitted upon or under any lot except for those
operations which already exist and are in place with the Seller.
e. No structure of a temporary character, trailer, basement,
shack, garage, barn, or other accessory building shall be used as
a permanent or temporary residence, with the exception of an RV
or recreational trailer.
f. No part of any lot shall be used as a site for mobile homes
or trailers, irrespective of whether such mobile home or trailer
is occupied as a dwelling or is stored on the lot, except during
construction. Construction of the permanent structure shall
commence within sixty (60) days after placement of mobile home or
trailer is in place on said lot. At the time of completion of
the home, all temporary residences shall be removed.
g. No sign or advertising of any kind, except for those of the
Declarant and its sales agents, shall be erected, placed,
permitted, or maintained upon any lot except for "For Sale" sign
referring only to the lot on which displayed.
3 . ANIMALS
a. No animals of any kind shall be raised, bred, trained or kept
on any lot for commercial purposes.
b. A combined maximum number of four cats and two dogs over the
age of twelve weeks and 4-H projects for children under the age
of 18 shall be permitted.

c. One horse per two acres, or fraction thereof, as shown on
plat, shall be permitted on any lot only if a suitable corral is
constructed and the horses are not permitted to overgraze.
d. No other animals shall be permitted without the written
approval of the Architectural Advisement Committee.
4 . BUILDINGS AND IMPROVEMENTS
These design guidelines establish standards for design features,
architectural styles, exterior colors and materials, construction
details and the locations and size of structures. ' The design
guidelines, from time to time, shall be reviewed and revised by
the Architectural Advisement Committee.
a. No building or improvement, including fences, shall be
constructed, erected, placed, or altered on any lot until the
construction plans and specifications have been approved by the
Architectural Advisement Committee. The Committee' s approval or
disapproval of plans and_sperifixations -as required--by these- -
covenants shall be in writing. The Committee's refusal to
approve plans and specifications may be based on any grounds,
including purely aesthetic grounds, which in the sole discretion
of the committee shall seem sufficient with the right of appeal
to the entire Homeowner' s Association, which will have the final
judgment. No barn or outbuilding is to be built prior to
building the residential home without permission from the
Architectural Advisement Committee.
b. Housing Requirements
- Housing styles include ranch, tri-level and two-story
homes (i.e. , Victorian, Country Farmhouses, Traditional
and Contemporary) . The minimum finished living space,
above ground, is 1700 square feet. The minimum finished
living space on two or more floors is 2100 square feet.
Two-story homes must be built with a minimum of 60% of the
finished area on the first floor.
- Garages may be -attached and accommodate a minimum of two
and a maximum of four automobiles.
- Roofs must have a minimum of 4 : 12 pitch and be of wood,
fiberglass, shake, cedar or high-quality asphalt shingles.
Simulated shakes, or other materials, such as concrete or
tile, will be considered.
- All exterior wall surfaces shall be masonry brick, stone,
stucco, natural wood siding or a composite siding, such as a
high-grade masonite will be permitted. Vinyl, aluminum or
other metal sidings or trims are not permitted. All buildings
and improvements located on any one lot must be of the same
architectural design and styling, or compatible colors
and materials, to be in harmony with the dwelling.

- Wood, vinyl-clad or metal-clad wood window frames are
permitted.
- All homes, outbuildings, corrals, fences, etc. must be
painted in aesthetically pleasing colors set forth by the
Architectural Control Committee. Neutral colors (ivory,
white, light yellow and light gray, etc. ) are the preferred
colors. Others will be considered on a case-by-case basis.
- Barn and Outbuildings: A steel pole barn is not to exceed
2000 square feet, which will be finished in coordinating
colors of the home (no plain steel is permitted) .
c. Landscaping Requirements
- Landscaping requirements are designed to ensure attractiveness
and continuity within Pleasant View Acres. It is recommended
that each lot shall have a minimum of three 2" caliper
deciduous trees or evergreen trees in the front and side yard
areas. The front and side yard area consists of footage
extending a--maximum-o-f--50- feet- tn-these three directions.
- Each lot shall have at least two 2" caliper trees and one 6
foot evergreen in the backyard area. The backyard area
extends a maximum of 100 feet back from the residential
dwelling.
- No trees are to be planted on the irrigation easements.
- At least 60% of the front yard, excluding driveways, must be
in grass or other vegetative cover.
- Landscaping must be installed as soon as reasonably possible
following construction and pending the results of the Atrazine
soil tests.

