RE: PRELIMINARY HEARING TO CONSIDER CREATING LOCAL IMPROVEMENT DISTRICT -
WELD COUNTY ROAD 32
A public hearing was conducted on April 22, 1992, at 10:00 A.M. , with the
following present:
Commissioner George Kennedy, Chairman
Commissioner Constance L. Harbert, Pro-Tem
Commissioner C. W. Kirby
Commissioner Gordon E. Lacy
Commissioner W. H. Webster
Also present:

The following business was transacted:
I hereby certify that a public hearing was conducted to consider creation
of a local improvement district along Weld County Road 32. Lee Morrison,
Assistant County Attorney, made this a matter of record. Mr. Morrison
said the Board should consider accepting the draft resolution declaring
the intent to create a local improvement district. Drew Scheltinga,
Director of Engineering Department, said out of 22 total parcels, 20 are
owned by individuals to be assessed $1000 per parcel, and 2 are owned by
Harbor American Health Care Trust, Inc. , to be assessed a total of $5000.
Three parcels, owned by Public Service, United Power, and K & C
Development, were excluded from the proposed district. Weld County Road
32 would be paved from Interstate 25 to Weld County Road 13, a distance of
2 miles. The lanes would be 12' wide with shoulders varying from a
minimum of 2' to 4' , with a large culvert to be installed. Asphalt would
be 2y", with 6" of aggregate base course. Mr. Scheltinga said the cost
estimate is based on last year's bid; however, this year's bid is $3 per
ton less. Mr. Scheltinga said the paving and shouldering is estimated at
$110,500. The preparation work is estimated at $119,800; however, it
could be less if Weld County material is hauled from the Hokestra Pit.
Administration fees are estimated at $15,000, with a total being estimated
at $245,300. He said the property owners would be assessed $1000 per
parcel. The district's share is estimated to be $20,000, Harbor American
Health Care Trust, Inc. , at $5, 000, and Weld County at $220,300. The
petition was signed by 18 of 20 owners, plus Harbor American. Mr.
Scheltinga explained the payment process of the assessments. Arlie Hames,
property owner, stated she would like to pay the $1000 in full. Ken
Williamson, owner of K & C Development, said he does not feel the amount
of traffic justifies paving of this road. He requested a confirmation
that he would not be assessed since K & C Development does not have access
onto Weld County Road 32. Mr. Scheltinga said traffic counts and visual
counts have been completed, with an average being 200 vehicles per day.
He said even though K & C Development was notified, it will not be
assessed. Ms. Hames said there are trucks with oil well equipment using
that road, and she stated concerns about damage that may be done to the
new pavement. Commissioner Webster stated if they damage the road, they
will be billed for repairs. There was further discussion concerning K & C
Development. Commissioner Lacy moved to approve the draft resolution to
form the local improvement district, with Commissioner Webster seconding
the motion. It carried unanimously. Commissioner Lacy moved to set the
creation hearing on Monday, June 1, 1992, at 9:00 a.m. The motion was
seconded by Commissioner Kirby and carried unanimously.
