RE: CREATION OF JOHNSON SUBDIVISION LOCAL IMPROVEMENT DISTRICT #1993-2
A public hearing was conducted on May 19, 1993 at 10:00 A.M. , with the
following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 7, 1993, and duly
published April 15, 1993, in the Windsor Beacon, a public hearing was
conducted to consider the creation of a local improvement district within
Johnson Subdivision. Lee Morrison, Assistant County Attorney, made this
a matter of record. Mr. Morrison noted the City's ordinance regarding the
two lots within the City of Greeley were consented to on first reading by
the City Council last evening. Drew Scheltinga, Director of Engineering
Department, said the concerned lots are 30 and 31. Mr. Morrison clarified
the City assured the County Commissioner's jurisdiction to include the two
lots in the District. Mr. Scheltinga said the petition included a cost
estimate of $49,500, which included shaping, grading, paving and
shouldering. Mr. Scheltinga said the lanes will consist of 2" of asphalt
to be 24' wide, with 4' shoulders to consist of 2" of aggregate. All lots
are to be assessed equally at $1,237.50 per lot. Mr. Scheltinga said the
assessment may be paid in full with no interest of over ten years at 8%
simple interest. Thirty-one of the forty lots, or 78 percent, petitioned
in favor of the improvement district. Mr. Scheltinga explained the bids
were opened yesterday with the low bidder being Western Mobile/Northern,
Inc. , at $55, 997. He said this amount is an increase of $6,497, or 13
percent, over the estimate, of which $3,300 to $3,400 was for aggregate
base course. Mr. Scheltinga said two other unexpected items were
utilities consisting of two man holes and four meter boxes; therefore,
pavement will have to be adjusted to grade at a cost of $1,365. He said
the drainage problems have been discussed with the residents, and it was
decided the district will not improve or correct the problems. The
primary driveway approaches will be paved. The cost included in the
estimate to pave the approaches was $43 per ton; however, the bid was $30
per ton which is a savings. Mr. Scheltinga said installation of a
concrete gutter pan was also included in the bid. In response to
questions of the Board, Mr. Scheltinga explained the clerical error in the
bid presented earlier today. He clarified the Engineer's estimate was
$49, 411, and Best Way's bid was $58, 163.94. He reiterated that Western
Mobile/Northern was the low bidder at $55,997. Mr. Scheltinga said there
will be a $162 per lot increase over the estimate, with the new estimated
assessment per lot being $1,399.93. He explained the breakdown of costs
over a ten-year period. In response to questions of the Board, Mr.
Scheltinga said the cost of aggregate base course doubled over last year,
and the County may be able to furnish it at less cost. That matter would
need to be negotiated with the contractor. Mr. Morrison suggested the
Board act with the higher bid then, if the costs go down, make the
necessary adjustments at the assessment hearing. Mr. Scheltinga
reiterated all costs are estimated, and the final cost will be established
at the assessment hearing. David Trevarton and Pearl Coates, property
owners, both spoke in favor of the district. Commissioner Hall moved to
create said local improvement district, and Commissioner Baxter seconded
the motion. Mr. Morrison suggested the Board consider accepting the draft
resolution and amending it to correspond to the Engineer's revised
estimate. Commissioners Hall and Baxter agreed to amend the motion to
include said changes. The motion carried unanimously.
