RE: APPROVE MEMORANDUM OF AGREEMENT REGARDING CONDUCT OF ELECTION AND
AUTHORIZE CHAIRMAN TO SIGN - WELD COUNTY SCHOOL DISTRICT #6
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Agreement
between the Clerk and Recorder of Weld County and Weld County School District #6,
and
WHEREAS, said agreement is for the administration of specific duties
relative to the conduct of the special budget election for School District #6 to
be held November 3, 1992, pursuant to the Election Code of 1992, CRS Title I,
Articles 1-13, and CRS 22-31-301, with the further terms and conditions being as
stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Agreement between the Clerk and Recorder
of Weld County and Weld County School District #6 be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 28th day of September, A.D. , 1992.

MEMORANDUM OF AGREEMENT
WELD COUNTY SCHOOL DISTRICT NO. 6 , hereinafter referred
to as "the jurisdiction" does hereby agree and contract with the
Board of County Commissioners, hereinafter referred to as the
"Board" , and the County Clerk and Recorder for the County of Weld
and State of Colorado, hereinafter referred to as the "County
Clerk" , for the administration of the following duties relative
to the conduct of the special budget election for the
jurisdiction to be held November 3 , 1992 , pursuant to the Uniform
Election Code of 1992 , CRS Title I, Articles 1-13 , and CRS 22-31-
301.
I.
The said County Clerk agrees to perform the following duties:
A. To accept the text of the ballot for printing as submitted
by the jurisdiction.
B. To arrange with Sequoia Pacific for the printing of the
absentee and official ballots. The County Clerk will order the
number of ballots to correspond to the number of General Election
ballots to be printed for each precinct, the cost of which will
be billed directly by Sequoia Pacific to the jurisdiction.
C. To provide to the jurisdiction for proofing the layout and
text of the absentee and official ballots before authorizing the
printing of the ballots.
D. To appoint and train a sufficient number of qualified
election judges to adequately serve the number of electors
anticipated to vote at the consolidated election within the
jurisdiction.
E. To conduct formal training sessions for the Judges of
Election to be held within the County October 28 and 29 .
F. To provide the following at no additional charge:
1. Security envelopes
2 . "Instructions to Voters" signs
3 . "Vote Here" signs
4 . "100 Foot Limit" signs
5. Plastic bag of miscellaneous items for conduct of
Election
6. Adequate number of pens and pencils
7 . Demonstration punch and demonstration ballots

8 . "Affidavit of Voter Assistance" forms
9 . "Registration Verification" forms
10. Sufficient voting booths and devices per precinct, the
total number to be determined by the number of
registered electors in each of the General Election
precincts within the jurisdiction and the historic
turnout.
11. Ballot boxes
12 . Padlocks and keys
13 . Supply boxes
14 . Black bags
15. Transfer cases
16 . Inner boxes for pre-printed signature cards
17 . Pre-printed sign-in cards
18 . Judges ' name tags
G. To provide and/or print the following at a cost:
1. Judges ' Report Forms - 2 per precinct (or 2 part NCR) .
2 . Pre-printed signature cards.
3 . If directed by jurisdiction:
Sample ballots - adequate supply for pre-election
distribution to the public. Jurisdiction will
determine manner of distribution and provide two (2)
per polling place for "County Clerk" .
4 . Judges manuals (County Clerk generated) .
5 . Any other supplies or services specifically required
for the conduct of the election by the jurisdiction.
6. Precinct Polling Place signs - to be posted by Precinct
Supply Judge.
H. To create for the jurisdiction, as quickly after the closure
of the registration books as possible, a listing of the
registered voters containing names and addresses of each elector
registered to vote in the jurisdiction, if requested.
I . To create the pre-printed signature cards for use by the
Judges of Election at the precinct. The pre-printed signature
cards shall contain, in alphabetical sequence the names and
addresses of electors residing within the Weld County portion of
the school district who have registered to vote on or before
October 9, 1992 . On the signature card of each elector residing
within the Weld County portion of the jurisdiction will appear a