125 feet of any street. Pasture fences may be located on the
property lines.

h. At least one entry light shall be placed on every lot as
means of illuminating driveway entrances, etc. as required by
Weld County.
i. No tanks for the storage of gas, fuel oil, or any other
matter shall be erected, placed, or permitted above or below
ground on any lot.
j . No exterior television or radio antenna shall be erected,
placed or permitted on any lot without the written approval of
the Architectural Advisement Committee. Satellite antennas shall
be approved by the Architectural Advisement Committee.
5. MAINTENANCE
a. Weeds must be kept cut or sprayed at all times, allowances to
be made for tall grass along the irrigation ditches.
b. All dwellings, accessory buildings, barns,_garages, fenccs
and other structuresshall be maintained in a clean, orderly and
attractive appearance at all times .
c. Each lot owner of Pleasant View Acres shall comply with the
Pleasant View Subdivision Water Association.
d. One of the following or unlicensed motor vehicles and one
recreational vehicle or boat, trailer, motorcycle or other
mechanical equipment shall not be stored on any lot for a period
longer than two weeks unless such equipment or vehicle is
concealed from public view, preferably stored in a neat and
orderly fashion.
e. Each lot shall be kept in an attractive and clean condition
at all times. No trash, litter, junk, containers, or building
material shall be permitted to remain visible from any
neighboring lot or street except as necessary during a period of
construction. In the event any structure is destroyed, either
wholly or partially by fire or any other casualty,
shall be properly rebuilt or remodeled within twelve said structure
months to
conform with these covenants . If the structure is not to be
rebuilt, all remaining portions of the structure, including the
foundation and all debris, shall be promptly removed from the
property.
ROAD MAINTENANCE
a. All Landowners within the Subdivision are responsible for
one-sixth (1/6) of the Road Maintenance from Weld County Road
Number 1 within the Subdivision. ;'
b. Said landowners agree to elect by 41 vote a Trustee, the Trustee
shall have the power to assess and collect Road Maintenance on a
prorata basis which shall be binding upon said property owners within
the Subdivision. The total cost of said Road Maintenance shall be

divided among the Landowners on an equal six way split. Said trustee
must be one of the Landowners, and shall be elected for a one year
term. The acceptance and the recording of a deed conveying fee
simple title to a plot of land within the subdivision shall
constitute consent by the grantee to abide by the provisions of this
Road Maintenance, which shall be perpetual unless specifically
released by the Board of County Commissioners of Weld County or
municipality should the subdivision be annexed at a future date.
c. Nonpayment of such assessments within 30 days of billing shall
result in the paying Member or Members being entitled to recover all
costs and expenses incurred to collect the delinquent assessments
plus interest at the rate of 18% per annum plus reasonable attorneys
fees. No owner may exempt himself from liability to pay any
assessment.
7. PROVISIONS
a. These covenants shall operate as covenants running with the
land for the benefit of theDeclarant_and- any persons—who—now—own
or may hereafter own property within Pleasant View Acres. Except
said covenants and agreements shall not apply to the present
improvements, residential home and 'outbuildings on Lot 1 . The
Declarant and each lot owner is specifically given the right to
enforce covenants through any proceedings, against any person
violating or threatening to violate these covenants, and to
recover any damages suffered by them from any such violation.
Such damages shall include, but not be limited to, reasonable
attorney's fees, court costs, expert witness fees and bonding
costs.
b. These covenants are to run with the land, and shall be
binding on lot owners for a period of 25 years from the date
these covenants are recorded, after which time said covenants
shall be automatically extended for successive periods of 10
years. These covenants, not withstanding the above, can be
altered or amended in any manner at any time by a recorded
instrument signed by the managing partner of the Declarant until
12/30/94, or by 75% of the lot owners after 12/31/95.
c. If any portion of these covenants are invalidated in any i.manner whatsoever, it shall not be deemed to affect in any manner
the validity, enforceability, or effect of the remainder of these
covenants, and in such event, all of the remaining provisions of
these covenants shall continue in full force and effect as if
such invalid provision has never been included herein.
d. No provision contained in these covenants shall be deemed to
have been abrogated or waived by reason of any failure to enforce
the same, irrespective of the number of violations or breaches
which may occur.

Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 10th

attendance to answer any questions the Planning Commission members might have with

2. It is the opinion of the Department of Planning Services' staff that the
applicant has shown compliance with Section 24.3 of the Weld County Zoning
Ordinance as follows:
- This proposal is consistent with the Weld County Comprehensive Plan's
Urban Growth Boundary area goals and policies. The Urban Growth
Boundary area section of the Comprehensive Plan provides for the
County to encourage land-use development proposals as long as they
conform to the desires of the effect municipalities. This land use is
located within the Urban Growth Boundary area of the town of Berthoud
and the City of Loveland. The town of Berthoud indicated in a
referral response that the proposal is compatible with the interests
of the town.
- This proposal is consistent with the intent of the A (Agricultural)
zone district and is provided for as a Use by Special Review.
The permitted uses will be compatible with the existing surrounding
land-uses that include agricultural production, pasture, rural
residences, a guyed transmission tower, and oil and gas production.
The uses will be compatible with the future development of the
surrounding areas as permitted by the A (Agricultural) zone district.
- No overlay districts affect the site.
- Special Review Permit Development Standards will provide adequate
protection of the health, safety, and welfare of the neighborhood and
County.

This recommendation is based, in part, upon a review of the application materials

The Department of Planning Services' staff recommendation for approval is

1. The attached Development Standards for the Special Review permit shall be
adopted and placed on the Special Review plat prior to recording the plat.
The plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder's office within
15 days of approval by the Board of County Commissioners.
2. Access shall be limited to one access per legal lot.

1. The Site Specific Development Plan and Special Review permit is for an
accessory structure larger than 1500 square feet (1920 square feet) in the
A (Agricultural) zone district as submitted in the application materials on
file in the Department of Planning Services and subject to the Development
Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. The applicant/property owner shall remove, handle, and stockpile manure
from the livestock area in a way that will prevent nuisance conditions.
The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests, or
pollutant runoff.
4. The facility shall be operated in compliance with the Confined Animal
Feeding Operations Control Regulation, and the Weld County Zoning
Ordinance, Section 47,
5. All liquid and solid waste shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. Fugitive dust shall be controlled on this site.
8. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
9. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
10. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
11. Personnel from the Weld County Health Department Berthoud Fire Protection
district and Weld County Department of Planning Services shall be granted
access onto the property at any reasonable time to ensure the activities
carried out on the property comply with the Development Standards stated
hereon and all applicable Weld County Regulations.

12. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by
the Weld County Planning Commission and the Board of County Commissioners
before such changes from the plans or Development Standards are permitted.
Any other changes shall be filed in the office of the Department of
Planning Services.
13. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

conditions are recommended to be part of any approval:
1. The applicant shall remove, handle, and stockpile manure from the
livestock area in a manner that will prevent nuisance conditions. The
manure piles shall not be allowed to exist or deteriorate to a condition
that facilitates excessive odors, flies, insect pests, or pollutant
runoff.
2. The facility shall be in compliance with the Confined Animal Feeding
Operations Control Regulation, and Weld County Zoning Ordinance, Section
47, prior to final approval of the proposed use.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Fugitive dust shall be controlled on this site.
