RE: APPROVE EAST 168TH AVENUE PAVING INTERGOVERNMENTAL AGREEMENT WITH CITY OF
BROOMFIELD AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with the East 168th Avenue Paving
Intergovernmental Agreement between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Weld
County Public Works Department, and the City of Broomfield, with terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the East 168th Avenue Paving Intergovernmental Agreement
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Public Works
Department, and the City of Broomfield be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 18th day of May, A.D. , 1994.

East 168th Avenue Paving
Intergovernmental Agreement
THIS INTERGOVERNMENTAL AGREEMENT, dated this ath day of
A ¢�4 , 1994, between the COUNTY OF WELD, STATE
OF COLORADb a body politic and corporate, hereinafter, "Weld County" and the CITY
OF BROOMFIELD, a municipal corporation, hereinafter "Broomfield."
WITNESSETH
WHEREAS, a section of East 168th Avenue as shown on Exhibit A contains
commonly shared borders between Adams County and Broomfield; and
WHEREAS, the north half of the roadway is in Broomfield and the south half of the
roadway is in Adams County; and
WHEREAS, Weld County maintains the south half of this roadway under a
maintenance agreement with Adams County; and
WHEREAS, Broomfield and Weld County desire to have an asphalt overlay placed
on this section of roadway.
NOW, THEREFORE, in consideration of the covenants and promises set forth and
for the good and valuable consideration, the sufficiency of which is hereby acknowledge,
the parties agree as follows:
1. Work. During the 1994 construction season, Weld County will cause an
asphalt overlay to be placed on the section of East 168th Avenue shown on Exhibit A.
The Work includes preparatory asphalt patching, a two-inch-thick asphalt overlay
graveling the finished shoulder area traffic control, and restriping the street section.
2. Payment. Broomfield agrees to pay Weld County for actual quantities
completed on the Broomfield street section. Exhibit B is a letter from Weld County which
shows the estimated unit costs. The total amount paid will not exceed $9,000 unless this
agreement is amended. Payment will be made within sixty (60) days of completion of
work.
3. Budget Limitations. The obligations of the parties hereunder are subject to
funds having been budgeted and otherwise made available pursuant to constitutional and
charter requirements.
4. Authorized Representatives. Weld County hereby designates Dean Dreher
of the Weld County Public Works Department as its Authorized Representative.
Broomfield hereby designates Dorian Brown of the Broomfield Public Works Department
as its Authorized Representative. Each party shall be notified of any change by the other
in its Authorized Representative. Task implementation and scheduling shall be the

responsibility of suct ithorized Representative.
5. Notice. Any notice required to be given by this Agreement shall be
considered delivered upon mailing, postage prepaid, to the part as appropriate, unless
provided herein, addressed as follows:

6. Term. This agreement terminates when Broomfield pays for the work.
7. Entirety. This Agreement represents the complete understanding of the
parties and may be modified only in writing and only by mutual consent.

ATTENTION: City Council and Dorian Brown, Deputy Director of Public Works
To Whom It May Concern:
Weld County would like to place a maintenance overlay on their portion of Weld
County Road (WCR) 2 during the 1994 work season. This section is over-due for
maintenance and is in need of attention.
Because of the complexities of overlaying half of a roadway, we would like to
overlay both sides of the road and then bill the City of Broomfield for their
share of the costs.
The area to pave is approximately 1,920 feet in length. The costs that would
be incurred include patching, a two inch overlay including the CSS - 1H
Emulsion to insure a bond to the underlying asphalt surface, and the gravel for
the finished shoulder area. The approximate cost would be $8,700 to $9,000.
The unit prices used are approximately $21/ton for asphalt, $8/ton for the
finish shoulder gravel and patching at $2/per square foot.