message to "Issue (color) School Ballot" . The pre-printed
signature cards will be generated by a Department of the Board,
Weld Information Services.
J. To certify the number of registered electors within the Weld
County portion of the jurisdiction on or before October 30, 1992 .
K. To provide support on the day of the election via telephone
and in person, should the need arise, from 6 : 15 a.m. until
counting of the jurisdiction' s ballots is completed.
L. To charge the jurisdiction for all staff time for the
preparation and conduct of the election at a prorated rate for
activities relative to the consolidated election as set forth in
Attachment "A" .
M. To pack precinct supplies and prepare the voting equipment
and have the equipment and supplies ready to be distributed to
the various Supply Judges by Monday, November 2 , 1992 . The
supplies will be distributed by the County Clerk. The location
and time of the distribution will be per schedule established by
the County Clerk. The cost of the distribution to be prorated,
based on the number of precincts within the Weld County portion
of the jurisdiction.
N. To provide the Board and the County Clerk' s electronic vote
counting equipment.
O. The Board and the County Clerk will assist the jurisdic-
tion' s representative in performing electronic vote-counting
equipment tests.
P. To certify the results of the jurisdiction' s election on
election night and to provide the jurisdiction with a copy of the
"By Precinct Statement of Vote" not later than November 4 , 1992 .
Q. To capture the vote history for the Election Department' s
vote history file and generate a listing of who voted in the
jurisdiction following the election, if requested.
R. To bill the jurisdiction for the cost of Judges of Election,
one per precinct.
S. To store all voted ballots for a minimum of 6 months and all
signature cards of electors who cast ballots on November 3 , 1992 ,
for a minimum of 25 months, and all other materials required by
general election law to be saved for 25 months in such a manner
that they may be accessed by the jurisdiction, if necessary, to
resolve any challenge or other legal questions that might arise
regarding the election.
T. To otherwise adhere to all applicable provisions of the
Uniform Election Code of 1992 , CRS Title I, Articles 1-13 , and
CRS 22-31-301 which are necessary or appropriate to the perfor-
mance of the above duties.
U. The County and its employees, agents, representatives or
other persons acting under the direction or control of the County

Clerk shall use reasonable care in carrying out its obligations
under this agreement.
V. To bill the jurisdiction for the materials, services, &
mileage in accordance with Attachment "A" to the agreement by
itemized statement.
II .
In consideration of the foregoing, the jurisdiction agrees
as follows:
A. To proof the layout and text of the absentee and official
ballots before authorizing the printing of the ballots.
B. To accept the established General Election precincts and
designated polling places as the official precincts and polling
places for the jurisdiction' s November 3 , 1992 , election.
C. To publish the Legal Notices as set forth in the School
Election Laws.
D. To formally notify each of the County Clerks within the
jurisdiction of the election and request the Certified number of
registered electors residing with the jurisdiction as of the
close of the registration books on October 9 , 1992 .
E. To prepare and run the required test deck at least 24 hours
before the official ballot counting commences and to again run
the same test deck immediately prior to the official ballot
counting and to be present or assign the responsibility to
another for the running of the same test deck immediately
following the ballot count.
F. To remit payment directly to Sequoia Pacific for all costs
relating to the printing of the jurisdiction's ballots.
G. To remit payment for services, supplies and mileage in
accordance with Attachment "A" to the County Clerk upon receipt
of the itemized statement.
H. To provide sample ballots - adequate for pre-election
distribution to the public. Jurisdiction will determine manner
of distribution and provide two (2) per polling place for "County
Clerk" .
III .
General Provisions:
A. No portion of this agreement should be deemed to have
created a cause of action with respect to anyone not a party to
this agreement nor is this agreement intended to waive any
privileges or immunities the parties, or their officers or
employees, may possess.

B. This constitutes the entire agreement of the parties and no
amendment may be made except in writing and approved by the
parties.
