County Attorney Subject: Rocky Mountain Railcar Railroad You conveyed information to indicating that Ron Maynard, President of Rocky Mountain Railcar, has claimed that new activities on the site are exempted because they involve a newly created railroad known as Rocky Mountain Railcar Railroad. You apparently have not been provided any information regarding Articles of Incorporation or any certificates of authority or convenience and necessty_from either state or federal avencies—r--Furthermore you have not been provided information which would indicate what activities are actually being carried out by Rocky Mountain Railcar Railroad. Given this lack of information, I can not advise you that the activities on site are exempt from local regulations under a theory of pre-emption. It may be that some of the activities which are subject to federal regulations are exempt from local regulation but in my view the simple fact that a railroad is involved in or located next to a activity does not, per se, make it exempt from local regulation. Should you be able to obtain necessary documents from Mr. Maynard regarding the authority for exemption from local regulation and an accurate and complete description of the activities claimed to be exempted, I would be able then to review the matter and issue an opinion. In answer to those questions the hours of operation will be from 7 :30 am to 4 : 00 pm Monday thru Friday. The number of trucks entering onto the property we estimate are six per week, these trucks will be tractor trailers . Enclosed you will find a blue print with the area highlighted in yellow were the operation will be located on the property. As for the facilities that will be used, they will be using the existing trackage the was previously used be the Westinghouse Project. The question on how I felt that this fit into the Special Use Permit was also asked. As you may be aware, Rocky Mountain Railcar, Inc. , has a sister company Rocky Mountain Railcar Railroad, Inc. , RMRR is incorporated as a Short Line Railroad and is registered with the ICC. Among RMRR' s current operations are: 1 . Rail serving the new DPC Industries Facilities, which handles and transports chlorine. 2 . Developing rail sevice to the new Denver Inter. Airport 3 . Soliciting customer ' s for the "Team" track unloading ( that is a spot on the railroad to unload-load freight cars to or from trucks) . 4 . Developing and marketing adjacent properties for rail served industries . Chemical Handling Corp. fits into the third category of our business plan. Since RMRR is a registered Railroad, local and state zoning does not apply. With that in mind, how this operation fits into our USR-821 doesn' t become applicable.
