RE: GRANT REQUEST FROM BURLINGTON NORTHERN RAILROAD FOR PREADVERTISEMENT OF
SPECIAL REVIEW PERMIT
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Maurice E. Foster,
Burlington Northern Railroad, for preadvertisement of an application for a
Special Review Permit for a microwave repeater station, and
WHEREAS, said property is described as E? NE,' NE,' Section 27, Township 1
North, Range 66 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, after study and review the Board deems it advisable to grant said
request, with the hearing date to be set as September 29, 1993, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Maurice E. Foster, Burlington Northern
Railroad, for preadvertisement of an application for a Special Review Permit for
a microwave repeater station be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said
request be, and hereby is, set as September 29, 1993, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 18th day of August, A.D. , 1993.

Burlington Northern Railroad has submitted a Use by Special Review
application for permission to construct and operate a private microwave
repeater station at a location southeast of Fort Lupton. Legal description
of the property subject to this Use by Special Review is the E 1/2 NE 1/4
NE 1/4 Section 27, T. 1N, R. 66W, Weld County, Colorado. A purchase
option on this property has been exercised with the landowners.
The proposed microwave facility replaces an existing station located in
Adams County adjacent to the north end of the New Denver Airport. With
the planned opening of the new airport scheduled for December 1993, the
City and County of Denver is urgently requesting that we relocate this
microwave repeater station as soon as possible. To accommodate required
flight testing of the runways , the microwave tower must removed before
opening of the airport.
Various delays has contributed to this late submission of the Use by Special
Review application including difficult negotiations in purchasing the
property for the proposed microwave station and long, extensive dealings
with the City and County of Denver for an acceptable relocation
agreement. Nevertheless, we are under extreme pressure to expedite the
Use by Special Review process.
Therefore, we are respectfully request preadvertising for a Board of
County Commissioner's hearing concerning the land use application on the
above microwave repeater station.

wish to approve this request, the specified date will allow adequate time
for advertising.

NOTICE
Pursuant to the zoning laws of the State of Colorado and the Weld County Zoning
Ordinance, a public hearing will be held in the Chambers of the Board of County
Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th
Street, First Floor, Greeley, Colorado, at the time specified. All persons in
any manner interested in the Site Specific Development Plan and Special Review
Permit are requested to attend and may be heard.
Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped record
which will be kept during the hearing, the Clerk to the Board's Office shall be
advised in writing of such action at least five days prior to the hearing. The
cost of engaging a court reporter shall be borne by the requesting party.
BE IT ALSO KNOWN that the text and maps so certified by the Weld County Planning
Commission may be examined in the office of the Clerk to the Board of County
