RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION
AGAINST CERTAIN PARTIES FOR VIOLATIONS OF THE WELD COUNTY INDIVIDUAL
SEWAGE DISPOSAL SYSTEM REGULATIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Weld County Department of Health has referred certain
violations of the Weld County Individual Sewage Disposal System Regulations to
the County Attorney's Office, and
WHEREAS, that individual in violation of the Weld County Individual Sewage
Disposal System Regulations is Lou Cozza, and
WHEREAS, despite efforts by the Health Department staff to resolve said
matter, the violations have not been corrected, and
WHEREAS, the Board deems it necessary to bring legal action against that
individual as hereinabove named to correct said violations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Thomas 0. David, Weld County Attorney, be, and hereby is,
authorized to proceed with legal action against Lou Cozza to remedy the
violations of the Weld County Individual Sewage Disposal System Regulations, and
any other persons occupying the properties, any persons claiming an interest in
the properties, and any persons acting in active concert with the identified
parties.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following
vote on the 12th day of February, A.D. , 1992.

Subject: Lou Cozza
In May of 1990, we received complaints in our office in regards to property
located at 4520 Weld County Road 5, Erie, Colorado 80516 and owned by Lou Cozza.
Our investigations have revealed that Mr. Cozza does not have an adequate sewage
disposal system for his residence and trailer on his property. During the past,
we have endeavored to bring Mr. Cozza into compliance with the Weld County
Individual Sewage Disposal System Regulations. In September of 1991, this matter
was heard before the Weld County Board of Health. At that time, a Cease and
Desist Order was issued. It was ordered that the Respondent cease and desist
from the use of the structures for any form of human habitation unless and until
the residences were connected to and being serviced by adequate, properly
functioning Individual Sewage Disposal System in compliance with the Weld County
Individual Sewage Disposal System Regulations. As of this date the Division
finds that the structures continue to be in violation of the regulations.
This matter has been referred to the County Attorney's Office and we are
requesting authorization for them to pursue legal action. Enclosed you will find
copies of the actions taken by this Division.
