RE: APPROVAL CF RECORDED EXEMPTION #1580 - WALTER AND DOROTHY MAYER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption #1580, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption 111580 was submitted by Walter
and Dorothy Mayer, 9704 Highway 66, Platteville, Colorado 80651, for property
which is located in part of the SW* of Section 22, Township 3 North, Range 67
West of the 6th P.M. , Weld County, Colorado, being more particularly described
in the plat which shall be provided by the applicant and known as Exhibit "A",
said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 154 acres and 1.492 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1580 submitted
by Walter and Dorothy Mayer be, and hereby is, approved conditional upon the
applicant submitting a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11. 7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Dear Commissioners:
This request for a Recorded Exemption is submitted by Walter and Dorothy Mayer.
The parcel of land on which this request is made is described as Lot B of
Recorded Exemption 396 , which is part of the SW4 Section 22, T3N, R67W, of the
6th P. M. , Weld County, Colorado. The property is located northeast of the
intersection of State Highway 66 and Weld County Road 19. The request is to
divide a 155.492 acre parcel into 154 and 1.492 acre parcels, more or less.
Central Weld County Water District can provide domestic water to this location.
Both proposed lots can be served by septic systems.
The proposed recorded exemption is the second on this parcel of land. The 1.492
acre parcel which would be created through this process is proposed to be
utilized as a vegetable processing facility by a relative of the applicant. Ken
Mayer has applied for a Use by Special Review permit at this location for the
proposed use.
Staff recommends approval of the requested recorded exemption. The parcel
created will be the smallest parcel which would allow for the proposed use, and
is in conformance with the Recorded Exemption standards of the Weld County
Subdivision Ordinance and the Weld County Comprehensive Plan.

1. The applicant shall submit a mylar plat to the Department of Planning
Services t:o be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall
be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

RECORDED EXEMPTION QUESTIONNAIRE
1. Explain the reason for the proposed recorded exemption and how each
proposed lot will be used.
The reason for the proposed recorded exemption is to provide
a legal lot for vegetable processing. The larger lot will be
confined to agriculture and the smaller 11 acre parcel will be
for vegetable processing.
2. Describe the location, size and present use of the area where each
proposed new lot will be created.
The smaller parcel will be 11 acres and will be located in the
northwest corner of the Northwest Quarter of Section 22,
Township 3 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, the present use is agriculture. The larger lot is
presently used for agriculture. The larger parcel will be
155.5 acres
3. Explain how the proposal is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan, if applicable.
This proposal is consistent with the Weld County Comprehensive
Plan because this is an agricultural support use, i.e. , the
smaller parcel will be devoted to a vegetable processing
operation to process area vegetables. The larger parcel will
remain in agriculture and therefore applicant's proposal is
very consistent with the Weld County Comprehensive Plan.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption.
All of the uses surrounding the smaller parcel are
agricultural in nature and therefore are very compatible
with this recorded exemption application.
5. Explain how the proposal is consistent with the intent of the zoning
district :Lt is located within.
The property surrounding applicant's use is zoned agriculture
and applicant's proposed use of the smaller parcel as a
vegetable processing operation is consistent with the intent
of the agriculture district.
6. Explain how the proposal is consistent with efficient and orderly
development.
Applicant's proposal is consistent with efficient and orderly
development because is it is supportive of the agricultural
uses that surround it.
7. Explain how adequate provision for the protection of the health,
safety and welfare of the inhabitants of the neighborhood and the
County will be accomplished.
The health, safety and welfare of the inhabitants of the
neighborhood and the County are well protected with
applicant's application because he is proposing an
agricultural use in an agricultural community that is low in
intensity and helpful to the surrounding agricultural
community.
